District Court Amendment (Subpoenas New South Wales

and Contribution) Rule 2001

The District Court Rule Committee made the following rule of court under the

District Court Act 1973 on 29 March 2001.

Explanatory note
The object of this Rule is to amend the District Court Rules 1973:

(a)

to provide that rules 6A and 6C of Part 29 do not apply to subpoenas issued out of the registry at Newcastle and such other registries as may be specified by the Chief Judge by direction published in the Gazette, and

(b)

to provide that Part 39A, rule 26 extends to offers of contribution as well as offers to contribute.

Contribution) Rule 2001

1     Name of Rule

This Rule is the District Court Amendment (Subpoenas and
Contribution) Rule 2001.

2 Amendment of District Court Rules 1973

The District Court Rules 1973 are amended as set out in Schedule 1.

3 Notes

The explanatory note does not form part of this Rule.

Schedule 1 Amendments

(Clause 2)

[1]     Part 29, rule 6D

Insert after rule 6D (3):

(4)

Rules 6A and 6C do not apply to subpoenas issued out of the registry at Newcastle and such other registries as may be specified by the Chief Judge by direction published in the Gazette.

Insert “(or offer of contribution)” after “offer to contribute”.
