HER HONOUR:
1Eden John Turkovic and Paul Millan, you have each pleaded guilty as follows.
2You Eden Turkovic have pleaded guilty to one charge of trafficking in a drug of dependence, being anabolic and androgenic steroidal agents; one charge of importing Tier 1 goods being anabolic and androgenic substances; one charge of trafficking in a commercial quantity of cocaine; one charge of importing a border controlled drug, namely cocaine and one charge of possessing a drug of dependence namely Diazepam. You have also pleaded guilty to the summary charge of possession of a Schedule 4 poison without a licence.
3You, Paul Millan, have pleaded guilty to one charge of trafficking in a drug of dependence, namely anabolic and androgenic steroidal agents; one charge of importing Tier 1 goods namely anabolic or androgenic substances; one charge of trafficking in a commercial quantity of cocaine; one charge of importing a border controlled drug, namely cocaine; one charge of possessing a drug of dependence, namely methylamphetamine.
4The facts underlying your offending were set out in the extremely detailed prosecution opening which is annexed as an exhibit to my sentencing remarks.
5In short compass, in mid-2015, you Eden Turkovic set up a business whereby you both imported and sold steroids using the postal service. You purchased steroids from Ukraine and China sending cash via money transfers and receiving steroids by mail. The packages were delivered to a variety of post office boxes that you leased in the outer eastern suburbs in the names of your brother Elijah and one Angela Touse. You sent a total of 41 transfers of money totalling $90,901 for the purchase of steroids between July 2015 and November 2016. On receipt of the steroids you re-packaged and forwarded them to your customers by mail. You, Paul Millan, became involved in this enterprise from March 2016.
6Charge 2 on the indictment relates to 28 parcels containing steroids which were sent to you Eden Turkovic and which were intercepted by the Australian Border Force. Those parcels contained a total of 5,053.13 grams of steroids. Charge 4 relates to 22 of those parcels which were sent after you Paul Millan, joined Eden Turkovic in this illegal enterprise. Their contents weighed 3,301.74 grams of steroids.
7The business then branched out into cocaine importation and trafficking. In August 2016 you Eden Turkovic travelled to the USA where you stayed for a month. In that time, you Paul Millan executed 15 money transfers to the US worth $43,846. On your return to Australia, you Eden Turkovic executed a further 13 money transfers to the US worth $30,029. It is the prosecution case that the visit and the money transfers were for the location and then payment for a cocaine supply. Between 3 and 26 October 2016, five parcels destined for your post office boxes Eden Turkovic were intercepted and found to contain a total of 150.83 grams of pure cocaine. The actions of each of you in importing this drug underlies Charge 6 on the indictment.
8Your business was conducted from three premises: a unit at Thiele Street, Doncaster, another unit at Maxia Street, East Doncaster, where you both lived, and a storage unit in Simla Street, Mitcham. On 18 November 2016 police raided all three premises. Charges 1 and 3 which are charges of trafficking against Eden Turkovic and Paul Millan respectively are based on 4,135.7 grams of steroid possessed for sale by you both which was seized by investigators at all three locations. Those charges are also based on the details taken from 20 tick sheets, being a list of outgoing steroids sales also recovered at two of the premises. Charge 5 relates to a mixed substance of 471.9 grams of cocaine seized at Thiele Street, and 2,465.5 grams also in relation to a mixed substance of cocaine recorded by you both as outgoing sales also recorded on the tick sheets between 25 July and 18 November 2016. Charge 5 is a charge of trafficking in a drug of dependence in a commercial quantity.
9Although the total outgoing sales aggregate to 2.4 times the large commercial quantity threshold at law, the prosecution concedes the intention by each of you was to traffic in commercial quantities of less than 1,000 grams, the relevant commercial threshold in this case being 500 grams.
10Charge 5 relates to many boxes of Diazepam recovered from your bedroom Eden Turkovic at Maxia Street totalling 3.6 grams of this substance. Charge 8 relates to 9.4 grams of methylamphetamine recovered from the storage facility which was for your use, Paul Millan. Items recovered from the three premises revealed literally dozens of items related to your importing and trafficking business including wrapping material, Australian Post Express envelopes, electronic scales, empty plastic vials as well as the steroids, cocaine and tick sheets that I have referred to. Items were also recovered from your car, Paul Millan.
11You both were arrested on 18 November when you arrived at Thiele Street in your car, Paul Millan, whilst police were searching those premises. You Eden Turkovic conducted a no comment record of interview, whilst you Paul Millan denied involvement in either importation or trafficking of drugs. In relation to the cocaine, police surveillance revealed that your customers either received their drugs by post or attended the Maxia Street unit where you both lived. Police also located Schedule 4 poisons which were possessed by you Eden Turkovic for your own use, they, your counsel informed me comprising effectively an oestrogen blocker used for building muscle and underlie the summary charge against you. The street value of the cocaine located at Thiele Street was estimated at between $270,000 and $360,000.
12The maximum penalty for trafficking in a commercial quantity of a drug of dependence is 25 years' imprisonment. The maximum penalty for trafficking in drug of dependence is 15 years' imprisonment. The maximum penalty for possessing a drug of dependence, that is in your case Paul Millan methylamphetamine, and in your case Eden Turkovic, Diazepam, one year
imprisonment. The maximum penalty for possessing a Schedule 4 poison without a licence is ten penalty units. The maximum penalty for importing Tier 1 goods is five years' imprisonment or 1,000 penalty units. The maximum penalty for importing a border controlled drug is 25 years' imprisonment or 5,000 penalty units.
13There was some evidence of enrichment on the part of each of you.
Rachel Petite, the former girlfriend of you Eden Turkovic, told police you had a lot of cash, were in possession of diamonds and bought expensive designer watches, sunglasses, clothing, belts and shoes. She said you Paul Millan, although not as materialistic as Eden Turkovic, also started buying designer clothing. Petite said that neither of you were working during this period of criminal enterprise but "had lots of cash though".
14On 24 June 2016, you Paul Millan purchased a new Holden sports sedan costing $54,595 after a trade-in, which you paid for by direct money transfer. On 26 October 2016 you Eden Turkovic, deposited $49,000 cash in a bank account, the moneys eventually being used to pay out a $48,778.90 loan on a 2013 Jeep Grand Cherokee wagon.
15I now turn to the personal circumstances of each of you beginning with you Eden Turkovic. You are aged 27 and are the eldest of four children. Your younger siblings are all employed and have never been in trouble with the law, neither have your parents. You have one prior conviction in 2013 for possessing a dangerous drug which was testosterone and you were dealt with by the Magistrates' Court by way of a fine without conviction.
16Your father was an engineer who has not worked since 2000 when he lost a thumb in an industrial accident. Your mother is a former teacher, has worked as a qualified naturopath, an occupation in which she worked for some years, but who has gone on to study law, being admitted to practice in Queensland in February of 2019. She also works as a casual marker and teacher at the
University of New England. There were some family difficulties. At the time that your father suffered the industrial accident he had a severe psychological reaction, your mother unfortunately at the same time suffering severe postnatal depression after the birth of your younger sibling. There was a brief separation in 2000. Your father's inability to work meant that there were many years afterwards of significant financial difficulty.
17Essentially you grew up in Grandchester, a small town in rural Queensland.
You moved to Lismore in January 2001 where your mother undertook naturopathic studies. In 2009 you completed Year 12 at Lismore High. You passed but your marks were poor, possibly due to what was an undiagnosed Attention Deficit Hyperactivity Disorder. At the age of 18 you moved to Tennant Creek where you worked in mines for 12 months, then worked as a labourer for Hutchinson Construction as a builders labourer. You then moved to Brisbane to work for the same company as a builders labourer for two to three years before moving to Melbourne in 2014.
18On arrival in Melbourne you initially boarded with family friends, the Barker family in Ferntree Gully. They are of some significance to your story as following your arrest you returned to live with them pursuant to bail conditions. You worked for 12 months as a forklift operator with Pura Milk but the work was sporadic only and you had difficulty finding other work beyond casual gardening and casual labouring work.
19Since the age of 16 you have been interested in fitness and bodybuilding due to a poor body image and low self-esteem. At age 21, through the gyms that you attended, you began using steroids and you continued use of steroids over the years until the time of your arrest. At a gym in Doncaster you were sourcing steroids but unable to afford them so you began to buy direct from Ukraine and China where these drugs are legal. Apparently others at the gym found out what you were doing and requested that you obtain steroids on their behalf and so the business began. You began using cocaine in about November of 2015
at first on a social basis but in the four months before your arrest were using up to 1 gram of this drug per day.
20Since your arrest and remand in custody for a period of some weeks, you have managed, I am satisfied, to turn your life around. You have attended upon a psychiatrist who has now formally diagnosed your ADHD and you are being treated for it with the drug Ritalin which has seen great improvement in your mood and concentration.
21Psychologist Tim Watson-Munro whose report dated 4 March 2019 was tendered on the plea opined that your undiagnosed ADHD may have made you more vulnerable to cocaine use. He said that you expressed appropriate remorse to him in the two sessions that you had with him and that he was satisfied you had now detoxified from cocaine use. He found you to be suffering a major depression disorder due to the knowledge of your impending incarceration and your intense guilt over the offending and the suffering in particular this has brought to your family. Since your release from custody you have established a high end online watch and jewellery business. This began in 2017 and has particularly turned a profit in the past six months. You operate this business with a partner and you have been working at it seven days a week.
22As I have said, since being placed on bail you have resided with the Barker family. You have abided by stringent bail conditions which has included daily reporting to police. Your mother and Marina Barker whom you live with gave evidence on the plea, and both spoke of your success in giving up cocaine, establishing a successful business and your strong work ethic. Mrs Barker in particular spoke of the invaluable assistance you have been to her family on the discovery of her husband’s brain cancer and his subsequent treatment. Her son also wrote a letter attesting to the enormous amount of help you have been to the Barker family, this is very much to your credit. You have also been able to offer employment in your business to two of the Barker boys.
