Service) Rule 2012

The District Court Rule Committee has made the following rule of court under the

District Court Act 1973.

Explanatory note

The object of this Rule is to repeal a rule relating to the discontinuation of proceedings in circumstances in which a person served with a summons or order does not file a document in reply to the process and no affidavit of service of the process has been filed. The rule is no longer necessary as it has been superseded by case management procedures under the Uniform Civil Procedure Rules 2005.
