B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. This Act may be cited as "The Diseases in Short title PO'ttltry Act Amendment Act of 1937," and shall be read: ~~ c~~ ~ ~. as one with *" The Diseases in Pmtltry Act of 1923," hereinafter referred to as the Principal Act. The Principal Act and this Act may collectively be cited as " The Diseases in Poultry Acts, 1923 to 1937." Amendments of the Principal Act. 2. Section two of the Principal Act is hereby Amendment amended, as follows :_ of s. 2. (a) The definition of the word "Disease" is repealed and the following new definition is inserted in lieu thereof, namely:- " " Disease "-Favus (Zophophyton Gallince), fowl Disease. cholera, fowl typhoid, fowl pox, fowl pest (all varieties). gapes (infestation of poultry with Syngamus trachealis), infectious bronchitis (Laryngo tmcheitis) , mites (all kinds). neuro-lymphomatosis, poultry lice (all kinds), poultry tick (Argus Persicus) , pullorum disease (bacillary white diarrhrea, poultry), scabies (Sarcoptes lcevis), stickfast flea (Echidusphaga Gallinacea) , tuberculDsis, tumours, vent gleet, and any other disease affecting poultry which the Governor in Council by Order in Council declares to be a disease under and for the purposes of this Act." * 14 Geo. v. (b) The following definitions are inserted before the definition of the word" Destroy," namely:- " " Chief Poultry Expert "-The officer entrusted with the poultry activities of the Department of Agriculture and Stock; " Day-old chicken "-The young of any species of poultry which has not distinctively developed the external characteristics of the male or female of its species." Amendment 3. Subsection one of section three of the Principal of s. 3. Act is hereby amended by the insertion in the first paragraph thereof after the word "appoint" of the words "a Chief Poultry Expert and"; and the said subsection is further amended by the repeal in the second paragraph thereof of the words "No such inspector," and by the insertion therein in lieu of such repealed words of the words " Neither the Chief Poultry Expert nor any such inspector." New ss. 3A, 4. The Principal Act is hereby amended by the 3B, and 3e. insertion therein after section three of the following new sections numbered 3A, 3B, and 3c, namely:- Licensing of "[3A.] (1.) The Minister may, upon .the recom- qdpueertaesloirfmniesidneto tmoelnicdeantisoenaonfy tpheersCohnieafsPaoupletrrsyonOfqfuicaelri, fileicdetnosedoetrerremfuinsee sdeaxy-oofld the sex of day-old chickens: chickens. Provided that the Minister shall not license any such person as aforesaid unless and until such person has passed such examination as may be approved by the Minister: Provided further, that nothing in this subsection contained shall compel or be. deemed to compel the Minister to grant any such license. Further powers of Minister as to licenses. (2.) The Minister may at any time cancel any license granted by him under and pursuant to subsection one of this section, or may direct the holder thereof to present himself for re-examination at a time and place to be appointed by the Minister. The license of any person'licensed under subsection one of this section who fails to present himself at the appointed tinie and place for, or having so presented himself fails to pass, such re-examination shall be and be deemed to be cancelled.

Where a license is cancelled under this subsection the holder thereof shall no longer be or be deemed to be licensed under and· pursuant to subsection one of this section. It shall be immaterial that the holder concerned has not delivered up his license to the Under Secretary, Department of Agriculture and Stock. (3.) Every license granted under subsection one ·of I?uration of this section shall unless sooner cancelled remain in hcense. force for one calendar year from the date of the granting thereof, but may from time to time be renewed for a like period upon application for such renewal before the expiration thereof. (4.) A certificate by the Under Secretary, !.'roof of Department of Agriculture and Stock, that any person hcenses. named in such certificate is licensed under subsection one of this section shall in the absence of proof to the contrary be sufficient evidence that such person is so licensed; and a certificate by the said Under Secretary that any person named in such certificate is not so licensed or that the license of such person has been cancelled shall in the absence of proof to the contrary be sufficient evidence that such person is not so licensed or, as the case may be, that the license of such person has been cancelled. Any certificate purporting to be a certificate by the Under Secretary, Department of Agriculture and Stock, as aforesaid shall be admissible in all proceedings whatsoever, and every court, judge, and justice shall take judicial notice of the signature of the said Under Secretary thereto. The failure by any such licensee to produce such license upon any such demand as aforesaid shall render such licensee liable to a penalty not exceeding fifty pounds. [30.] When the license of a person licensed under ~ en this Act as a person qualified to determine the sex of ~ ~ li~ ~~ e;; day-old chickens is cancelled the Under Secretary, his license. Department of Agriculture and Stock, shall forthwith serve upon such person a notice in writing requiring him to deliver up his license to the said Under Secretary.