23Your counsel informed me that your possession of the Diazepam came about because of insomnia that you have suffered from for many years. It was Mr Watson-Munro's view that you had a good insight into your offending and its causes and he was of the belief that you had been drug free for two years.
24I now turn to you Paul Millan. You are aged 33 and have no prior or subsequent convictions. You were born in Melbourne, your mother works in furniture sales and your father is a carpenter and joiner. They separated when you were five and you then lived with your mother until you were 19. You have an older sister who works in an online jewellery business. As with Eden Turkovic, you are the only member of your family ever to have been in trouble with the law. When you were nine your mother was diagnosed with ovarian cancer and underwent chemotherapy and radiotherapy. Ten years ago she was diagnosed with breast cancer and underwent four operations. You told psychologist Jeffrey Cummins whose report dated 6 March 2019 was tendered on the plea that you were raised in a loving family and had strong bonds with each of your parents.
25You completed Year 10 at Emmanuel College in Forest Hill but were asked to leave because of non-attendance. You then attended Box Hill Secondary College where you completed Year 12. After leaving school you worked for ten months as an NBN cabler for Telstra, then at the age of 19 began working for your father with whom you completed your apprenticeship in carpentry and then worked as a carpenter until you were aged 29 or 30. The last six to seven years of your employment were for your paternal uncle who had a construction business. You left this employment when you fell out with your uncle over his Jehovah's Witness beliefs.
26In 2011 you began attending Genesis Gym in Doncaster and in the years following met Eden Turkovic. You are a very tall man, six foot five, and had a skinny frame and hence you became involved in gym and body fitness and bodybuilding. Soon after starting at the gym when lifting a heavy weight you developed a bulging disc for which you still take pain medication and which still
causes you some difficulties. From the ages of 21 to 22 you intermittently began using steroids. You had some problems with alcohol in your 20s, you described intermittent use of cannabis and ecstasy to Mr Cummins in your teens, but he described you as overall being drug free until you were introduced to cocaine in your late 20s. You eventually became dependent upon it, your use rising to 3-4 grams per week in about a 12-month period leading up to your arrest. You also in that time experimented with ice or methylamphetamine.
27Since your arrest you too have abided by stringent bail conditions including daily reporting to police. You established a café in Clifton Hill which you ran seven days a week. You recently sold this business due to burn out and have since been working as a concreter. You told Mr Cummins you believed you would have no troubles finding work on your release from prison.
28Mr Cummins opines that at the time of your offending you were dependent on cocaine and were intermittently using cycles of steroids. You were also unemployed having left your uncle's business but you admitted to Mr Cummins that you eventually sought to earn an income from your offending behaviour. Mr Cummins wrote that you had developed an Adjustment Disorder with mixed Anxiety and Depression in response to your arrest and inevitable term of imprisonment. He said that otherwise you suffered from no diagnosable mental health disorder. It was his belief that you had favourable prospects of rehabilitation. You retain the support of your family as does Mr Turkovic. He described you as being embarrassed, ashamed and remorseful for your offending. Importantly in my view you told Mr Cummins that during the offending you did not think about what might happen if you were caught, that you knew what you were doing was wrong but you simply convinced yourself that you would not be caught.
29References from family and friends attested to your hardworking nature and their shock and surprise that you involved yourself in this serious offending. You also wrote a letter to the court expressing your remorse for your offending
and for the distress you have caused your family and I accept that this was a genuine letter.
30I do not regard your prior conviction, Eden Turkovic, as being particularly relevant to the sentencing exercise before me. It was indicative of long-term steroid use.
31I accept that both of you have been hardworking young men from loving and law abiding families who continue to support you. I accept that both of you since your arrest have ceased using drugs instead throwing yourselves into your own businesses, each working very long hours and essentially turning your lives around. I regard each of you as having very good prospects of rehabilitation.
32I accept each of you fell into using steroids in your early 20s because of problems with your body image thus leading you Eden Turkovic to source it yourself, and then when others wanted some to begin on-selling it and then establishing your business. You Paul Millan became involved because of your gym friendship with Eden Turkovic and because of your own problems with steroid use and then cocaine. I accept that each of you went on to develop dependencies on cocaine although I would not regard them as massively serious dependencies. Each of you appears to have successfully detoxified yourself without much in the way of professional assistance. I accept in that context the business extended to the importation and sale of cocaine. I accept that your system of importation and sale was fairly unsophisticated and was inevitably going to be discovered and uncovered by the authorities. I also accept that despite your late pleas of guilty, the issue essentially revolved around whether the two of you would be charged with trafficking in a commercial or large commercial quantity of cocaine which ultimately resolved. I also accept that both of you were relatively young men who did not give a lot of thought to the seriousness of the offending in which you were engaging, or the effects that this could have upon your lives.
33I accept that each of you are remorseful for your offending. However in my view there is no doubt that this was a business for profit beyond a means of supplying yourselves with steroids and cocaine and may well have gone on indefinitely had your offending behaviour not been detected as it was inevitably going to be. There was no submission other than I should deal with you by way of a sentence of imprisonment to be immediately served. Importation and sale of illicit drugs are very serious offences. Drug addiction is a cause of enormous misery and ruin in the community, this applies to both steroids and cocaine. In terms of the cocaine importation and trafficking, whilst this part of your business may have lasted only a few months, you managed in that time to sell a seriously large quantity of that drug and it is clear on the evidence that from August 2016 the business was, as the prosecution described it, very much ramping up.
34In sentencing you I take into account the mitigatory factors I have outlined.
Because of them the long parole period for each of you will be less than would otherwise be the case. But the authorities have made it very clear that offending such as yours must result in a substantial term of immediate imprisonment being imposed. The principle of general deterrence, that is the imposition of a sentence which deters others from offending in the same way is a primary factor to which this court must have regard in the sentencing exercise before it.
35I therefore sentence you as follows. Could you stand up please Eden Turkovic.
36On Charge 1 you are sentenced to three years' imprisonment.
37On Charge 2 you are sentenced to two years' imprisonment.
38On Charge 5 you are sentenced to five years' imprisonment.
39On Charge 6 you are sentenced to four years' imprisonment.
40On Charge 7 you are sentenced to four months' imprisonment.
41On the charge of possessing a Schedule 4 drug, you are fined $200.
42The base sentence will be the sentence imposed on Charge 5 which is the charge of trafficking in a commercial quantity of cocaine. I order that ten months of the sentence imposed on Charge 1, that is trafficking in steroids, be served cumulatively to the sentence imposed on Charge 5.
43Charges 2 and 6 are Commonwealth offences and therefore I must impose them by reference to the starting date. The sentences on each will commence at the expiration of the State non-parole period. This results in a total effective sentence of eight years and I order that you serve a minimum term of five years before becoming eligible for parole.
44I declare that 39 days of that sentence have already been served by way of pre-sentence detention. Have a seat Mr Turkovic.
45I sentence you Paul Millan as follows.
46On Charge 3, which is your charge of trafficking in steroids you are sentenced to two years' imprisonment.
47On Charge 4, importing steroids, you are sentenced to 18 months' imprisonment.
48On Charge 5, trafficking in cocaine in a commercial quantity, you are sentenced to five years' imprisonment.
49On Charge 6, a charge of importing cocaine, you are sentenced to four years' imprisonment.
50On the charge of possessing amphetamines you are sentenced to four months' imprisonment, that being Charge 8.
51The base sentence will be Charge 5, a sentence of five years. Four months of the sentence imposed on Charge 3 will be served cumulatively to that sentence. I order that the sentences on charges 4 and 6 commence on the expiration of the State non-parole period.
This gives a total effective sentence of seven years and I order that you serve a minimum term of four years before becoming eligible for parole.
52I should note and I want it noted that the sentence imposed in relation to Charge 7 for Mr Turkovic, that is possession of Diazepam, four months. And the sentence imposed on Mr Millan, four months for possession of amphetamines is to be served concurrently with the sentence.
53I declare that 33 days of your sentence have been served by way of pre-sentence detention.
54In relation to Mr Turkovic's sentence, I declare that pursuant to s.6AAA had he not pleaded guilty, I would have ordered him to serve a maximum term of nine years and order he serve a minimum term of six years.
55In relation to Mr Millan, pursuant to s.6AAA, I declare that had he not pleaded guilty I would have sentenced him to a term of imprisonment of eight years and order he serve a minimum term of five years. Have a seat sir. Thank you.
HERHONOUR: I am now going to sign the orders, disposal orders and forfeiture orders, thank you. Can I say to each of you, I understand that the sentence is a heavy blow. I have no doubt and very much hope that on your release from prison you will both go on to lead the successful lives that I have no doubt that you can. The law makes it very clear if you engage in the sort of offending that you did to the extent that you did, that this is the response. But at least you have strong supportive families and you are both in my view skilful intelligent young men who can go on after this to build successful lives. I thank counsel for their assistance. Take Mr Turkovic and Mr Millan down please. Is there anything else that I need to do?

