HIS HONOUR:

1Christopher Membrey on 19 April 2023 at the County Court here in Melbourne you pleaded guilty to the following charges on case number CR-22-00909:

Charge1: Used a carriage service to transmit child abuse material between 21 September 2019 and 19 June 2020.

Charge2: Caused child abuse material to be transmitted to yourself by using a carriage service between the 17 October 2019 and 19 June 2020.

Charge3: Used a carriage service to access child abuse material between 21 September 2019 and 22 June 2020.

Charge4: Used a carriage service to transmit child abuse material between 5 July 2020 and 17 April 2021.

Charge5: Used a carriage service to access child abuse material between 6 July 2020 and 22 February 2021.

Charge6: Possessed child abuse material which was obtained by using a carriage service on 23 April 2021.

2The 23 April 2021 was the day of your arrest for these offences.

3Each of these Commonwealth offences has a maximum penalty of 15 years imprisonment.

4You have signed a certificate under s16BA of the Crimes Act 1914 admitting to the offending at Viewbank in Victoria between 13 and 15 September 2019 and 22 December 2020. I have taken those matters into account when fixing the total sentence for you for the offences before this court. You have no prior criminal history.

The circumstances of your offending

5The prosecutor read from Prosecution Opening for Plea and was tendered as Exhibit ‘A’. The document was 35 pages in length and included a ‘Table A’ and a ‘Table B’ at the end of it. Exhibit ‘A’ is attached to these reasons for sentence.

6Each of the charges 1, 2, 3, 4 and 5 are rolled up charges. Meaning a number of discreet offending events are included in the single charge. At the time of the offending you were between 44 and 45 years of age.

7On 17 February 2021 the Joint Anti-Child Exploitation team, which is known as 'JACET' arrested a man by the name of Thomas James Donaldson and executed a search warrant at his home address. An analysis of Mr Donaldson's iPhone revealed a number communications on the encrypted Telegram messaging application between Mr Donaldson and the user with the moniker of 'GYOZPRV'. Those communications involved discussions about the sexual abuse of children. The moniker, as in GYOZPRV, also sent to Mr Donaldson various images and videos which were identified as child abuse material. The investigation revealed that you were the person using the moniker GYOZPRV.

8Charges 1 to 5 inclusive arise from your use of the telephone application 'Telegram'. You used Telegram to communicate with other likeminded individuals in sexually charged conversations interspersed with the transmission of images and videos of child abuse material.

9Charges 1 and 4 are charges of transmitting child abuse material. These are two separate charges because of the introduction of the Crimes Legislation Amendment (Sexual Crimes Against Children and Community Protection Measures) Act 2020, which came into effect on 23 June 2020.

10 The offending is on numerous occasions transmitting child abuse material between 21 September 2019 and 17 April 2021. Your communications were with a total of 31 separate people over that period. I will now deal with the admitted criminality in respect of Charges 1 and 4 together.

11On Charge 1, between the dates of 21 September 2019 and 19 June 2020, of transmitting child abuse material, there are 18 separate users, which I will briefly summarise:

1)The user referred to as 'man guy', transmission happened between 21 September 2019 and 4 January 2020. There were 39 videos and 42 images.

2)The user referred to as 'BMelb28'. This occurred between 6 October 2019 and 2 November 2019. There were five images.

3)The user 'JL Jr', this happened between 17 October 2019 and 17 November 2019. It occurred over two days and an image was sent.

4)The fourth person was 'Tommo7221' between 1 November 2019 and 7 June 2020, there were conversations and images transmitted to that person.

5)The fifth person was 'JoshBigD' on 15 November 2019, this was a one date occasion. There was a conversation and an image transmitted.

6)Another user referred as 'SL' that was on 26 November 2019 and one image was transmitted.

7)The next person was 'Matt B' on 1 December 2019. You sent a series of images to that person.

8)'Spunk Witch' on 17 December 2019. This was a one-off communication where you sent one video and images.

9)'JT' between 27 December 2019 and 7 March 2020, one image and conversation in that period.

10)'ccwilly' between 1 January 2020 and 5 February 2020, had conversations and six images were transmitted.

11)'G-Raffe' was between 4 January 2020 and 12 May 2020, where you transmitted two videos and seven images.

12)'M M' between 22 January 2020 and 14 May 2020, transmitted six videos and images.

13)'Bee' that was on 7 March 2020 which is a one-off, one image and then that was the end of that communication.

14)'Shardvark' between 7 March 2020 to 23 March 2020, where you sent one image.

15)'Ryan no limits, pm open' that was between 25 March 2020 and 7 June 2020, with conversations and four images.

16)'Partypigbro' on 16 April 2020, images and conversation took place.

17)The next one was 'Perv' that was between 28 April 2020 to 19 June 2020, where you transmitted 11 videos and more than nine images.

18)And 'Baby Storage C' which was a one-day matter in a group chat on 15 May 2020, you sent four images to the group.

