DISTRICT COURT ACT 1973—RULE
NEW SOUTH WALES

1. This rule is made by the Rule Committee on 14 June 1995, and has effect on and from 1 July 1995 and in respect only of proceedings commenced on or after 1 July 1995.
2. The District Court Rules 1973 are amended as follows:
(a) Part 5 rule 5 (1)
(i) In paragraph (b) omit “or” where secondly occurring;
(ii) Omit paragraph (c), insert instead:
(c)
if it is a statement of liquidated claim, for 2 years from the date on which it is filed or such further period as the Court may direct; or
(d)
in any other case, for 3 months from the date on which it is filed or such further period as the Court may direct.

EXPLANATORY NOTE
The purpose of the amendments is to require service of an ordinary statement of claim, issued on or after 1 July 1995, to be effected within 3 months of issue, or such further period as the Court may allow, so that acceptable time standards can be established for the eventual management by the Court of contested actions.
