District Court Amendment (Powers of

Judicial Registrar) Rule 2010

The District Court Rule Committee has made the following rule of court under the

District Court Act 1973.

Explanatory note
The object of this Rule is to amend the District Court Rules 1973:

(a)

to omit Part 28C (Court appointed referral for legal assistance) from the Rules as a consequence of provisions to the same effect being included in the Uniform Civil Procedure Rules 2005, and

(b)

to provide that the Judicial Registrar of the Court may exercise the powers of the Court under rule 6, 7 or 10F of Part 53 of the Rules and under the Bail Act 1978.

1      Name of Rules

This Rule is the District Court Amendment (Powers of Judicial
Registrar) Rule 2010.

2      Commencement

This Rule commences on the day on which it is published on the NSW legislation website.

3 Amendment of District Court Rules 1973

(1) Part 28C Court appointed referral for legal assistance

Omit the Part.

(2) Part 43A, rule 1
Omit rule 1 (1) (a). Insert instead:
(a) the powers of the Court in its criminal jurisdiction (except for the Court’s powers under rule 6, 7 or 10F of Part 53 or under the Bail Act 1978), or