12On Charge 4, again transmission of child abuse material between 5 July 2020 and 17 April 2021. There are a total of 29 people you sent material too and I'll read them out:

1)The first person is 'Man guy' which occurred on 22 December 2020. You sent six videos and two images.

2)The second one is 'BMelb28' between 8 July 2020 and 22 December 2020. There were six videos and nine images.

3)The third person was 'JL Jr' between 5 December 2020 and 2 April 2021. There were five separate days of images being sent.

4)'Tommo7221' which occurred between 5 July 2020 and 5 February 2021. There was conversations, one video and two images sent.

5)'JoshBigD' between 27 December 2020 and 5 February 2021, there were three separate images sent.

6)'SL' between 22 July 2020 and 22 December 2020, there were three separate images sent.

7)'Matt B' between 19 October 2020 and 4 February 2021, there were 13 images and one video sent.

8)'JT' between 20 October 2020 and 22 February 2021, there were four images sent.

9)'CCWilly' between 26 December 2020 and 26 January 2021, there were three videos and three images sent.

10)'G-Raffe' between 22 October 2020 and 24 January 2021, there was one video and a conversation.

11)'MM' on 3 August 2020, there were three videos.

12)'Shardvark' between 22 July 2020 and 29 March 2021, images and conversations.

13)'Ryan no limits, pm open' on 14 December 2020 you sent two images.

14)'Partypigbro' between 22 July 2020 and 5 December 2020 there were images sent.

15)'Perv' between 6 July 2020 and 2 April 2021 there were 19 videos and images sent.

16)'Baby Storage C' on 17 December 2020 there were two images sent.

13All of those people were also involved in Charge 1. The following people were new:

1)'RG' between 8 July 2020 to 17 April 2021, there were 16 videos and more than 15 images.

2)'Dirty' between 2 August 2020 and 22 December 2020. One video and five images.

3)'Alex' between 1 November 2020 and 25 February 2021, 15 videos and 20 images.

4)'Nudie Melb' was between 28 November 2020 and 12 December 2020, images and a chat.

5)'TylerCarson' between 16 December 2020 and 22 February 2021, 13 images.

6)'MickyMisha' between 17 December 2020 and 28 December 2020, there were one video and one image sent.

7)'K Mac' between 21 December 20202 and 27 December, three videos and 10 images.

8)'D' on 22 December 2020, one image.

9)'J Dean' between 26 December 2020 and 27 December 2020, one image.

10)'Awkward Guy' on 28 December 2020 six videos and two images.

11)'AMINO AC' between 29 December 2020 and 4 February 2021, 17 images.

12)'iPad21' between 19 January 2021 and 22 February 2021, images over four days.

13)'Yustin Lop', one image sent on 5 February 2021.

14The child abuse material transmitted through these charges includes images, videos and written material depicting the following things:

a)Male children being penetrated in the anus and mouth by a penis and a finger of the adult male or that of a sex toy;

b)Adult men licking the anus, penis and vagina of children ranging in the age from newborns to pre-pubescent;

c)Adult men masturbating the penis of children ranging from infants to pre-pubescent;

d)Pre-pubescent children being subjected to torture and/or acts of 'BDSM' that consist of wearing mouth chokers, being locked in animal cages, being bound by hands and feet;

e)Children depicted in the images and videos ranged in ages between nought and ten years of age; and

f)Some of the children depicted in these images and videos were crying and appeared to be in distress.

15‘Yustin Lop’ sent you an image that depicted nine boys of decreasing age standing in line numbered one to nine. In response, you stated 'number 8 for me'. Later Lop asked if you had a picture like that and you then sent him a child abuse image which I have referred to earlier. The image depicted an animated pre-pubescent boy being penetrated in the anus by the penis of an adult male while giving a thumbs-up.

16On Charge 2, between 17 October 2019 and 19 June 2020 you transmitted, to yourself child abuse material. This is a rolled-up charge incorporating your use of a carriage service to cause child abuse material to be transmitted to yourself through the telegram application as follows:

i.'Man guy' between 17 October 2019 and 4 January 2020 there were 16 videos and 14 images; and

ii.'Tommo7221' between 7 June 2020 and 19 June 2020, it was done over a period of two days.

17You requested images and videos from ‘Tommo7221’ on 7 June 2020, the following conversations occurred between the two of you:

Tommo: 'M'hmm fuck yeah. we could get married and adopt kids of our own and become dumps'.
You: 'Did you have pics of you and your nephew?' Tommo then sends you an image.
You: 'I want that so much babe'.
'Fuck my pedo cock is rock hard here'.
Tommo responds: 'Hee hee hee I love being a paedophile'. You respond: 'That photo is amazing'.