No. 21, - -- - - - -- - -- . -- - ~ Such notice may be served upon such person by delivering same to him in person or by a prepaid post letter addressed to him at his last known place of abode or business. The failure by a licensee whose license has been cancelled to deliver up his license to the said Under Secretary within seven days after the service upon him of a notice as aforesaid shall render such licensee liable to a penalty of not more than twenty pounds." Amendment 5. Section seven of the Principal Act is hereby of s. 7. amended, as follows :_ Notifiable disease. (a) The said section is renumbered subsection two of section seven and the following new subsection one is inserted therein,..namely :- "(1.) The Governor in Council may at any time and from time to time declare by Order in Council published in the Gazette that any disease is a notifiable disease under and for the purpose~ of this Act." (b) Subsection two of the said section (being the said section as renumbered subsection two of section seven by paragraph (a) of this section) is amended by repealing the first paragraph thereof and by inserting in lieu of such repealed paragraph the following paragraph, namely :- " Every owner, when any notifiable disease appears among his poultry, shall before the expiration of one week after the appearance of such disease give notice thereof to the nearest inspector or to the Under Secretary, Department of Agriculture and Stock." News.7A. Offence to sell, &c., diseased poultry. 6. The Principal Act is hereby amended by _the insertion therein after section seven of the following new section numbered 7 A, namely : - " [7 A.] (1.) Any person who (and whether as principal or agent) sells, or attempts to sell, or has in his possession for sale, or forwards or delivers for sale any poultry which is diseased or unfit for human consumption shall be guilty of an offence and liable to a penalty of not more than fifty pounds. Diseases in Poultry Act Amendment Act. .or unfit for human consumption, or which is the carcass .of any poultry which has died otherwise than by slaughter, shall be guilty of an offence and liable to a penalty of not less than ten pounds nor more than one hundred pounds. In any proceedings for an offence against this subsection the averment in the complaint that the -carcass of any poultry the subject-matter of such pro- ceedings was for human consumption shall, in the .absence of proof beyond reasonable doubt by the defendant to the contrary, be sufficient evidence of the fact so averred." . 7. Section eight of the Principal Act is hereby Amendment .amended by the insertion therein after paragraph (ii.) of s. 8. thereof of the following new paragraph numbered (iii.), namely:- " (iii.) Order the destruction of any poultry forwarded to or in the possession of an agent for sale (and whether the sale thereof has been completed or not) which is in his opinion diseased or otherwise unfit for human consumption." 8. The first· paragraph of section nine of the Amendment Principal Act is hereby repealed and the following new of s. 9. paragraphs are inserted in lieu thereof, namely:- "Except as hereinafter provided, any person who thinks himself aggrieved by an order of an inspector may appeal to the Minister on giving to the Minister or to such inspector notice in writing within seven days after the making of such order: Provided that no appeal to the Minister shall lie against any order of an inspector made under and in pursuance of paragraph (iii.) of section eight of this Act." 9. No. 21, or in respect .of anyone transaction, determines or purports to determine or gives an opinion upon, or advertises or notifies that he will determine, or attempt to determine, or give an opinion upon the sex of day-old chickens; or (b) Whether for or in expectation of any fee, gain, or reward, or not, and either generally or in respect of anyone transaction, determines, or purports to determine, or gives an opinion upon the sex of day~ old chickens (and whether the property of himself or of any other person) which are for sale, or intended for sale, or had in possession for sale; or (c) Falsely represents himself (and whether verbally, or in writing, or .by conduct, or in any other manner whatsoever) to be ·licensed under this Act as a person qualified to determine the sex of day-old chickens, or to be the person named in a license issued under this Act to a person qualified to determine the sex of day-old chickens, shall be guilty of an offence and liable to a penalty of not more than fifty pounds. Any inspector or member of the Police Force may seize any license issued under this Act to a person qualified to determine the sex of day-old chickens which is found by him in the possession of any person other than the person named in such license. When [lOB.] Any person who (and whether as principal ooffffeenr cfeorto or &gent) sells, or attempts to sell, or offers for sale, sale, &c., or has in his possession for sale, or advertises or notifies aosr pcoucllkeetrsels that he has for sale, or has. in his possession for sale day-old male or female day-old chickens shall, unless the sex chickens. of such day-old chickens has been determined to be male or, as the case may be, female by a person licensed under this Act as qualifiedto determine the sex of day- old chickens, be guilty of an offence and liable to a penalty of not more than fifty pounds. Vendor to [lOc.] (1.) The seller (and whether as principal or sopfedcaifyy- osledx agent) of any day-old chickens shall inform every chickens. prospective purchaser thereof, or, if so required by such

