Explanatory note

The object of this Rule is to amend Part 29, rule 5 of the District Court Rules

1973 to provide for the return of exhibits.

District Court Rule (Exhibits) 2000

1      Name of Rule

This Rule is the District Court Rule (Exhibits) 2000.

2 Commencement

This Rule commences on 3 April 2000.

3 Amendment of District Court Rules 1973

The District Court Rules 1973 are amended as set out in Schedule 1.

4 Notes

The explanatory note does not form part of this Rule.

(Clause 3)

Part 29, rule 5

Omit rule 5 (1). Insert instead:

(1)

Exhibits in any proceedings must be returned to the persons who produced them (whether on subpoena or otherwise) to the Court or registrar:

(a)

if the Court makes no order that the exhibits be retained—immediately after judgment is given or a final order made, or

(b)

if the Court makes an order that the exhibits be retained—at the expiration of the period of 30 days after judgment is given or a final order made or such other period as may be specified in the order.