18 On 19 June 2020, in the course of a conversation about being paedophile lovers and paedophile parents, the following exchange occurred between you and Tommo7221:

You: 'I would have raped you in hospital as a newborn' and there are some emojis attached.
Tommo responds: 'Oh dad fuck you shove your cock balls deep, dad will love you'.
You: 'I want our own family together. I want to rape our babies with you every day. Baby I love you.'
Tommo responds 'Did you see the naked pic of my nephew? He looks sexy as fuck'.
You: 'Baby I want to see that so much'.
Then Tommo sends you an image, said to be of his nephew including child abuse material.
Tommo: 'Look how sexy he looks Dad. We need a baby of our own' and you say You: 'Fuck he's gorgeous’
‘Show me more of our little nephew'.

19 I note here that your talk of 'a nephew', being Tommo2771 nephew, takes place only sixteen months after your own two year old nephew was tragically killed in a farm accident.

20On Charges 3 and 5, both charges are of accessing child abuse material by using a carriage service. There are two separate charges due to the same legislative changes referred to earlier in my reasons about Charges 1 and 4. Your offending in respect of these charges is that on numerous occasions between 21 September 2019 and 22 February 2022 you accessed child abuse material.

21In respect of Charge 3, that is between the dates of 21 September 2019 and
22 June 2020 you accessed child abuse material. It's a rolled up charge incorporating your use of a carriage service to access child abuse material through the telegram application. Again the charges are separated only as a result of the legislative changes that relate to the use of your GYOZPRV account to access child abuse material in the following way:

22You saved messages between 21 September 2019 and 29 April 2020 with:

1. Perv between 29 April 2020 and 22 June 2020, there were six occasions where you accessed the material.

2. Travis Barron on 15 May 2020, images and videos were sent; and

3. The ‘TeDdy Collection’ which is a group, or effectively a library of child abuse material of some 63 videos and 9,175 images on 7 June 2020.

23Within the telegram application you also saved a selection of material from multiple sources such as group chats, individual chats, and unknown sites. The material ranged from 21 September 2019 to 29 April 2020 and includes 100 images and 183 videos which have been identified as child abuse material. That is also part of Charge 3.

24Charge 5 is between the dates of 6 July 2020 and 22 February 2021, you accessed child abuse material, again is a rolled up charge of you using a carriage service to obtain child abuse material through that telegram application. This charge is separated from Charge 3 only by way of legislative changes. It is a continuum of

your activities and it relates to the use of your account GYOZPRV, again in the following way:

251. Perv between 6 July 2020 and 22 February 2021 on 14 occasions;

262. You accessed the ‘TeDdy Collection’ between 1 November 2020 and 3 January 2021 on three occasions with ‘AlexRG’ and ‘Matt B’. There were some 63 videos and 9000 images within that group chat.

27And finally, Charge 6, on 23 April 2021 police executed a search warrant at your home. During the search an Apple iPhone belonging to you was located and seized by the police. Analysis of the iPhone revealed 64 images of child abuse material stored on the device within a folder entitled 'Cutie and Dad'. The images were of a series depicting the same pre-pubescent boys and adult males with each image dated 1 April 2020.

28In addition, the child abuse material shares by telegram as described above was also located on the device. The images and videos possessed around each of these chats can be broken down in the following manner, and I'll start with users and then what you transmitted or what was transmitted by other users:

Amino AC: you transmitted 17 child abuse images.
Awkward Guy: 18 child abuse files - sorry eight child abuse files, two images and six videos.
BMelb28: 21 files, 14 images and seven videos.
CCWilly: was 11 files in total including six images and five videos. Also CCWilly transmitted to you 27 images.
Dirty: there was six child abuse files, there was five images and one video transmitted by you.
iPad21: you transmitted four images and received one image from that person.
JT: there was a total of four images and one video transmitted by you and there's one text based response to you.
JL Jr: there were seven files transmitted by you which involved seven images.
K Mac: there were 12 files of nine images and three videos transmitted by you.
Man guy: there were 15 files of one image and 14 videos and then a later set of files with 89 files in it which is 44 images and 45 videos all of them transmitted by

you to Manguy. He sent you in return 14 images and 16 videos.
Micky Misha: there were two child abuse files comprising one image and one video.
Nudie Melb: was two images.
Partypigbro: was three images transmitted by you.
Ryan no limits, pm open: you sent one image and received one image. Shardvark: you sent three images.
SL: you sent four images. Spunkwitch: you sent one video.
Travis Barron: you received four images and one video. Yustin Lop: you received one image.

29 In total, on your iPhone, there was 128 images and 84 videos that you had sent and 47 images and 17 videos you had received.

30You provided the investigators with the passcode to your mobile phone. You exercised your right to make “no comment” record of interview.

31Your offending does not involve the volume of images and videos which are frequently seen in cases such as this. Nevertheless your offending involved sending and receiving images of children and videos of children being sexually abused whilst communicating on telegram chat about your perverted and repugnant plans and fantasies with the recipients or senders of the child abuse material. This offending normalises and promotes the concept of sexual abuse of children. This factor is an aggravating feature of the general charge of accessing child abuse material and of transmitting child abuse material.