MAIN POINTS
(A)The reason for the State-based Traffick (Simpliciter) Steroids charges 1 and 3 being separate when the activity was what was formerly known as a joint criminal enterprise is that Mr Millan's complicity with Mr Turkovic starts later. These charges are based on:
(i)the evidence of Raquel Petit who gives direct evidence of observing overseas packages being received, as well as observations of Turkovic and Millan processing and sending out unknown quantities of Steroids express post parcels;
(ii)some outgoing Steroids as detailed on most of 20 "Tick" sheets; and
(iii)the total of 4,135.70 gr of Steroids being possessed
for sale by Turkovic and Millan seized by investigators from 3 locations in November 2016.
(B)The reason for Commonwealth Import Tier 1 (Steroids) import charges 2 and 4 being separate when the activity was what was formerly known as a joint criminal enterprise is that Mr Millan's complicity with Mr Turkovic starts later.
A total of 28 inbound parcels containing Steroids were intercepted by the Australian Border Force at either the Melbourne international mail "Gateway", or the Clyde NSW international mail "Gateway". The pure quantities of Steroids intercepted and seized by ABF are:
(i)Turkovic - all 28 parcels - 5,053.13 gr
(ii)Millan - the final 22 parcels - 3,301.74 gr
(C)Quantities relating to the Commonwealth offences are PURE weights (to 2 decimal places).
(D)Quantities relating to the State-based offences are gross MIXTURE WEIGHTS
(to 1 decimal place).
(E)The State-based Charge 5 Traffick Drug of Dependence (Cocaine) (not less than a Commercial Quantity) is constituted by:
(i)2,465.5 gr agreed Cocaine (mixed substance) as Turkovic and Millan outgoing sales recorded on the "Tick Sheets" over the period between July 25 and 18 November 2016 (almost 4 months); and
(ii)471.9 gr Cocaine (mixed substance) possessed by Turkovic and Millan for the purpose of sale seized from 115/2-6 Thiele Street Doncaster on 18 November 2016.
For the avoidance of doubt, although the outgoing sales evidenced by the "Tick Sheets" aggregate to 2.4 times the Large Commercial threshold, on a Mustica basis the prosecution concedes that the intention held by Turkovic and Millan was to traffick in Commercial quantities (less than 1000 gr). The relevant COMMERCIAL threshold in this case is 500 grams Cocaine (mixed substance).
(F)The charge 6 Importation of Border Controlled Drug (Cocaine) Quantity is
150.83 gr (pure) discovered within 6 intercepted packages.
(G)The Turkovic Charge 7 (Diazepam) involves 3.6 gr.
(H)The Millan Charge 7 (Methylamphetamine) involves 9.4 gr.
The investigation revealed that Turkovic was regularly sending cash overseas to Ukraine and China which the prosecution contends was for the purchase of Steroids:
(i)To Ukraine $26,858 AUD in 14 transfers

