No. 35 of 1953.
AN ACT to prohibit the importation into this State of certain desiccated coco-nut, to empower the Commissioner of Public Health to destroy certain desiccated coco-nut without payment of compensation and for other purposes.

BE it enacted, by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:-
1. This Act may be cited as the Diseased Coco-nut narlatm.

2. (1) A person shall not import or introduce =gag
into this State any desiccated coco-nut which is Ter-sntitt
contaminated with the germs or organisms of a dangerous infectious disease or an infectious disease.
(2)
For the purpose of this Act the expressions "dangerous infectious disease" and "infectious disease" have the same meaning as those respective expressions have in the Health Act, 1911-1952.
(3) A person who contravenes this section is guilty of an offence.
Penalty—One month imprisonment or a fine of two hundred pounds.

STE7Z goner 3. (1) Notwithstanding the provisions of the
?arc Health Act, 19114952, or of a notice or order issued or given pursuant to any one of those provisions, the Commissioner of Public Health may for the purpose of more effectually checking or preventing the spread of a dangerous infectious disease or an infectious disease, seize and destroy or cause to be destroyed or disposed of in such manner as he deems fit any desiccated coco-nut which is
| (a) | found in this State; |
| (b) | produced in or received from Papua; and |
| (c) | in his opinion contaminated with or likely to be contaminated with the germs or organisms of a dangerous infectious disease or an infectious disease. |
(2) Where desiccated coco-nut is destroyed or disposed of pursuant to the provisions of subsection (1) of this section, the owner of the coco-nut or any other person is not entitled to compensation.
(3) Where any desiccated coco-nut has been destroyed disposed of or delivered before the fifteenth day of September, one thousand nine hundred and fifty-three, pursuant to the powers conferred by section two hundred and fifty-one of the Health Act, 1911-1952, or an order issued under that section, the owner is entitled to compensation to the extent and subject to the conditions set forth in section two hundred and fifty-nine of that Act but not otherwise.

The provisions of this Act are in addition to those of the Health Act, 1911-1952, and except as modified by the provisions of this Act, the provisions of the Health Act, 1911-1952, apply to desiccated coco-nut.

This Act shall continue in operation until the
thirty-first day of December, one thousand nine
hundred and fifty-four, and no longer.