Personal circumstances

32You are now 47 years old. At the time of your offending you were between 44 and 45 years of age. You grew up in the farming district of Naringal near Warrnambool. Your parents were dairy farmers. You are the eldest child of four children in the family. You were educated at Naringal Primary School and then attended Brauer Secondary College in Warrnambool to complete Year 12. You reported to Patrick

Newton, which was Exhibit ‘B’, that you were well cared for in your family and that you had not been subjected to any form of mistreatment.

33Upon leaving school you joined the Army and served as a Tank Crewman. You remained in the Army for one full year and a further four years part time. Whilst in the Army you studied a short time at the University of Wodonga. You then returned to work on the family farm. You were involved with the local sporting clubs and the community activities there.

34You have spent one year in the United Kingdom on an agricultural scholarship exchange. You returned home and ran a local general store for three years. During all of this time you were exploring and coming to the conclusion that you were a gay man. You came out to your family when you were approximately 30 years of age. Your family fully supported you in your life. You moved to Melbourne and soon thereafter commenced a relationship with your partner Kier. You attempted conducting a bar business here in Melbourne but that was not successful.

35As a mature aged student you have completed a Bachelor of Science and Environment and a Masters of Urban Planning and Environment. You have worked as a Commonwealth public servant for approximately 14 years and resigned shortly prior to your plea hearing.

36You have remained in a relationship with Kier. You described your relationship with Kier in Exhibit ‘B’ as 'initially exclusive and became more open over time'. You engage in drug use and describe the drug use as 'central to your sexual connection with your partner'.

37In January 2019, one of your nephews, aged two, was tragically killed when a piece of farm machinery fell on him. Your offending for these matters commenced later in 2019.

38In 2013 you contracted HIV. You have received medical care for that condition and now have an undetectable viral load.

39Since your arrest for this offending you have participated in Sex Offender Treatment programs under the supervision of Dr Philip Greenway and Geoffrey Burrows. Exhibit 3 was a report dated 12 April 2023 outlining the treatment in full detail. You have attended 23 consultations in person and 10 of them by video conferencing between 14 May 2021 and May of 2023. The report states:
'Following this element of treatment, Mr Membrey successfully structured his distorted offence-supporting cognitions and demonstrated an improved albeit intellectual understanding of the destructive nature of his offending behaviour. His restructured cognition, included “sexual abuse will always cause significant harm to a child's life, regardless of how they appear” and “role playing about child abuse can normalise it to myself and others and may encourage someone to act out their fantasies and harm a child”. Despite this progress, Mr Membrey's victim empathy remains superficial. He requires further engagement in treatment to consolidate his progress and further enhance his victim empathy'.

40 You have also participated in 'CEM-COPE', that is a Coping with Child Exploitation Material Use Program, facilitated by Dr Diana Talevski, Dr Simon Vincenzi and Ms Rose Tingate at Forensicare. The report dated 3 April 2023 is Exhibit 4 in the plea. You have attended 15 sessions under this program. Each session was for a period of two hours. In summary, the identified issues were illicit substance abuse which was methamphetamine, relationship stress, social isolation and loneliness. You have been absent from drug use since your arrest and have needed drug screens to establish that position which are in Exhibit 5 on the plea.

41You have the support of your partner who gave a reference which was Exhibit 7, your family, which were Exhibits 6 and 8. They accept that you have accepted the responsibility for your offending, that you are remorseful for your offending and that you have actively sought treatment to lower the risk of reoffending by you.

Sentencing Considerations

42The basic purpose for which a court may impose a sentence, just punishment, deterrence, both specific and in general, rehabilitation and denunciation of your

actions, and the protection of the community. In sentencing you, I must have regard to a range of factors such as the seriousness of your offending, your culpability for it and your personal circumstances.

43I'm also required to balance the interest of the community in denouncing your criminal conduct with the interest of the community in seeking to ensure that, as far as possible, that you, as an offender, are rehabilitated and reintegrated into society.

44The six charges you pleaded guilty to, are Commonwealth offences. In sentencing you I also take into account the matters referred to in the certificate attached to s 16BA of the Crimes Act 1914 form dated 19 April 2023 to which you have admitted. These matters raise matters of specific deterrence and retribution in your overall sentence.

45Section 17A of the Crimes Act 1914 provides that a Court shall not pass sentence of imprisonment for a federal offence unless it is satisfied, after having considered all other available sentences, that no other sentence is appropriate in all the circumstances.

46Section 16A(2) sets out a non-exhaustive list of factors a Court is required to consider when sentencing a federal offender such as yourself, as follows:

a)The principles of general deterrence;

b)The nature and circumstances of the offending including your moral culpability;

c)The maximum penalties applicable to the charges that you face;

d)If the offence forms part of a course of conduct that consists under serious criminal acts, the same or similar acts to that course of conduct;

e)The fact that you have pleaded guilty to the charges;

f)The degree to which you have cooperated with law enforcement agencies in the investigation of the offences themselves;

g)The deterrence effect of any sentence or order under consideration may have on you personally, that is specific deterrence;

h)The need to ensure that you are adequately punished for your offences;

i)Your character, antecedence, age, means and physical and mental condition;

j)The probable effect of any sentence or order under consideration may have on your family or your dependents;

k)The prospects of your rehabilitation;

l)The fact that prison is, as I've said before, a last resort.

