HER HONOUR:

1Daryl John Offord, you have pleaded guilty to one charge of using a carriage service to procure a person believed to be under 16.  The maximum sentence for that offence is 15 years' imprisonment.

The offending

2Between 12 August and 19 September 2022, a period of five weeks, you engaged in conversation with an undercover police operative who purported to be a 14 year old boy named “Joshua”.  Using Facebook Messenger and SMS you transmitted sexualised messages to “Joshua” and made plans to meet him to engage in sexual activity which culminated in you attending the McDonald's restaurant in Burnley to meet him.

3On 4 August 2022 a friend request had been made to you and on 12 August you accepted it.  That request, in fact, came from undercover police operative.  You and Joshua then exchanged approximately 150 messages up until 16 September using Facebook Messenger.  These messages are set out in annexure A.

4Between 16 and 19 September you exchanged a further 42 messages approximately by SMS which are set out in annexure B.  Both annexures will be appended to these sentencing remarks.

5In your message accepting the friend request you introduced yourself to Joshua saying you would like to catch up with him at your place and in his reply three days later Joshua stated that he was 14, asking how old you were.

6Later that day you replied that you were 59 and that you liked the company of younger guys.  Later you explained the benefits of knowing older guys and soon commenced some sexual talk, including the prospect of Joshua allowing you to play with his penis.  You told him that one of the benefits of being with older men was that young people could benefit financially and that you would give him some money if he let you play with his penis.  You encouraged Joshua to trust you.

7The two of you made plans to meet on 19 September in which you made further reference to playing with his penis.  You agreed to meet him at McDonald's in Burnley and you exchanged mobile phone numbers.

8At that location on 19 September, Joshua sent you a text message to say he had arrived.  You replied that you would park your car over the road.  You entered McDonald's.  About 15 seconds later you left and when you saw the informant and another police officer approaching you walked in the opposite direction from your car.  You were then stopped and arrested.

9After taking part in a “no comment” record of interview you were charged and remanded before being bailed the next day.  You pleaded guilty at the second committal mention on 10 March 2023.

Personal background

10You are a single man aged 80 with no previous convictions.  You did not initiate the contact in issue but responded to an online approach, as I have said, by an undercover police officer.

11You live alone and you have no immediate family and no friends but you lead a largely contented life looking after your garden and managing your life independently.  You own your house subject to a mortgage which is paid out of your pension.

12At the time of the offending you were socially interactive with men on Facebook and dating apps but you have ceased this.  Friends you made in the past have died and the only contact you have with other people is by casual conversation with your neighbours.

13You have several significant problems with your physical health.  You had your prostate removed some 10 years ago.  You then suffered lymphoma and later had your gall bladder removed.  Dr Jennens, an infectious diseases physician, has been caring for you since you were diagnosed with HIV in 2011.  You were treated with antiviral medication with review every six months.  This places you at risk of osteoporosis with increased risk of bone fractures through even minimal trauma.

14In 2012 you developed lymphoma and achieved remission through chemotherapy but you remain at risk of relapse or a second tumour.  Dr Jennens said surgery may be needed for the carpal tunnel syndrome which affects your hands if the recent injection treatment does not help.

15You have type 2 diabetes managed with medication and regular monitoring.  Recently a bladder tumour was detected and you are awaiting investigation and management by a urologist at the Royal Melbourne Hospital.  Your GP, Dr Stephen Williams, considers this is likely to be cancer.  He provided a report to this effect and noted that he has been treating you for over 12 years.  He said he regards you as a polite and respectful person, adding that he has no reason to doubt that you are of excellent and outstanding character in the community.

16You were assessed recently by a forensic psychologist, Dr Melissa Tso, who tested you and found no indication of any mental health issues.  She concluded that you fall into the category of low to moderate risk of sexual recidivism with no evidence of a pervasive sexual interest in children, but with little insight as to the effect of your behaviour on others, and why soliciting of minors for sex is illegal.  However, she said you appeared to be open to gaining a greater understanding of this and that you are prepared to continue, at least in the short term, to engage in psychological treatment.

17Dr Tso said your risk of recidivism would be increased by being prevented from having access to appropriate services by imprisonment.  Dr Tso also offered her opinion about the effect of imprisonment upon you more generally.  She considered that it would be more burdensome for you than for others because of your age and your multiple physical health problems.

18In June this year you commenced treatment with psychologist,
Mr Geoffrey Burrows, who provided a report as to your progress.  You have engaged with Mr Burrows in a sex offender treatment program on a voluntary and self-funded basis.

19Mr Burrows reports that you have little insight into the harmful nature of what you did and the treatment is aimed at helping you to gain that insight as to why you offended and to enhance empathy for the person who might be the victim of such offending.

