A.D. 1897.
An
HEREAS doubts have arisen in relation to certain District Preamble.
W | Couucil elections, and it is desirable that such doubts should |
advice and consent of the Parliament of South Australia, as follows:
1, This Act may be cited as " The District Councils Electionsshort title.
Validating Act, 1897."
2, No annual election of Councillors or Auditor under " The Certain elections
District Councils Act, 1887," held in the
hundred and ninety-seven shall be invalid by reason of the day of
nomination having taken place on any day other than that required
by law: Provided always that nothing in this section shall affect
any judgment, order, or decision made or given before the passing
of
persons not |
from being or continuing a Councillor under | The District Councils being Councflla8. |
(a ) His being or becoming indebted to the District Council for
wire netting supplied under | The Vermin-proof Fencing |
Act, | 1890 ": |
( b ) His being or becoming indebted to the District Council for
seed wheat supplied under | The Seed Wheat Act, |

to use and occupy, any road under section 286 of | The |

Provided that no Councillor shall vote on any question in which
he is personally interested.
Amendmentofsection | 4. The words | 011 the third business day after " in the fourth |
and fifth lines of section 96 of The District Councils Act, 1887," are hereby struck out, and the following words inserted in lieu
thereof, namely, | on the day following." |
5, For the purposes of section | The District Councils |
1887," the word "election" shall be deemed to mean the taking the poll on an adjournment, under section 68, of the proceedings in the event of there being more candidates nominated than are
required to be elected.