Diseases in Poultry Act Amendment Act. prospective purchaser, state in writing to him, as to whethe~ - > ( ) Such day-old chickens are of mixed sex, > that is to say, that their sex has not been determined by a person licensed under this Act as a person qualified to determine the sex of day-old chickens; or (b) Such day-old chickens are cockerels, that is to say, that their sex has been determined to be male by a person licensed under this Act as a person qualified to determine the sex of day-old chickens; or (c) Such day-old chickens are pullets, that is to say, that their sex has been- determined to be female by a person licensed under this Act as a person qualified to determine the sex of day-pld chickens. In the event of such seller informing or stating in writing toa prospective purchaser that the day-old chickens concerned an' cockerels or pullets within the meaning of paragraph (b) or paragraph (c) of this subsection, he shall include in such information or statement the name of the person licensed under this Act as a person qualified to determine the sex of day-old chickens who determined the sex thereof. (2.) The seller (and whether as principal or agent) Account- of any day-old chickens shall, upon every account-sales, ~ al~ s, &c., receipt, or other document relating to such sale issued e~d; rsed by him to the purchaser thereof, endorse the following ;;ith i1 x of words and particulars, that is to say- c~fc~ns. (a) Where such day-old chickens are of mixed sex within the meaning of paragraph (a) of subsection one of this section, the words " day-old chickens"; or (b) Where such day-old chickens are cockerels within the meaning of paragraph (b) of subsection one of this section, the words "cockerel day-old chickens" and the name of the person licensed under this Act as a person qualified to determine the sex of day- old chickens who has determined that such chickens are cockerels; or

No. 21, (c) Where such day-old chickens are pullets within the meaning of paragraph (c) of subsection one of this section, the words "pullet day-old chickens" and the name of . the person licensed under this Act as a person qualified to determine the sex of day-old . chickens who has determined that such chickens are pullets. Warranty. (3.) Information or a statement in writing given or made under and pursuant to subsection one of this section, or words endorsed upon an account-sales or receipt, or other document relating to a sale of day-old chickens under and pursuant to subsection two of this section shall according to the nature of such information or endorsement be and be deemed to be a warranty' by the seller (and whether as principal or agent) to the prospective purchaser or purchaser that the day-old chickens in respect of which such information is given or statement or' endorsement made are of mixed sex, or contain not less than eighty-five per centum of cockerels, or contain not less than eighty-five per centum of pullets within the meaning, respectively, of paragraph (a) or paragraph (b) or paragraph (c) of subsection one of this section, and that the person named as having determined any day-old chickens to be cockerels or pullets is a person licensed under this Act as qualified to determine the sex of day-old chickens, and has in fact determined the sex of such day-old chickens to be male or, as the case may be, female. (a) J!.. ails to give to a prospective purchaser thereof the information or, if so required by such purchaser, the statement in writing prescribed by subsection one of this section, or gives to such prospective purchaser any information or statement in writing prescribed by the said subsection which is false in a material particular; or (b) Issues to the purchaser thereof an account- sales, receipt, or other document relating to a sale of day-old chickens which does not contain the endorsement prescribed by sub- section two of this section, or issues to such purchaser an account-sales, receipt, o~ other

