The District Court Rule Committee made the following rule of court under the

District Court Act 1973 on 11 October 2001.

Explanatory note

The object of this Rule is to amend Part 5, rule 5 of the District Court Rules 1973 to provide that a statement of claim is valid for 1 month after the date on which it is filed.

Rule 2001

  1. Name of Rule

    This Rule is the District Court Amendment (Validity for Service)

    Rule 2001.

2 Commencement

This Rule commences on 1 January 2002.

  1. Amendment of District Court Rules 1973

    The District Court Rules 1973 are amended as set out in Schedule 1.

The explanatory note does not form part of this Rule.

(Clause 3)

  1. Part 5, rule 5

    Omit “2 months” from rule 5 (1) (c). Insert instead “1 month”.

  2. Part 5, rule 5 (1) (ci)

    Insert “but before 1 January 2002” after “1 January 1996”.

  3. Part 5, rule 5 (1) (cii)

    Insert after rule 5 (1) (ci):

(cii)

if it is an ordinary statement of claim filed on or after 1 January 2002, for 1 month from the date on which it is filed or such further period as the Court may direct.

Omit the paragraph.