(J)The investigation also revealed that while Turkovic was in the United States, that Millan executed 15 money transfers in his own name between 5 and 23 September to the United States totaling $43,846 AUD.
(K)The investigation also revealed that Turkovic himself, while in Australia, executed 13 money transfers to the United States (using the name John Eden) (12 from Doncaster 7/11 and 1 from Hurstville NSW 7/11) between 26 September and 10 October 2016 totaling $30,029 AUD.
(L)It is the prosecution case that all of the money Turkovic sent to the United States from Australia and the majority of the money Millan sent to the United States while Turkovic was there was for the purpose of Turkovic buying cocaine.

DETAILED SUMMARY
Eden Turkovic gave his birth date as 21 April 1991 and he is therefore now aged 27.
Paul Millan gave his birth date as 13 July 1985 and he is therefore now aged 33.
The evidence of Raquel Yasmin Petit (Notice of Additional Witness)
Raquel Petit was formerly Mr Turkovic's girlfriend and has deposed that she met Eden Turkovic in 2011 on the Gold Coast in QLD when he worked in a gym supplement store and in the construction industry for Hutchinson's builders and that he was a steroid user
Petit says that in 2014 she re-acquainted with Eden Turkovic at a music festival in Brisbane where he told her that he had relocated to Melbourne, still with Hutchinson's builders.
Petit says that in March/April 2014 she moved to Melbourne to be with Eden Turkovic, who was then living with the Barker family in Jolen Court, Donvale.
Petit says that around this time Eden Turkovic told her he "had made up his own steroid label called Precision Pharmacy", and she saw that he had a printer and office setup as well as a shredder at Jolen Court and also boxes of empty vial and lids as well as shoe boxes full of Precision Pharmacy brand vials.
Petit says she noticed that Turkovic always had lots of Express Post envelopes, which he would buy in packs of ten.
Petit says that Eden Turkovic met Paul Millan at a gym they used to go to and that Millan was at that time living in a duplex apartment at 444 Smith Street Fitzroy;

