Discrimination (Amendment) Act (No. 3)

An Act to amend the Discrimination Act 1991

[Notified in ACT Gazette S289:  22 December 1994]

The Legislative Assembly for the Australian Capital Territory enacts as follows:

Short title

1.  This Act may be cited as the Discrimination (Amendment) Act (No. 3) 1994.

Commencement

2.  This Act commences on the day on which it is notified in the Gazette.

Principal Act

3.  In this Act, “Principal Act” means the Discrimination  Act 1991.1

Conciliation

4.  Section 80 of the Principal Act is amended by adding at the end the following subsection:

“(2)  Evidence of anything said or done in the course of conciliation proceedings in relation to a complaint is not admissible—

(a)in subsequent proceedings under this Act; or

(b)in proceedings, pursuant to section 94, for the review of a direction or other decision of the Commissioner;

relating to the complaint.”.
