DISTRICT COURT ACT 1973—RULE

NEW SOUTH WALES

[Published in Gazette No. 77 of 23 June 1995]

1. This rule is made by the Rule Committee on 14 June 1995, and has effect on and from 1 July 1995 and in respect only of proceedings commenced on or after 1 July 1995.

2. The District Court Rules 1973 are amended as follows:

(a) Part 5 rule 5 (1)

(i) In paragraph (b) omit “or” where secondly occurring;

(ii) Omit paragraph (c), insert instead:

(c)	if it is a statement of liquidated claim, for 2 years from the date on which it is filed or such further period as the Court may direct; or
(d)	in any other case, for 3 months from the date on which it is filed or such further period as the Court may direct.

Part 24C rule 3 (1) action”.

EXPLANATORY NOTE

The purpose of the amendments is to require service of an ordinary statement of claim, issued on or after 1 July 1995, to be effected within 3 months of issue, or such further period as the Court may allow, so that acceptable time standards can be established for the eventual management by the Court of contested actions.
