District Court Act 1973 on 9 December 1999.

Explanatory note

The object of this Rule is to amend Part 28, rule 8 of the District Court Rules 1973 to require expert reports to be served in accordance with that rule in all proceedings before the Court. At present, the rule applies only to proceedings in which damages are claimed in respect of the death of a person or personal injury or in which the Court has directed that the rule is to apply to proceedings.

1     Name of Rule

This Rule is the District Court Rule (Service of Expert Reports) 1999.

2 Commencement

This Rule commences on 1 March 2000.

3 Amendment of District Court Rules 1973

The District Court Rules 1973 are amended as set out in Schedule 1.

4 Notes

The explanatory note does not form part of this Rule.

(Clause 3)

Part 28, rule 8

Omit Part 28, rule 8 (1). Insert instead:

(1) This rule applies to any proceedings in the Court.