47You have pleaded guilty to these charges at the earliest time in these proceedings. Your plea of guilty and cooperation with the police indicate and demonstrate some remorse on your part and I will accept that you are remorseful for your offending.

48Your plea of guilty has utilitarian value. You have allowed for the orderly administration of justice to take place. There is a certainty of outcome and the resolution of the substantive issues raised by your offending. Your plea also allows for the preservation of court and police resources to deal with other matters and your plea vindicates the public confidence in the legal process which has been set up to protect the community. As I said before, you have no criminal history and there are no charges outstanding.

49The Court of Appeal in the case of Worboyes v The Queen which is reported at [2021] VSCA 169 sets out a number of considerations that were particular to a plea of guilty in the course of the COVID 19 pandemic and even more so in the sentencing process. These considerations were reinforced by the Court of Appeal in the case of Rossi v The Queen [2021] VSCA 296 which recited the paragraphs

35 through to 39 of Worboyes' case and highlighted the following; I'm not going to read them all out, I'm just going to read some of them:
'We therefore consider whilst the Courts of this State continue to labour under the adverse effect of the pandemic, a sentence in court should view a plea of guilty as carrying with it a greater utilitarian benefit than at other times and in other circumstances and concomitantly, as attracting an augmented mitigatory effect on the sentence, simply because the plea will benefit the beleaguered administration of justice, given the unhappy state of the courts’ lists, the courts must, in an endeavour to alleviate the strain on the system, encourage those accused who are guilty to so plead. Such encouragement must come from an actual and probable amelioration of sentence.'

50 The Court of Appeal then went on:

For these reasons, we consider that, all other things being equal, a plea of guilty entered during the currency of the COVID-19 pandemic is worthy of greater weight in mitigation than a similar plea entered at a time when the community and the courts are not afflicted by the pandemic’s effects. A plea of guilty during the pandemic ordinarily should attract a more pronounced amelioration of sentence than at another time. Although a sentencing judge need not quantify the extent of any ‘discount’, he or she must ensure that the plea of guilty results in a perceptible amelioration of sentence.'

51 The Worboyes discount, as referred to, has particular application in your case because you were on bail between your arrest and plea hearing.

52The time between your arrest and plea has been a delay of two years. You have engaged in rehabilitation programs in that time. You have also managed to stay drug free for that period. The fact that these charges and the potential for imprisonment have been hanging over your head for a two year period, are a factor in mitigation in your sentencing process.

53I take into account your personal circumstances as at outlined earlier in these reasons. You have no prior convictions. You have a consistent work history over your life.

54You have been examined by Mr Patrick Newton, Forensic Psychologist, for the purpose of your plea hearing. His report, dated 11 April 2023 was Exhibit 2 in the plea. He assesses your mental state as normal. He has diagnosed you with methamphetamine use disorder in remission. He opines that you meet the criteria for other specified paraphilia with paedophilic features. He assesses

you as a moderate risk of re-offending. He recommends you continue with your sex offender rehabilitation to reduce your risk of re-offending.

55I assess your prospects of rehabilitation as fair. You have engaged in rehabilitation by undertaking sex offender programs, you have the support from your family, your diagnosis of a specified paraphilia with paedophilic features represents a moderate risk of recidivism.

56Your offending is serious in respect of each of the six charges. Parliament has fixed a maximum sentence of 15 years imprisonment. Your moral culpability for these offences is high, the extent of the offending is significant:

(a)Charges 1 and 4 are in effect a continuation over a period of 19 months where you transmitted child abuse material to like-minded persons over 31 different telegram chats.

(b)Charges 3 to 5 are offending which occurred over a 16-month period on four different telegram chats where you accessed child abuse material with like-minded offenders.

(c)Charge 2 is where you offended over two discreet periods totally three months where you caused child abuse material to be transmitted to you by like-minded persons using the telegram chat system; and

(d)Charge 6 is the possession of the child abuse material including images, texts and videos, on the day of your arrest.

57The materials included degrading, forceful and humiliating sexual acts on children. The sexual acts included penetrative and non-penetrative activity and acts engaged with adults and children. The children ranged in age from babies to pre-pubescent children. The images were of a sadistic and deviant nature.

58The chat communications not only referred to sexual acts but also contained references to raping, kidnapping, drugging, infecting with HIV and other

deliberately harming acts to children. The text communications had the tendency to “normalise” or encourage the exploitive sexual activity with children and may stimulate a susceptible recipient to engage in actual activities of sexual offending against real children.

