DISTRICT COURT ACT 1973—RULE

NEW SOUTH WALES

[Published in Gazette No. 73 of 27 May 1994]

1. This rule is made by the Rule Committee on 23 March 1994, and

has effect on and from 27 May 1994.

2. The District Court Rules 1973 are amended by inserting after Part 53

rule 11 the following rule:

View of real property

11A. The Court has the same powers as the Supreme Court has to make an order for a view of real property for the purposes of any proceedings.

EXPLANATORY NOTE

The purpose of the amendment is to exercise a power given by the Courts Legislation (Amendment) Act 1993. thus removing doubt as to whether the District Court in its criminal jurisdiction is able to order a view of real property.