Diseases in Poultry Act Amendment Act. document relating to a sale of day-old chickens containing any endorsement pre- .scribed by the said subsection which is false in a material particular, shall be guilty of an offence and shall be liable to a penalty of not more than fifty pounds: Provided that nothing in this subseotion shall prejudjce any civil right or remedy which any person may have against such seller: Provided further, that it shall not be a defence to a charge of an offence against this section to prove that the sale of the day-old chickens the subject-matter of such charge was not completed or was rescinded. [lOD.] (1.) Every person licensed under this Act as a ~ 1: arking of person qualified to determine the sex of day-old chickens cocker~ l shall mark in the prescribed manner and with the pre- ~ ~ ki~ ~ ns. scribed stain all day-old chickens the sex of which is determined by him to be male. (2.) No person shall (and whether as principal or agent) sell, or attempt to sell, or offer for sale, or have in possession for sale any day-old chickens, other than cockerel day-old chickens the sex of which has been determined to be male by a person licensed under this Act as a person qualified to determine the sex of day-old chickens, which have been marked with a stain prescribed for the marking of cockerel day-old chickens the sex of which has been determined to be male by a person licensed under this Act as a person qualified to determine the sex of day-old. chickens. (3.) No person shall (and whether as principal or agent) sell, or attempt to sell, or offer for sale, or have in possession for sale day-old chickens the sex of which . has been determined to be male by a person licensed under this Act as a person qualified to determine the sex of day~ old chicken~ unless all such chickens are marked with the prescribed stain. (4.) Where some only of a lot of day-old chickens are marked with a stain prescribed for marking day-old chickens the sex of which has been determined by a person licensed under this Act as a person qualified to determine the sex of day-old chickens then, and in every such case, any person who (and whether as principal or agent) sells, or attempts to sell, or offers for sale, or has

No. 21, in his possession for sale such lot of chickens shall securely fasten or attach to the container holding such chickens a label or other notice clearly and legibly indicating that an such chickens marked with such stain are cockerels. (5.) No person shall (and whether as principal or agent) sell, or attempt tosell~ or offer for sale, or have in possession for sale any day-old chickens which have been marked with any stain whatsoever by a person other than a person licensed under this Act as a person qualified to determine the sex of day-old chickens; and no person so licensed shall mark with any stain whatsoever any day-old chickens other than day-old chickens the sex of which has been determined by him to be male, or mark with a stain other than the approved stain any day-old chickens the sex of which - has b . een determined by him to be male. (6.) Any person who contravenes or fails to comply with any provision of this section shall be guilty of an offence and liable to a penalty of not more than fifty pounds." New s. lOE. 10. The Principal Act is hereby amended by the insertion therein after section IOD, as previously inserted by section nine of this Act, of the following new section numbered IOE, namely:- Agent not "[10E.] ",There the fees, charges, commISSIOn, t&oc.c,heaxrcgees, s reward or other remuneration which an agent shall be or improper entitled to receive for or in respect of ahy service or fees, &c. transaction relating to the sale by him as an agent of poultry are prescribed, any agent who, for or in respect of such service or transaction, demands, receives, or retains from moneys received by him an amount by way of fees, charges, commission, reward, or other remuneration which is in excess of or not included in the fees, charges, commISSIOn, reward, or other remuneration, as the case may be, so prescribed shall be guilty of an offence and liable to a penalty of not more than one hundred pounds: Provided moreover that any covenant, agreement, or stipulation to pay or allow or to waive or surrender any right or remedy in respect of any such excess or improper fee, charge, commission, reward, or other remuneration shall be absolutely void and of none effect whatsoever."

The Principal Act is hereby amended by the New s. lOF. insertion therein after section lOE, as previously inserted by section ten of this Act, of the following new section numbered lOF, namely;- "[10F.] (1.) Any owner who is desirous of registering his Proc~ dure to hatche . r • y under this section shall make application in the r o e b g t~ Is Itn rat' IOn. prescnbed form accompanied by the prescribed fee to the Under Secretary, Department of Agriculture and Stock, and upon the registration of such hatchery the said Under Secretary shall issue to him the prescribed <lertificate of registration. Every registration of a hatchery granted under this Act shall continue in force until the last day of the <lalendar year during which same was granted, but may from time to time be renewed for the next ensuing <lalendar year upon payment before the date of the expiration thereof of the prescribed renewal fee. (3.) Any owner of a hatchery other than a hatchery Offences. which is registered under this Act who- (i.) Advertises or notifies or in any other manner represents that his hatchery is registered; or (ii.) Has any words, signs, or letters displayed in any manner whatsoever, or allows to remain unobliterated any words, signs, or letters that have been so ilisplayed over or about any land, premises, or place upon which his hatchery is situated that lead to the belief or supposition that such hatchery is registered; or (iii.) Places or causes to be placed any placard, board, writing, or thing in the public view to the intent that it may be believed or supposed that such hatchery is registered, shall be guilty of an offence. If the owner' of a hatchery who has been convicted of an offence against this subsection allows the words, signs, or letters, or the placard, boar~ , writing, or thing in respect of which he was convicted to remain unobliterated or in the public view, as the case may be, for a period of three days following such conviction,

