An Act to further amend the Diseases in

Sheep Acts and for other purposes. [21st
November , 1882.]
WH E R E A S of 1 8 6 6 " and t h e "Diseases in Sheep Ac t s A m e n d m e n t A c t of
it is expedient to a m e n d t h e " Diseases in Sheep A c t
1 8 7 8 " and t h e " Reg is t ra t ion of Brands A c t of 1 8 6 6 " B e i t therefore

enacted by t h e Queen ' s Mos t Exce l len t Majes ty by a n d wi th t h e advice and consent of t h e Legislat ive Council and Legis la t ive Assembly of N e w South W a l e s in P a r l i a m e n t assembled and b y t h e au thor i ty of t h e same as follows :—

1. This A c t m a y be cited as t h e " Diseases in Sheep Ac t s A m e n d m e n t A c t of 1 8 8 2 " a n d shall be read and const rued w i t h t he " Diseases in Sheep A c t of 1 8 6 6 " and t h e "D i sea se s in Sheep Acts A m e n d m e n t A c t of 1 8 7 8 " and t h e " R e g i s t r a t i o n of Brands A c t of 1866 . "

2. No twi th s t and ing a n y t h i n g contained in t h e Diseases in Sheep

A c t s hereinbefore men t ioned or in t h e " Regis t ra t ion of Brands A c t of 1 8 6 6 " t h e following provisions shall after t h e pass ing of th is A c t be in force and t ake effect name ly—

(I.) The Minis te r m a y from t i m e to t ime notify in t h e Gazette

one or more poll ing-places in a sheep distr ict a t which the votes of owners ent i t led to vote a t the election of directors m a y be t a k e n in addit ion to t h e pol l ing-place a t wh ich the

r e t u r n i n g officer for t h e distr ict presides I n t h e case of a
n e w dis t r ic t or i n a n y emergency t h e Min is te r m a y appo in t
t h e r e t u r n i n g officer and in t h a t of ex is t ing distr icts t h e
c h a i r m a n of t h e ou t -go ing Board of Sheep Directors shal l
be t h e r e t u r n i n g officer A n d t h e r e t u r n i n g officer shal l for

each of such addi t ional poll ing-places appoint a depu ty r e tu rn ­ ing officer who shall conduct t h e election a t such addi t ional poll ing-places as provided by the " Diseases in Sheep A c t of 1 8 6 6 " and the " Diseases in Sheep Acts A m e n d m e n t A c t of

said persons to be duly elected. (II . )

thereof in due course to t h e r e t u r n i n g officer who shall as soon as pract icable on a day a n d hour to be fixed announce t he resul t of t he election a n d publish t he same in t h e Gazette Provided t h a t in all cases of doubt or d ispute t h e decision of t h e r e t u r n i n g officer or depu ty r e t u r n i n g officer as t he case m a y be shal l be final a n d conclusive Provided also t h a t a n y vacancy in a Board of Directors caused b y death res ignat ion absence of more t h a n six m o n t h s from t h e distr ict or other­ wise shall be filled u p by t h e Board a t a special mee t ing of wh ich no t less t h a n t e n clays not ice shall be given to t h e members of t h e Board N o candidate shal l be eligible for election unless h e shall have been n o m i n a t e d in wr i t ing by two persons qualified to vote and the nomina t ion paper w i t h t h e candidate ' s consent the re to shall have been placed in t h e hands of t he r e t u r n i n g officer a t least four teen days before

t he day of election I n t he event of only five persons be ing
nomina ted t h e r e t u r n i n g officer shal l for thwi th declare t h e

(II.) W h e r e a n owner in conformity wi th t he law is provided w i t h a certificate g ran ted by an inspector wh ich conta ins

t h e

par t i cu la rs requi red to be set for th in a n y pe rmi t t rave l l ing
s t a t emen t or del ivery-note in regard to t h e n u m b e r k ind

ownership s t a r t ing point route a n d dest inat ion of any s tock i t shall no t be necessary in such a case to provide e i ther a pe rmi t t rave l l ing s t a t emen t or del ivery-note for such stock and t h e certificate shall be held a n d deemed to be also a pe rmi t t rave l l ing s t a t emen t or delivery-note as t h e case m a y

requ i re W h e r e the owner of any stock is provided with a
pe rmi t ne i ther a t rave l l ing s t a t emen t nor del ivery-note shal l

be necessary A n d where ne i ther a certificate nor pe rmi t is necessary t he owner in charge of any stock if they be on land other t h a n t h a t in t h e occupat ion of such owner shall be provided wi th a t ravel l ing s t a t emen t and a delivery-note shall in t h a t case not be necessary.

(III.) The dura t ion of qua ran t ine for impor ted sheep a r r iv ing by

sea from any of the Aus t ra l i an Colonies t h e n u m b e r of dressings and t h e med icaments to be used shall be such as shall from t ime to t ime be fixed by regula t ions .

(IV.) Sheep directors whi le necessarily employed as such shall be al lowed t ravel l ing expenses a t t h e ra te of one pound per day and where t h e dis tance exceeds t w e n t y miles t h e a l lowance shal l be a t t he ra te of one shi l l ing per mi le coun t ing one way only such a l lowance be ing in full of all expenses payable to directors ac t ing as such or as inspectors unde r th i s or any o ther Diseases in Sheep A c t o ther t h a n in t h e case of appeals

and applicat ions.