59The offending by you involves being part of a network of like-minded offenders. There is no evidence you derived any financial benefit from the offending or the communications on telegram. The chats clearly mark out your sexual interest in young boys between zero and ten years of age. The first five charges involve numerous separate events of offending and clearly more serious than a single event of offending.

60The main sentencing consideration is general deterrence. The protection of children is of tantamount consideration for the court in applying the law.

61I take into account the provisions of s 19(5) of the Crimes Act 1914, where there is a presumption of cumulation for sex offences charges committed after 23 June 2020. I have cumulated only that part of the sentence for Charges 4, 5 and 6, that properly reflect the overall seriousness of the offending. The sentences imposed are of appropriate severity in all the circumstances of this prosecution. To impose a great cumulation or total cumulation would be in breach of the sentencing principle of totality.

62The principles of general and specific deterrence are paramount in this sentencing process. The principles of just punishment and denunciation of conduct are also applicable and the protection of the community is a relevant sentencing consideration. The community demands that the law protects children and a just sentence dictates the term of imprisonment to be actually served as the only appropriate sentence for the charges 1 to 6.

63Now Mr Prosecutor, can I just check, what is the pre-sentenced detention?

64MR MANNING: Twenty-three days, Your Honour.

Background

The offender was born in June 1975 and is 47 years old. At the time of the offending he was between 44 and 45 years old.

On 17 February 2021, the Joint Anti-Child Exploitation Team (JACET) arrested Thomas James Donaldson and executed a search warrant at his home address. Analysis of Mr Donaldson’s iPhone revealed a number of communications on the encrypted Telegram messaging application between Mr Donaldson and a user with the moniker ‘GyOzPrv’. Those communications involved discussions about the sexual abuse of children. GyOzPrv also sent to Mr Donaldson various images and videos which were identified as child abuse material.

The investigation into GyOzPrv led JACET investigators to the offender.

Overview

The charges predominately relate to the offender’s use of telephone application Telegram, which he used to communicate with other likeminded individuals. The conversations captured are sexually charged and are interspersed with references to, and images of, child abuse.

Charges 1 and 4 are rolled-up charges incorporating the offender’s use of a carriage service to transmit child abuse material through the Telegram application. The charges are separated only as a result of legislative changes.2

Both charges relate to the offender’s use of Telegram account, GyOzPrv, to send child abuse material in 31 Telegram chats over the charged dates, as follows:

The child abuse material transmitted throughout charges 1 and 4 includes images, videos and written material depicting the following:

b.Adult men licking the anus, penis and vagina of children (ranging in age from newborn to prepubescence);
c.Adult men masturbating the penis of children (ranging from infant to prepubescence);
d.Prepubescent children being subjected to torture and/or acts of BDSM (wearing mouth chokers, being locked in animal cages, being bound by the hands and feet);
e.Children depicted in the images and videos ranged in age between 0 and 10 years of age;
f.Some of the children depicted in these images and videos were crying and appeared to be in distress.3

Chat logs with man guy

On 13 September 2019, the offender initiated a conversation on Telegram with ‘man guy’, stating that he saw man guy’s “profile on sexting forum” and that he “love[s] toddler boys”.4 Man guy asked if the offender had any experience to which the offender stated, “[s]adly I don’t. I’ve only realised that I am a pedo over the last few years. Always liked younger but it was only when given some encouragement that I realised I was fully up for as young as baby’s”.5

They discussed whether they had “stuff” to share and trade, and the offender subsequently sent 14 videos to man guy which have been identified as child pornography material from 13 September 2019 to 15 September 2019.6 That conduct forms the basis of Scheduled Item 1.

On 13 September 2019, after the users exchanged explicit pictures/videos of themselves and child pornography material, the offender asked, “Any more vids to share?”.7 Man guy then sent 3 child pornography videos to the offender.8 That conduct forms the basis of Scheduled Item 2.

Between 21 September 2019 and 4 January 2020, the offender transmitted 39 videos and 42 images to man guy which have been identified as child abuse material.9 The material depicted newborn babies, infants and prepubescent boys being penetrated in the anus and mouth by the penis of an adult man or foreign objects. It also depicted a prepubescent female displayed with the text “PEDO PRINCESS PRP 2016” written upon her legs whilst being simultaneously penetrated in the anus and vagina by the penises of adult men.

The images and videos transmitted between 21 September 2019 and 4 January 2020 form part of

Charge 1.

Throughout the conversations above, man guy also transmitted child abuse material to the offender, as follows:

a.On 17 October 2019, after sharing several videos with man guy, the offender asked if man guy had “any new to share”.10 In response, man guy asked the offender if he is “into boys or girls”.11 The offender answered boys, before man guy sent 2 child abuse videos.12 Man guy then sent a further 5 child abuse videos to the offender.
b.On 4 January 2020, after exchanging child abuse material with man guy, the offender asked if man guy had any more.13 In response, man guy sent the offender 8 child abuse images.14 Upon receipt of the images the offender said, “[f]uck yes. They are great pics of them both inside her”.15

Man guy sent a further 5 child abuse images. The offender asked, “any black babies or kids being raped/abused”.16 In response, man guy sent the offender a series of videos.17

The offender stated, “[l]ove how big his cock is”18 and “love him being fingered”.19 Man guy then sent further videos.