Petit says that one night while she and Turkovic were staying at the Jolen Court house that they went to Paul Millan's apartment and that at the apartment she heard Turkovic and Millan talking about cocaine, and that they were discussing how to get it and that Paul had a contact and they discussed going halves in it, and that Paul said he knew an older man who could get cocaine for them. She says she heard them discussing 'how to cut it to make money'. She says they 'were discussing vacuum sealing the drug';
Petit heard them discussing making it into solid rock like it had just come of [sic] the rock of pure cocaine so people wouldn't complain it wasn't pure. She says that Eden Turkovic talked about cutting the cocaine with a supplement. Petit also says that Eden Turkovic talked about sending cut cocaine to people in Brisbane.
Petit says that Eden Turkovic found out that Petit had a fake ID that she had created in 2011 when she was 17 years old in the name of Ashleigh Deseree Towse to get entry to music festivals. Towse was a friend of hers and Pettit had obtained a duplicate Towse licence from the Queensland Transport Office at Bundall and had it with her when she came to Victoria, although it had since expired.
Petit says that the Towse QLD licence was used by her at Eden Turkovic's direction to open up post office boxes at various Post Offices and licensed postal outlets.
Petit says that Eden Turkovic would pre-fill the application forms out, and then she would show the ID and she would get the post office box key and give it to Eden Turkovic.
The Post Office boxes used in this offending
The investigation revealed that Post Office Boxes were leased in the names of Elijah Turkovic (Eden Turkovic's brother) and Ashleigh Towse. The following post office boxes were set up by Turkovic and Petit:

Money Transfers
The investigation revealed that Eden Turkovic had been transferring money overseas to Ukraine and China. Cash payments usually in the thousands of dollars on any one occasion had been transferred to recipients in the Ukraine and China. These payments were made in the names of Eden Turkovic, Eden John or Ashleigh Towse. Austrac records of the transfers in the names Eden Turkovic and Eden John show that the transferee gave the same date of birth as Eden Turkovic.
The payments were usually made from overseas money transfer exchanges at 7-11 Donvale, 7-11 Doncaster and GZ Corp Doncaster. These overseas money transfers to the Ukraine and China were payment for steroids.
The money transfers to the Ukraine and China in Eden Turkovic's own name (or the name of John Eden) to purchase steroids were as follows:

Mr Turkovic also transferred money to the Ukraine and China providing the identification of "Ashleigh Towse." These transfers were reliant on Rachel Petit producing the false Queensland driver’s licence in Ashleigh Towse’s name but bearing Petit’s photograph to effect the transfers.

Turkovic and Petit lease 115/2-6 Thiele Street Doncaster from 3 June 2015
Raquel Petit says that she and Eden Turkovic were approved for their 'first apartment' which was at 115/2-6 Thiele Street in Doncaster and that they moved in, with her intending to decorate and fill out their apartment. This lease is confirmed by the statements of Casey McDonald from Jellis Craig Real Estate at deps 535.
Petit says that Eden Turkovic was 'obsessed with running his steroid-selling business and that he always wanted to have the best quality product.'
Petit says that he spent a lot of time wrapping and sending parcels to customers and that his customer base grew as their relationship went on.
Petit says that Paul Millan came over to the Thiele Street Apartment and producing a bag of cocaine from out of his 'work bag.' She says that Turkovic and Millan then used the cocaine, and that she herself had used it a couple of times when at Millan's apartment but that "it didn't do anything" for her.
Petit says that Turkovic was receiving many packages from overseas and there were many packages lying around the apartment. She says that on many occasions she accompanied Turkovic to Post Offices to collect packages. She says that he would open the packages in front of her in the car, and that 'it looked like packs of flour'. She says that she noticed sometimes the powder would be in Asian wrapping. She says that Turkovic told her that the powder was Testosterone, and that he always had lots of post office box keys in the console of his car.
Petit says that Turkovic would go to the Post Office at The Pines shopping centre a lot and collect packages from there. Petit also says that Turkovic spoke with Millan 'a lot and ask[ed] him to collect parcels for him'.
Petit says that between October 2015 up to shortly before Australia Day 2016 she had returned to Queensland but went back to Melbourne for Australia Day 2016.
When she arrived back, Petit found that Turkovic was no longer living at 115/2-6 Thiele Street but was instead living in a townhouse at 1/16 Maxia Road in East Doncaster. She says that within a short time Turkovic began asking her to resume trips to 7-11 and to open up more post office boxes. She agreed.