20Similar observations were made by the Corrections officer who interviewed you today for assessment as to your participation in a treatment program.  The officer reported that a treatment program would challenge and explore your attitude about the capacity of a young teenager to give consent.

21Mr Burrows reported that another goal of treatment is to develop a solid relapse prevention plan.  He said you had failed to understand the destructive impact of your behaviour, and you attributed a precocious sexual readiness to underage boys.  You have begun, although at an early stage, to demonstrate some improved understanding of these matters and are motivated to continue.

22The reports of Dr Tso and Mr Burrows are helpful in assessing matters such as risk and prospects for rehabilitation as well as the likely burden of imprisonment.  That leads me to consider issues that relate to the determination of an appropriate sentence in your case.

Sentencing Issues

23That consideration must begin with the acknowledgment that sexual offences against children are serious crimes and are regarded with abhorrence by members of the community.  General deterrence is the primary consideration in such cases, to be addressed by an appropriate sentence with specific deterrence to be dealt with according to need, but with reduced importance being accorded to mitigating factors.  It is also not to the point that your offending did not involve an actual child, although if “Joshua” had been a real child rather than fictitious that would have been an aggravating factor.

24In this case the duration of five weeks is a relatively long period, although the rate of messaging was not constant.  There were no photos of any type exchanged, although messages you sent contained sexual content.  Your communications were unsophisticated and somewhat naïve, offering a visit to Mc Donald's and being prepared to present yourself there as an 80 year old man and driving your own car.

25You intended to meet Joshua and took steps to do so which is also an aggravating factor.  Some of the content of your messages referred vaguely to financial benefits for him which could be regarded as an inducement.  You told him you were 59 when you, in fact, were 79.

26Ms Skaburskis, who appeared on your behalf, submitted that your actions were the product of loneliness rather than predatory behaviour which is supported by the fact that you demonstrated no ability to chat online with a 14 year old in culturally and age appropriate terms.

27I must place weight on the fact that you pleaded guilty at the earliest possible stage thus avoiding a trial which is of assistance to the criminal justice system and therefore warrants a discount on your sentence.  That is of greater value currently when the court is still dealing with the backlog of cases caused by the pandemic.  Even in a strong prosecution case as this is, such a discount is appropriate and in your case it should be one of a reasonable degree.

28Your plea indicates that you have taken responsibility for your offending and that despite your initial reluctance to accept your behaviour as criminal you have developed some understanding through the treatment you sought out yourself.

29On that point, should you be imprisoned your pension payments would cease and you would not be able to fund the treatment of Mr Burrows which currently is continuing.

30You have no previous convictions and the police ascertained that you have not engaged in any similar behaviour in the past.  Indeed you did not take steps to seek out a minor but had responded to the Facebook invitation sent by a police officer.  Ms Skaburskis described this as a triggering event, meaning that the offending would not have been initiated but for it.

31Insofar as it has been demonstrated that  you have been a person of good character until now, that factor is relevant to the likelihood that you would not have offended without the Facebook request.  Accordingly, there is no suggestion that the protection of the community is a significant issue which it otherwise would be.

32The material before me suggests that your rehabilitation is more likely to be achieved by you remaining in the community and that imprisonment would only curtail your progress.  Your prospects of rehabilitation are probably better than guarded because of the absence of any previous similar behaviour and the steps you have taken to address it.

33The burden of imprisonment to which I referred earlier is particularly relevant when it concerns an elderly person suffering from various health problems as you do.  I take into account and place considerable weight on the likelihood that prison would be more difficult for you than for a younger healthier person.  This must be balanced against the seriousness of the crime and your moral culpability.

34Ms Skaburskis submitted on your behalf that a Community Correction Order would achieve the necessary sentencing requirements or if imprisonment was warranted a recognisance release order with immediate release would be appropriate.  This latter disposition can only be imposed if the court is satisfied that there are exceptional circumstances and Ms Skaburskis submitted that these are to be found in your age and health problems, in particular, the recent likely cancer diagnosis which very likely requires urgent medical attention.

35The prosecution's submission was that imprisonment is warranted by means of a recognisance release order, implying that the term to be served should be greater than six months but not greater than three years.

36I am bound by the requirement to not impose imprisonment if there is no other sentence that is appropriate in all the circumstances, subject to the need for exceptional circumstances as required by s20(1)(b)(iii) of the Commonwealth Crimes Act.  This leads to me to consider current sentencing practice and the guidance offered by other cases.

