Disability Amendment Regulations 2020

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Disability Regulations 2018—

(a)to remove the NDIS Quality and Safeguards Commission as a prescribed person to whom any person or body may disclose information under section 39(6) of the Disability Act 2006 for the purposes of the NDIS; and

(b)to prescribe further persons as persons to whom the Disability Services Commissioner may disclose information under section 132ZB of the Disability Act 2006.

2Authorising provision

These Regulations are made under section 221 of the Disability Act 2006.

3Commencement

These Regulations come into operation on 1 July 2020.

4Principal Regulations

In these Regulations, the Disability Regulations 2018[1] are called the Principal Regulations.

5Use, disclosure and transfer of information for or with respect to the National Disability Insurance Scheme

In regulation 40 of the Principal Regulations, paragraph (a) is revoked.

6Disclosure of information by the Disability Services Commissioner

In regulation 41 of the Principal Regulations—

(a)in paragraph (h), for "Commonwealth." substitute "Commonwealth;";

(b)after paragraph (h) insert—

"(i)the Disability Worker Registration Board of Victoria established under section 8 of the Disability Service Safeguards Act 2018;

(j)the Victorian Disability Worker Commission established under section 21 of the Disability Service Safeguards Act 2018;

(k)the Victorian Disability Worker Commissioner appointed under section 26 of the Disability Service Safeguards Act 2018.".