1/16 Maxia Road was leased by Paul Millan's father on 20 November 2015 and when this address was searched by police in November 2016 Paul Millan had an established bedroom there as well (although he gave his residential address during interview as Apartment 602/6 Mater Street Collingwood).
Steroids intercepted
Between 10 July 2015 and 27 October 2016, Eden Turkovic – initially – then from 17 March 2016 both Turkovic and Millan jointly, unlawfully imported significant quantities of various types of Steroids from the Ukraine and China. The Steroids imported are classified as anabolic and androgenic substances and are prohibited tier 1 goods under the Commonwealth Customs Act 1901, unless approval for importation is obtained. Permission was never obtained.

Thiele Street as a production and packaging facility
Petit says that she went to the Thiele Street apartment with Turkovic and Millan (this was while they were living at Maxia Road). She says that there was a table in the middle of the kitchen, and that she also saw a big roll of bubble wrap, express post bags, disposable gloves, scales, small zip lock bags with smiley faces and what she describes as science lab equipment with beakers containing oil. She also says that there were lots of boxes with vial lids and empty vials. She says that there was no other furniture in the apartment.
Petit says that she watched Turkovic and Millan putting the liquid from the beakers into the empty vials and bubble-wrapped them and put them in express post satchels. She will say she also noticed them writing on the express post satchels. She says that she noticed that they put the tracking numbers from the satchel onto a piece of paper and wrote notes alongside them. She says that this "went on for hours". Petit says that Turkovic was always keen to finish before the six o'clock express post pickups.
Petit says that a few times she was taken to a storage unit 'in Vermont'. Turkovic told Petit that it had been his brother Elijah's storage unit when Elijah was living in Melbourne. She says that she saw a black filing case with about six bottles of grape seed oil, and a massive bag of vial lids with all different colours. She also saw a shoe box full of vials with Precision Pharmacy labels, and she noticed the vials were full of liquid. NOTE: The prosecution concedes that what Petit saw at Vermont is likely to be what was ultimately found later in the Mitcham Storage King Unit number 217.
Petit says that Turkovic was 'always sending and receiving express post bags and satchels', and that she remembered one time seeing him open a parcel that contained cash wrapped in underwear. She remembers seeing him receive cash in a DVD case, as well as other cash in a toilet paper roll as well as in a birthday card. She also says that she overheard Turkovic telling customers that 'if it was sent towards the end of the week they wouldn't get it until Monday'. She also says that 'he always seemed to have dramas with getting payments for the drugs'.
Petit says that there were times that she was left in the Maxia Road townhouse while Turkovic and Millan were off "doing their own thing.' She says that there were always random people coming to the Maxia house [and] it was obvious they were buying drugs and that sometimes they'd go upstairs, sometimes downstairs. She says that sometimes she would overhear a lot of talk about drugs, and that she noticed there was always a lot of cash at the Maxia Road townhouse.
Petit says that Turkovic would keep cash stored in a box in his sock drawer. She will also say that Turkovic bought 2 solariums and kept one in a spare room at Maxia, and the 2nd in the garage
Petit says that on one occasion Turkovic told her to count the cash, and it was about $40,000.
Petit says that Turkovic told her that he had a contact in Las Vegas who had "pure cocaine" and that the prices were very low there. Turkovic told her that they would send a sample first and that he received the sample. She will say that she saw the sample was packed in gel-capsules and they were packed in supplement bottles with actual supplements.
Petit says that 'Paul and Eden did everything together … they were running the business together …. [and that] … Eden seemed to be directing Paul even though Paul was a business partner. Paul had stopped working his regular job and was doing the business with Eden full-time'. She says that she was told that the Maxia Road townhouse was leased by Millan's father.
Petit says that she became aware that Millan had bought a "newish" Holden Commodore, an upmarket version'.
Petit says that Turkovic 'had a lot of cash' and that he would go to jewellery stores because he was obsessed with diamonds. He also bought a Tagheuer watch and a Versace watch. He bought expensive sunglasses and designer clothing, belts and shoes. She says that Turkovic took her to Rockpool at Crown on one occasion.
Petit says that Millan was not as 'materialistic' as Turkovic, although she did notice that Millan also started buying designer clothing as well.
Petit says that Turkovic never had a job when she was with him, and that Millan didn't work during that same period either. She says that ' … both had lots of cash though.'
Turkovic travelled to the United States between 18 August and 26 September 2016
On 9 August 2016, Turkovic made a renewal application for his Australian passport in his name. In that application, he gave as his phone number, 0411316437. This was a mobile phone number subscribed in the name of Ashleigh Towse.
On 18 August 2016, Turkovic departed Australia for Los Angeles. The prosecution case is that he travelled to the USA to source cocaine for importation into Australia by way of posting them to the post office boxes in Melbourne.
Millan sent money to Turkovic while Turkovic was in the United States
On 15 occasions between 5 September 2016 and 23 September 2016, Paul Millan at the 7-11 stores in Donvale or Doncaster, transferred cash of approximately
$2,900 on each occasion to Turkovic in Los Angeles, USA:

The prosecution contends that these money transfers made by Millan were for the purchase of cocaine by Turkovic in the USA.
There are several images on Turkovic's recently examined IPhone that confirm Turkovic's sightseeing at a popular Los Angeles lookout, together with a picture of a boarding pass between Las Vegas and Los Angeles (which supports Petit's evidence of being told that Turkovic had a contact in Las Vegas).
Turkovic's return
On 26 September 2016, Turkovic returned from the USA. Between 26
September 2016 and 10 November 2016, Turkovic at 7-11 stores in Doncaster (and once from Hurstville in NSW) transferred cash amounts of about $1-2,000 on each occasion to recipients in Los Angeles. The prosecution contends that these payments were for the purchase of cocaine.

