DISTRICT COURT ACT 1973 - FORMS

NEW SOUTH WALES

In pursuance of Part 47 rule 2 (2) of the District Court Rules 1973 I have amended the Forms approved for use in the Court as follows:

Form 15A - Notice of appeal under s. 184 (2) of the Transport
Accidents Compensation Act 1987
Omit the Form.
Forms 43 - Notice of bringing money into Court; 44 - Security
to pay into Court; 45 - Authority of insurer; 46 - Notice of
acceptance of money brought into Court; 47 - Notice of
withdrawal of money brought into Court
Omit the Forms.
Forms 94 - Writ of execution; 94A - Writ of specific delivery;
94B - Writ of delivery; 95 - Notice to judgment debtor of writ
of execution; 100 - Notice to judgment debtor of registration of
writ of execution; 102 - Registrar's certificate that land not sold
under writ; 108 - Assurance of land not under Real Property
Act; 119 - Warrant to arrest witness; 120 - Warrant to arrest or
detain a person alleged to be in contempt of Court; 121C -
Warrant for committal; 127 - Summons to claimant to file

of judgment debtor

(i)	Omit "District Court bailiff”, insert instead "Sheriffs Officer or bailiff of the District Court";
(ii)	Before "bailiff where otherwise occurring insert

statement of his claim.
Before "bailiff' where occurring insert "Sheriffs Officer or''.

Form 96 - Notice to person that he is responsible for property

"Sheriffs Officer or'';

(iii) Before "Bailiff' insert "Sheriffs Officer or".

(e)	Forms 97 - Bailiff’s notice of sale of personal property; 124 - Bailiffs notice requiring security.
(i) Omit "Bailiffs notice" where occurring, insert instead

"Notice";

(ii)        Before "Bailiff where occurring insert "Sheriffs Officer or".

(f)

Forms 104 - Notice of sale of land; 106 - Contract of sale of land; 131 - Notice where proceeds of execution required by statute to be retained by bailiff.

(i)	Before "bailiff' where occurring insert "Sheriffs Officer or'';
(ii)	Before "Bailiff' where occurring insert "Sheriffs Officer or''.

(g)

Form 112 - Writ against the person

(i)	Before ''the bailiffs" insert "all Sheriffs Officers and";
(ii)	Before "bailiff" where occurring insert "Sheriffs Officer or";

(iii) Before "bailiffs" insert "Sheriffs Officer's or". Form 121A - Warrant to arrest and keep in custody Before “bailiff” insert "Sheriff or".

(h)

(j)

Form 126 - Bailiff's application for relief by way of interpreter

(ii)	Omit "Bailiffs Statement", insert instead "Statement".
