s1 2 s4 Disposal of Unexecuted Warrants Amendment No. 52, 1996 (No. 1) ˙ Short title 1. This regulation may be cited as the Disposal of Unexecuted Warrants Amendment Regulation (No. 1) 1996 . ˙ Regulation amended 2. This regulation amends the DisposalofUnexecutedWarrantsRegulation 1988 . ˙ Amendment of s 1 (Citation) 3. Section 1, heading— omit, insert Short title ’. ˙ Replacement of ss 4 and 5 4. Sections 4 and 5— omit, insert ˙ Approved form of application to clerk of the court for fresh warrant—Act, s 5(4)(a) 4.(1) An approved form of an application to the clerk of the court Brisbane for the issue of a fresh warrant must provide for the following information— (a) the name of the authorised police officer making the application; (b) the type of warrant cancelled; (c) the purpose for which the warrant was issued; (d) the day and place the warrant was issued; (e) the day the warrant was cancelled. (2) An application must be signed by the authorised police officer making it.
s5 3 s6 Disposal of Unexecuted Warrants Amendment No. 52, 1996 (No. 1) ˙ Approved form of application to judge for fresh warrant—Act, s 6(6)(a) 5.(1) An approved form of an application to a judge of the District or Supreme Court for the issue of a fresh warrant must provide for the following information— (a) the name of the prescribed person making the application; 1 (b) the type of warrant cancelled; (c) the purpose for which the warrant was issued; (d) the day and place the warrant was issued; (e) the day the warrant was cancelled. (2) An application must be signed by the prescribed person making it.’. ˙ Insertion of new s 7 5. After section 6— insert— ˙ Repeal 7. All subordinate legislation (other than this regulation) made under the Act, and in force immediately before the commencement, is repealed.’. ˙ Omission of schedule 6. Schedule— omit. 1 Under section 6(8) of the Act, a prescribed person is the director of public prosecutions, a deputy director of public prosecutions, or the person on whose application the cancelled warrant was issued or someone else acting for the person.
