Disability Services Amendment

Regulations 2017

Made by the deputy of the Governor in Executive Council.

1.             Citation

These regulations are the Disability Services Amendment
Regulations 2017.

2.             Commencement

These regulations come into operation as follows —

(a)	regulations 1 and 2 — on the day on which these regulations are published in the Gazette;
(b)	the rest of the regulations — on 1 July 2017.

3.             Regulations amended

These regulations amend the Disability Services
Regulations 2004.

4.             Regulation 11 amended

In regulation 11 insert in alphabetical order:

Kimberley-Pilbara area means the area constituted as
at 1 July 2017 by the local government districts of
Ashburton, Broome, Derby-West Kimberley, East
Pilbara, Halls Creek, Karratha, Port Hedland and

Wyndam-East Kimberley;

Mandurah-Rockingham area means the area
constituted as at 1 July 2017 by the local government
districts of Mandurah and Rockingham;

5.             Regulation 12 amended

(1)	In regulation 12(1) delete “area and the 2017 expansion area” and insert:
area, the 2017 expansion area, the Kimberley-Pilbara area and the Mandurah-Rockingham area
(2)	In regulation 12(2) to (5) delete “2017.” and insert:
2018.
(3)	After regulation 12(5) insert:
(6) For the purposes of section 26G(3) of the Act, the trial period for the Kimberley-Pilbara area and the Mandurah-Rockingham area begins on 1 July 2017 and ends on 30 June 2018.

6.             Regulation 16 amended

(1) In regulation 16(1):

(a) in paragraph (d) delete “area.” and insert:

area; or

(b)	after paragraph (d) insert:
(e) on 1 July 2017 the person resides in the Kimberley-Pilbara area or the Mandurah-Rockingham area.

(2) After regulation 16(2)(a)(iv) insert:

(v) Kimberley-Pilbara area or the

the person starts to reside in the after 1 July 2017;

(3) In regulation 16(3):

(a)	after paragraph (bb) insert:
(bc) the child is born after 1 July 2017, and at least one of the child’s birth parents who cares for

that child resides in the Kimberley-Pilbara area

or the Mandurah-Rockingham area on the day

the child is born; or

(b)	after paragraph (db) insert:
(dc) at a time after 1 July 2017, the child comes to be in the care of a person who has ongoing parental responsibility for that child and who has resided in the Kimberley-Pilbara area or the Mandurah-Rockingham area since 1 July 2017, and this will be the child’s place of residence;

or

(c)	in paragraph (e)(ii)(I) after “1 January 2017,” insert:
or in the Kimberley-Pilbara area or the Mandurah-Rockingham area after 1 July 2017,

7.             Schedule 4 amended

In Schedule 4 Division 2:

(a) in item 16 delete:

2 DSC - NDIS/My Way trial sites (My Way)

and insert:

2 DSC - WA NDIS trial sites (WA NDIS)

(b) in the note to item 16 delete “2 (My Way),” and insert:

2 (WA NDIS),