In total, the offender received 16 videos and 14 images of child abuse material between 17 October 2019 and 4 January 2020.20 That conduct forms part of Charge 2. On 4 January 2020, the offender responded to one of the files sent to him by man guy, stating, “That’s fucking hot. Love how he’s holding it as well”.21

On 22 December 2020, the offender sent man guy 6 videos and 2 images of child abuse material.22 That conduct forms part of Charge 4. Upon man guy stating “Nice”, the offender said, “Cheers perv. How about you?”.23 Man guy then sent child abuse videos and images to the offender.24 This conduct forms the basis of Scheduled Item 3.

Chat logs with BMelb28

On 30 September 2019 the offender commenced a conversation with Telegram user, BMelb28.25 The offender stated, “It’s always great to know there’s some like minded guys locally. I’m 43 gay like young boys”.26 BMelb28 responded, “I’m 28. Into all kinds of taboo”.27

On 6 October 2019 the offender sent 5 child abuse images to BMelb28.28 On 2 November 2019 he sent a further child abuse image. The transmission of these images forms part of Charge 1.

On 8 July 2020, the offender sent another 3 child abuse images to BMelb28.

On 21 July 2020, he stated, “Want to be cruising for young boys”. He asked BMelb28, “Any close encounters with younger kids recently”29 and later sent 1 child abuse video and 2 child abuse images.30 The conversation continued:31

The communications by the offender between 8 July and 22 December 2020 form part of Charge
4. The images and videos transmitted depicted prepubescent and infant boys being penetrated in the mouths and anus with the penises of adult men or foreign objects; and a newborn boy being fed semen through a baby’s bottle and the smoke emitted from an ‘ICE pipe’’.

Chat logs with JL Jr

On 17 October 2019 the offender commenced a conversation with Telegram user JL Jr. The offender sent a child abuse image to JL.

The conversation continued on 17 November 2019. The offender stated, “I’m just playing with my hard pedo cock watching some appropriate porn. How about you”.34 Later that day, JL sent the offender an image of his penis, to which the offender replied, “Fuck I wanna rape babies with you so much babe [emoji].”35

The offender’s communications on 17 October and 17 November 2019 form part of Charge 1.

On 23 January 2020, the offender and JL Jr engaged in further conversation, with discussions around staying together. The offender stated, “We could spend the time discussing some humanitarian style travel ideas”, and sent an image titled “Age of sexual consent around the world”.36

On 15 May 2020, the pair sent messages including:37

JL Jr All in all it’s a near ideal kind of isolation. (If a two-perv kidnapping is impractical
…. you and me plus one, locked in for months (with frequent illicit journeys to acquire essential substances to inflict upon our new charge, of course) There are bogan junkie sluts with fatherless babies all over up here

OffenderMmm you make it sound like the most romantic of romantic getaways. A pedo honeymoon allowed due to a pandemic necessitated lockdown. Granting us the isolation and privacy we could only have dreamed about before.

On 5 December 2020 the offender sent a child abuse image to JL Jr.38 He sent further child abuse images on 22 December 2020, 26 December 2020 and 4 February 2021.39

On 26 February 2021, the offender stated, “Was out and about in a local park. Toilet block near playground”.40 JL Jr responds, “Yum. Fucken dirty pervert. Wish I’d been there [emojis]”.41

On 2 April 2021, the offender sent JL Jr images of himself wearing “boys [sic] underwear”.42
Later, he sent an image which has been identified as child abuse material.43

The child abuse images sent by the offender between 5 December 2020 and 2 April 2021 form part of Charge 4. The images depicted real naked infant boys positioned with a focus on their genitals; animated naked infant boys either displaying erect penises and being masturbated, or being anally penetrated digitally or with the penis of an adult male.

Chat logs with Tommo7211

Between October 2019 and June 2020, the offender communicated with another Telegram user, Tommo7221. Tommo7221 was the Telegram account of Thomas James Donaldson, who was arrested on 17 February 2021 and led to the investigation into the offender.

During the conversation the offender and Tommo7211 discussed engaging in sexual activity, both between themselves and with children. They repeatedly referred to themselves as paedophiles.

On 1 November 2019, GyOzPrv and Tommo7221 had the following exchange:44

Tommo7721: Mmmm yes daddy tell me how much you wanna fuck a baby while you’re deep in me
Offender:Ah baby I want that so much A newborn

Tommo7721: Oh yes brand new!
He wouldn’t survive

Offender: Yeah he would stand no chance with us brutally opening him up and using him

On 3 November 2019, GyOzPrv and Tommo7221 had the following exchange:45

Tommo7221: I’ll have to take a toilet break Offender: Yeah. Grab a kid on the way in
Tommo7221: Fuck yeah shove my pedo cock inside him

At 10:30am that day, the offender wrote “Fuck so close” and sent a child abuse image.46 He continued, “Baby boy I want you and whatever other baby boy we could have join us”.

