District Court Act 1973 on 24 February 2000.

Explanatory note
The object of this Rule is to make miscellaneous amendments to the District Court Rules 1973 concerning proceedings under the Motor Accidents Compensation Act 1999.

1 Name of Rule
This Rule is the District Court Rule (Motor Accidents) 2000.
2 Commencement
This Rule commences on 3 April 2000.
3 Amendment of District Court Rules 1973
The District Court Rules 1973 are amended as set out in Schedule 1.

Omit “Motor Accidents Act 1988” from rule 6 (2) (b) and (c) wherever
occurring.
Insert instead “Motor Accidents Compensation Act 1999”.[2] Part 5, rule 6A
Omit “or section 73 of the Motor Accidents Act 1988” from rule 6A (e)
and (f) wherever occurring.
Insert instead “, section 73 of the Motor Accidents Act 1988 or section
137 of the Motor Accidents Compensation Act 1999”.[3] Part 14A, rule 2 Application for order under s 73 (4) of Motor Accidents Act 1988 or s 137 (4) of Motor Accidents Compensation Act 1999

[6] Part 28, rule 15A Examination etc under section 66A of the Motor Accidents Act 1988 or section 119 of the Motor Accidents Compensation Act 1999
Omit rule 15A (1). Insert instead:
(1) The following applications to the Court must be made on notice of motion before the day on which the proceedings commence to be heard unless the Court in special circumstances otherwise orders:
(a) an application under section 66A (1) of the Motor Accidents Act 1988 or an application for leave of the Court under section 66A (3) or (4) of that Act, (b) an application under section 119 (1) of the Motor Accidents Compensation Act 1999 or an application for leave of the Court under section 119 (3) or (4) of that Act.

Insert “or section 119 of the Motor Accidents Compensation Act 1999” after “Motor Accidents Act 1988”.
[8] Part 31, rule 13A