The quantity of cocaine seized on each occasion of interception was not less than the marketable quantity of cocaine. The marketable quantity of cocaine is not less than 2.0 grams pure.
On 14 October 2016, Turkovic is recorded on CCTV cameras at the Bullen post office attempting to collect the parcel that was addressed to Sarah Brown of post office box 332. The police had earlier intercepted and seized this parcel containing cocaine on 11 October 2016.
The prosecution contends that quantities of cocaine that were imported un- intercepted by way of the mail system to post office boxes - or which were obtained from Australian sources - were then jointly trafficked by Turkovic and Millan, including selling drugs to customers by way of the mail system and keeping Cocaine aside to be picked up. 20 “Tick sheets” were located at premises the accused were using to operate their drug importing and trafficking business revealed that they had been trafficking quantities of cocaine between 25 July and 18 November 2016 (almost a 4- month period).
The prosecution contends that the "Tick Sheets" reveal that the Cocaine side of their business was "ramping up" from August 2016 onwards.
Relevant Locations
Turkovic and Millan operated their joint business of importing and trafficking drugs, from three locations. When these locations were searched under warrant in November 2016, police located amongst other things, various types of steroids, cocaine and other drugs and drug related paraphernalia, including cash, electronic scales, plastic bags, and express post parcels and parcel tracking documents.
Those locations were:
a. The rented apartment at 115/2-6 Thiele Street, Doncaster;
b. The rented townhouse at 1/16 Maxia Road, Doncaster East and
c. A rented storage unit (No 217) at Storage King at 2 Simla Street, Mitcham;
Storage Unit 217 at Storage King Mitcham
On 11 August 2016, the accused Millan commenced renting storage unit 217 at Storage King, 2 Simla Street, Mitcham.
The Holden Club Sport and the Jeep Grand Cherokee
On 24 June 2016, Paul Millan bought a new 2016 Holden Club Sport sedan, which was paid for by direct transfer after deduction of the trade in vehicle. The Holden was purchased for $75,995 in the name of John Millan, Millan's father, from Gary and Warren Smith, Dandenong. After deduction of the trade in vehicle, $54,595 was paid by Millan by direct transfer to the Garry and Warren Smith account.
At the time of the purchase and test drive of the Holden, Millan was accompanied by Turkovic.
On 26 October 2016, Turkovic deposited $49,000 cash into the business account of his father, Tony Turkovic, a business known as “Rock Farmers”. The deposit was made at the Doncaster East branch of the Commonwealth Bank. Rock Farmers then paid $48,778.90 to Nissan Finance to pay out the outstanding loan amount on a 2013 Jeep Grand Cherokee wagon. The Jeep was later registered with NSW registration, DKC 07Z in the name of Rock Farmers Pty Ltd.
Matthew Barsley - 5 Capistano Court Southport QLD
On 17 November 2016, drugs and white powder, including 44.6 grams of cocaine powder and 31.6 grams of cocaine rock, together with drug trafficking paraphernalia were located by Queensland police at 5 Capistrano Court, Southport. Amongst the items located by police during the execution of the search warrant was Australia Post packaging found in a car at the property addressed to Mathew Barsley,
PO Box 5483, Gold Coast Mail Centre, with the sender details being "Ash T" of PO Box 805, Templestowe.
The parcel packaging had the tracking number 60630552495 096. On "tick sheet" 19 found at the Thiele Street apartment, a sticker with this tracking number was located next to the handwritten annotation "AF-MB l-O-C $7300". A similar entry is found in “tick sheet” 16 dated two weeks earlier which reads “AF-MB - $7,300 l-O-C”. The prosecution contends that at least some of the cocaine found at the Queensland address was a sale of the drug by Turkovic and Millan by way of the Express Post satchel bag.
Surveillance, Arrests and Execution of Search Warrants
Police identified the premises 1/16 Maxia Road, Doncaster East as the possible residence of Turkovic and a police surveillance unit was engaged to make observations of the address. On 10 November 2016, police observed Turkovic collect three Australia Post express parcels that had been left at the front door of the Maxia Road unit.
Later that day, Turkovic and Millan were observed leaving the premises at 2-6 Thiele Street, Doncaster. Turkovic left in a 2013 Grand Jeep Cherokee wagon with NSW registration plates, DKC07Z. Millan left the area in his 2016 Holden Commodore Club sport’s sedan with Victoria registration plates, AIL325.
On 11 November 2016, CCTV cameras at the Doncaster 7-11 store record the accused attending at 12:58am and transferring cash amounts of $2,941.74 and
$2,808.02 to Los Angeles under the name Eden John.
On 18 November 2016, police surveillance officers observed the following:
d. A DHL courier attend at 1/16 Maxia Road, Doncaster East and leave a card in the letter box after having received no reply at the front door.
e. Millan collecting the card from the letterbox.
f. Turkovic and another male driving to the DHL facility at 55 Ricketts Road, Mount Waverley.
g. Turkovic collected a parcel at the facility addressed to John Eden of 1/16 Maxia Road, Doncaster East.
115/2-6 Thiele Street Doncaster Search under warrant
On 18 November 2016, police attended at unit 116/2-6 Thiele Street, in the company of Jellis-Craig Real Estate agent Casey McDonald, who facilitated entry. They found the apartment unoccupied and sparsely furnished. They also found what appeared to be drugs and drug related items in the apartment. Later at about 5:00pm, police returned with a search warrant which they executed at the premises. During the search police located and seized the following:
(a)471.9 grams of cocaine (mixed substance);
(b)6 “tick sheets” in the kitchen plus sheets with initials and money amounts;
(c)18 new unused Express Post satchels (18);
(d)3 sets of electronic scales;
(e)a large quantity of food storage bags;
(f)A large quantity of snap lock sandwich;
(g)A food storage bag heat sealer;
(h)a large roll of bubble wrap;
(i)a homemade block press, to press powdered steroids and drugs;
(j)white powder residue on sandwich bags, bowls, sieve, scales, spoons, measuring cup;
(k)Disposable gloves, used and un-used;
(l)numerous documents in the name of Eden Turkovic and Eden John including in relation to PO Box 3314 Doncaster East;
(m)an Internet connection invoice in the name of Paul Millan for 115/2-6 Thiele Street, Doncaster;
(n)a bag of creatine and sports supplement powders, used as cutting agents to dilute the purity of drugs;
(o)an Australia Post Parcel Note addressed to Paul Millan (relating to a parcel delivery dated the 30/6/15 in the name of Paul Millan of 115/2-6 Thiele Street, Doncaster);
(p)a used Australia Post satchel with the name Eden John, PO Box 3314, Doncaster East 3109;
(q)2 tape dispensers;
(r)4 vacuum pumps for evacuating air from packages being sealed; and
(s) rolls of aluminium foil. Turkovic and Millan arrests
A short time after police attended, Turkovic and Millan attended at the address in the black Club sport sedan AIL325 driven by Millan. Turkovic was the front seat passenger. They were arrested and their vehicle searched. Police located the following items in the possession of the accused and inside the vehicle:
(a)Storage contract for Storage King at 2 Simla Street Mitcham in the name of Paul Millan dated 11/8/16. Mobile phone member 0423563704 was given as the contact number. This number is subscribed in the name of Ashleigh Towse;
(b)A large number of post office box keys;
(c)Australia Post receipt for an express post parcel bearing tracking number 606305525000 973; and
(d) Timber and clamps. 1/16 Maxia Road Search
On the same day, police executed a search warrant at 1/16 Maxia Road, Doncaster East, premises occupied by Turkovic, Millan and a friend Zac Smith. Police located the following items;
(a)Keys to the Thiele Street address in the console of the Jeep DKC07Z;
(a1) 14 "Tick Sheets"
(b)Millan’s bedroom -
i.Collins Simms tenancy application for rental property at 36 Little Turner Street, Abbottsford in the name of Paul Millan – mobile phone number provided being 0423563704, a mobile phone number subscribed in the name of Ashleigh Towse;
ii. $40,000 cash;
iii.An empty DHL express envelope in the name of John Eden of 1/16 Maxia Road, Doncaster East which had been sent from Beverley Hills California, USA;
iv.Various express post satchels in various names addressed to either Paul M, Eden John or John Turk;
v.Numerous vials of liquid in various places around the premises;
vi.Numerous empty plastic bottles;
vii.“Precision Pharmacy” labels – bearing steroids names;
viii.Police also located on 17 January 2017, a further two “tick sheets” in the shoebox where “Precision Pharmacy” labels were found in the garage;
ix.Numerous documents with tracking number labels, payment amounts- “tick sheets”;
x.Consignment of Rapid flow filters;
xi.Handwritten document and digital scale.
xii.Money Gram receipts in the name of Eden John;
xiii.Tasking list- including reference to “clean out 6 Thiele”;
xiv.Large amounts of clothing, personal items and documents;