37I was referred to several cases reflecting varying degrees of seriousness and with prison sentences in all but one case.  The offenders were almost all aged many years short of 80 and had no apparent serious health concerns.  The cases clearly indicate that prison should ordinarily be imposed and only in the case of Singh[1] was a non-custodial term imposed and upheld on appeal.  The sentence was a three year Community Correction Order with a $2,000 fine for behaviour that was similar to this case.

38In dismissing the Crown appeal the court commented that the sentence was remarkably lenient.  The appeal court would have imposed a term of immediate imprisonment noting that there were not and I quote,

'Sufficient mitigating features to take it out of the ordinary type of offending which demands an immediate term of imprisonment…'

39However, the court concluded that the sentence was not wholly outside the range of sentences available.

40The question is whether your circumstances are sufficiently rare, indeed exceptional, to avoid imprisonment.  I am satisfied that they are when considered in combination and that an appropriate sentence is a recognisance release order of 18 months with an order that you be released immediately on condition that you be of good behaviour for 18 months.

41The counselling that you have embarked on is appropriate in dealing with your deficits in understanding the issues relevant to your offending but I shall order, as I am obliged to do, that it be a condition of the recognisance release order, amongst other conditions, that you take part in a sex offender treatment program for which you have been assessed as suitable.

42I fix a recognisance in the sum of $1,000 which is not a sum that you need to pay now but may be called upon to do so in the event of further offending.

43I am required to explain to you that the order is intended to punish you and to assist in your rehabilitation by reducing the risk of you reoffending.  If you were to breach the order you may have to return to court to be resentenced.  Regardless, you may apply at any time for the discharge or variation of the recognisance.

44You will be asked to sign an agreement to the recognisance and other conditions when that is ready shortly.  If you had pleaded not guilty to this charge I would have imposed an RRO requiring you to serve six months imprisonment before being released.

45Now I understand Ms Pan has got a copy of the proposed order and subject to her comments in a moment that can be signed.

46MS PAN:  That's right, Your Honour.  I'm just amending it now.  There's just a typo but everything else is good.  I'll just quickly do that and hand it to your associate.

47HER HONOUR:  That can be fixed, can it?  All right.  Thank you, Ms Pan.  In a moment I'll ask you, Ms Skaburskis, if you would like to accompany my associate to the dock for signature of that order.

48MS SKABURSKIS:  Thank you.  Yes, I would, Your Honour.  May I approach the dock, Your Honour?

49HER HONOUR:  Yes.  Thank you.  Is there anything further?

50  MS PAN:  Yes, Your Honour.  There's just two matters.   I suppose they're more corrections.  In terms of the background of the matter, if I understood Your Honour correctly when Your Honour was going through the initial messages I think Your Honour said that Joshua said that he was 14 and then three days later Mr Offord responded that he was 59. These messages all occurred on the same day -16 September. The other thing was in reference to Mr Offord entering and attending the McDonald's.  I think Your Honour said that Mr Offord was there for 15 minutes before he left, it was actually 15 seconds.

51HER HONOUR:  All right.  What will occur is that that will appear on the transcript of today's hearing and I'll see that those corrections are incorporated into the final sentencing remarks.

52MS PAN:  Thank you, Your Honour.

53      HER HONOUR:  Subject to your agreement, Ms Skaburskis, do you agree?

54      MS SKABURSKIS:  I've got no issue with that, Your Honour.

55HER HONOUR:  All right.  Thank you.  Now there is one other thing than I've just remembered.  I think there should be pre-sentence detention of one day, is that right?  Was he held overnight?

56MS PAN:  He was.  So I believe it's actually two days.

57HER HONOUR:  Two days.

58MS PAN:  Yes. 

59HER HONOUR:  All right.  Agree with that, Ms Skaburskis?

60MS SKABURSKIS:  Yes, I do, Your Honour.

61HER HONOUR:  Well I don't think it becomes relevant, does it, because there's no imprisonment order.

62MS PAN:  That's correct, Your Honour.

63HER HONOUR:  So those two days just remain available.

64MS PAN:  I must admit I'm not entirely sure what happens in those circumstances.  Perhaps I can - - -

65HER HONOUR:  They stay there unclaimed until such - - -

66MS SKABURSKIS:  It does unless Your Honour makes a particular point that it is something you took into consideration as relevant to the ultimate outcome.  Otherwise I believe they just sit there unclaimed.

On 14 September 2023  the matter was brought back to court to  amend   the sentence.

Charge 1: 8 months imprisonment to be released forthwith on a  $1000 recognisance  order to be of good behaviour for 18 months.

Pursuant tos 34 of the Sex Offender Registration  Act 2004  Daryl Offord has been placed on the SOR for a period of 8 years.