No. 21, any inspector may obliterate or cause to be obliterated such words, signs, or letters, or may remove or cause to be removed such placard, board, writing, or thing, and for- that purpose the inspector concerned and/or any person authorised in writing by him may enter upon such hatchery or other place where such letters, signs, words" placard, board, writing, or other thing is or are. • Registration (4.) Nothing in this section contained shall compel voluntary. or be deemed to compel any owner of a hatchery to register same: Provided however that the Minister may refuse to register any hatchery or at any time cancel the registration of any hatchery without assigning any reason for such refusal or cancellation. Proof of . (.5.) In any proceedings for an offence against this registration. section the averment in the complaint that the hatchery the subject-matter of such proceedings is not registered shall, in the absence of the production of the proper certificate of registration therefor, be sufficient evidence of the fact so averred." New s. lOa. 12. The Principal Act is hereby amended by the insertion therein after section 10F, as previously inserted by section eleven of this Act, of the following new section numbered lOG, namely:- Certificate that hatchery free from certain diseases. "[lOG.J (1.) Where the Minister is satisfied that the young of poultry produced at any registered hatchery are free from pullorum disease or any other disease capable of being transmitted to the young of poultry by reason of their becoming infected at or immediately after hatching, or by reason of the eggs from which they are produced having become infected before hatching, he may issue a certificate to that effect to the owner of such registered hatchery: Provided that the Minister may refuse to issue such certificate or may at any time cancel any such certificate without assigning any reason for such refusal or cancellation. Offences. . (2.) Any owner who advertises or notifies or in any way holds out that any hatchery owned by him, other than a registered. hatchery in respect of which he has received the certificate prescribed by subsection one of this section, is free from pullorum disease or any other disease capable of being transmitted to the young

Diseases in Poultry Act Amendment Act. of poultry by reason of their becoming infected at or immediately after hatching, or by reason of the eggs from which they are produced having become infected before! hatching, shall be guilty of an offence and liable to a penalty of not more than fifty pounds. (3.) In any proceedings for an offence against this Evidence. section the averment in the complaint that the defendant owned a hatchery other than a registered hatchery in respect of which he had received the certificate prescribed by subsection one of this section shall unless such certificate is produced in evidence in respect of such hatchery be sufficient evidence of the fact so averred." 13. Section twelve of the Principal Act is amended Amendment by repealing the second paragraph thereof, being the of s. 12. paragraph commencing with the words " All such" and ending with the words" this Act." 14. The Principal Act is hereby amended by the New ss. 13 insertion therein after section twelve of the following and 14. new sections numbered thirteen and fourteen, namely:- &:.,;0 " [13.J All Orders in Council and regulations made Regulations, or purporting to have been made under this Act shall have upon being published in the Gazette have the same force e ee. and effect as if they were enacted in this Act and shall be judicially noticed, and shall not be questioned in any proceedings whatsoever. The publication in the Gazette of any such Order in Council or regulation shall be conclusive evidence of the matters contained therein and of the power and authority to make such Or0-er in Council or regulation. Any Order in Council made under this Act may be amended or rescinded by any later Order in Council. [14.J This Act and every Order in Council and Construe .. regulation made thereunder shall be read and construed tion. subject to the *Commonwealth of Australia Constitution Act, and so as not to exceed the legislative power of the State, to the intent that where any enactment thereof or 'provision contained in any such Order in Council or regulation would but for this section have been construed as being in excess of that power it shall nevertheless be a valid enactment or provision to the extent to which it is not in excess of that power." * Imperial Act 63 and 64 Vie., cap. 12.

New cc. 17, (d) The following new clauses, numbered respectively 2 1 0 8 . ,19, and seventeen, eighteen, nineteen, and twenty, are added to the said Schedule ;- Stains "[17.] Prescribing stains to be used for the marking of day-old for marking chickens the sex of which has been determined to be male by a cockerel day-old chickens. person licensed under this Act as a person qualified to determine the sex of day-old chickens. Disinfection [18.] Prescribing and regulating the disinfection of crates, coops, of crates, boxes, or other containers used for confining or transporting poultry, &c. and the persons who shall be responsible for such disinfection. Fees, &c. [19.] Prescribing the fees, charges, commission, reward, or other remuneration that agents shall be entitled to receive for or in respect of the services or transactions carried out by them in relation to the sale of poultry, and the maximum amounts thereof.