Search of Storage King Mitcham Unit 217
On 22 November 2016, police executed a search warrant at storage unit 217, at Storage King, 2 Simla Street, Mitcham and found the following:
(a)Box containing (9) bottles of yellow residue;
(b)Box containing (4) flasks with yellow liquid residue;
(c)Approximately 4 grams of methylamphetamine;
(d)Various personal papers in the name of Paul Millan;
(e)Numerous vials of liquid in various colours;
(f)(4) boxes containing (3) testosterone injections;
(g)(3) cocaine testers;
(h)(11) small bottles and vials with viscous liquid;
(i)iPhone box with plastic bag containing white residue and “No Doz” tablet;
(j)a Vial cap dispenser;
(k)(4) boxes containing 100 tablets of Euthymox 50 mg;
(l)a box of Letrozole 2.5 mg tablets;
(m)a box of Clomid tablets;
(n)glass beakers;
(o)a large quantity of small plastic bottles;
(p)a quantity of empty glass vials;
(q)4 vacuum pumps boxes;
(r)a quantity of “Rapid flow” filters; (vacuum filtrations systems)
(s)Bottles of grape seed oil;
(t)a box of sealed syringes;
(u)a large quantity of vial caps;
(v)on 17 January 2017, police located a further 4 grams of methylamphetamine secreted in the lining of the cooler bag located at storage unit 217.

Turkovic exercised his right to decline to answer police questions.
Millan was taken to the police station following his arrest and interviewed. Amongst the comments he made in his interview were the following:

Value of cocaine
Detective Sergeant Keith Randall of the AFP states that according to the ACIC Illicit Data Report 2014-15, which collates drug price data from multiple sources, and the NDARC IDRS Report 2015, which surveys numerous drug users, the following median prices are based on the powder form of cocaine in the State of Victoria:
(a)0.1 to 0.3 gram street deal or 'cap' is selling for $50;
(b)1 gram street deal is selling for between $300 and $400;
(c)One-ounce (28 grams) wholesale deal is selling for between
$8,000 and $11,000; and
(d)One-kilogram (1000 grams) wholesale deal is selling for between
$200,000 and $240,000.
Det Sgt Randall notes that individual transaction prices for drug commodities will vary depending on numerous factors.

Drug value – cocaine
Detective Sergeant Keith Randall of the AFP made an estimate of the value of the cocaine at the Thiele Street apartment. Based on a net weight of 250 grams of cocaine and on 2014-2015 cocaine prices, he estimated that the wholesale value was between $128,000 and $176,000, and the street value was between $270,000 and
$360,000.
