STATUTORY RULES.
REGULATION UNDER THE DISTILLATION ACT 1901-1934.*

Amendment of the Distillation Regulations.
The Distillation Regulations are amended by inserting after regulation 129 the following heading and regulations:—
“Working Days and Hours for Distilleries.
“130.—(1.) Subject to regulations 131and 132 of these Regulations, all work at Distilleries and Vigneron’s premises shall be performed only on the prescribed working days and during the prescribed working hours.
“(2.) Subject to sub-regulation (3.) of this regulation—
(
a ) the working days shall be all days except Sundays and public holidays; and(
b ) the working hours shall be from 8 a.m. to 5 p.m. on each day from Monday to Friday, and 8 a.m. to 12 noon on Saturdays.
“(3.)The Collector may approve that the working days shall be Monday to Friday (but not including any public holiday) and that the working hours shall be such hours worked from Monday to Friday in equal daily periods, as the Collector specifies:
Provided that the working hours shall not commence before 7 a.m. on any day.
“131.The Minister may permit work to be performed on Sunday, Christmas Day, Good Friday, Anzac Day or Eight Hours’ Day or Labour Day (as the case may be) for such time and subject to such conditions as he thinks fit, and the Collector may permit work to be performed on any other day which is not a working day for such time and subject to such conditions as he thinks fit.

“132. Subject to regulation 131, the Collector may permit work to be performed outside the working hours fixed by sub-regulations (2.) and (3.) of regulation 130 of these Regulations, for such time and subject to such conditions as he thinks fit.
“133.—(1.) Where the Collector permits work to be performed otherwise than on a prescribed working day or during the prescribed working hours (except where shift work is performed by direction of the Collector and such work does not involve the payment of overtime) a charge at the rate of four shillings and sixpence per hour or part thereof shall be made against the distiller or vigneron for the services of each officer required to be in attendance:
Provided that—
(
a )where the service is performed on a public holiday—the charge shall be for not less than four hours except where the service is continuous with overtime worked on the previous day; and(
b ) where the service is performed on a working day but outside working hours—the charge shall be for not less than two hours except where the service is continuous with prescribed working hours.
“(2.) The charge shall be calculated from the hour from which the attendance of the officer is necessary and, when the service is not continuous with prescribed working hours, shall include a charge in respect of the time reasonably occupied by the officer in proceeding to and from the place where the attendance is required.
“(3.) The money received for overtime shall be held by the Department and payment shall be made to the officer who has earned the overtime.”.