On 13 April 2020, the offender and Tommo7221 exchanged messages. Relevantly, the conversation included the following:47

Tommo7221: Fuck yeah that pedo cock would look so hot in a toddler [sent explicit image of himself]

Fuck I love your pedo cock [emojis]

On 7 June 2020, the offender and Tommo7221 exchanged sexually explicit photographs.48 They then had the following conversation:

They continued to discuss Tommo7221’s nephew, and in particular, the various acts of sexual abuse they wished to perpetrate against him.49

The above communications form part of Charge 1.

In the course of their conversations in May 2020, the offender asked if Tommo7221 had a picture of his nephew.50 After receiving a photo from Tommo7221 purporting to depict his nephew,51 the offender stated “[d]id you have any pics of you and him together”52 and the following exchange ensued:53

Between July 2020 and February 2021, the offender continued his conversation with Tommo7221. These communications form part of Charge 4.

On 5 July 2020, the offender sent messages to Tommo7221.58 In the course of that conversation, Tommo7221 told the offender that he “loves [his] pedo dad’s cock”.59 In reply, the offender stated, “I can’t wait to have it inside your baby nephew with yours [emojis]”.60

On 8 July 2020, they continued to discuss Tommo7221’s nephew.61 Among other things, the offender stated that they could “both poz your nephew”.62 He also stated that he imagines them “fucking your nephew so much”.63

A similar conversation followed on 21 and 22 December 2020.64 After asking for more pictures of Tommo7221’s nephew, the offender stated, “want to fuck him with you now”.65 There was an ensuing discussion about sexual activity with Tommo7221’s nephew. The conversation ended with the offender asking for “any more pics of our little boy”.66

On 5 February 2021, the offender sent two child abuse images to Tommo7221.67 In the course of the conversation at the time, the offender also forwarded Tommo7221 a child abuse video.68

Chat logs with JoshBigD

On 15 November 2019 the offender sent another Telegram user, JoshBigD, a message. He stated that he was in Australia, introduced himself as ‘Chris’, and sent several pictures of himself. He also sent an image that has been identified as child abuse material.69 The pair had a brief discussion about their “desires”. JoshBigD stated that he liked “7 – 14 …”. The offender responded that he liked “pre pubescent and younger”.

The transmission of the child abuse image on 15 November 2019 forms part of Charge 1.

Between December 2020 and April 2021, the offender continued his conversation with JoshBigD. On 27 December 2020, the offender sent JoshBigD a message. A brief exchange followed, at which point the offender stated “I want to feel our cocks inside a baby boy together”.70 The offender later sent JoshBigD a child abuse image.71

On 25 January 2021 the offender sent JoshBigD a further child abuse image.72

On 5 February 2021, without any greeting and in the absence of any request, the offender sent JoshBigD a further child abuse image.73

The communications between 27 December 2020 and 5 February 2021 form part of Charge 4. The child abuse material depicted animated prepubescent male children either masturbating or being penetrated in the anus by an adult male. The material also showed a real infant boy being held with his hands behind his back, and appearing as about to be digitally penetrated.

On 14 November 2019 the offender initiated a conversation with Telegram user, ‘SL’.74 On 26 November 2019 he sent SL a child abuse image.75 This forms part of Charge 1.

On 27 November 2019, the offender told SL that he loved toddlers and babies.76 They had a similar conversation on 15 February 2020, during which the offender said he loved “pre pubescent and younger” and “0+. Brutal”.77

On 22 July 2020, the offender told SL, “I want to cruise for kids with you and snatch them to molest and rape together”. He also sent a child abuse image.

On 14 December 2020, after staying they were both ‘horny’, the offender said, “Want my cock inside a little boy. With yours”.78 He then sent another child abuse image to SL.79

On 22 December 2020, the offender sent a further child abuse image.80

The communications between 22 July and 22 December 2020 form part of Charge 4. On 1 December 2019, the offender sent Telegram user ‘Matt B’ a series of child abuse images.81 He referred to Matt B as a “pedo brother” and asked Matt B for images of himself. On 17 December 2019, the offender sent Telegram user ‘Spunk Witch’ a number of images, including a photograph of himself.88 He later sent a child abuse video.89 The video depicts an adult male masturbating in the presence of a naked prepubescent male child, and encouraging the child to do the same. The adult male then placed the prepubescent male child on top of his stomach and continued to masturbate.

The video transmitted by the offender forms part of Charge 1.

Chat logs with J T

On 27 December 2019 the offender sent a message to user ‘J T’ on Telegram. He told J T,
“[b]aby I want that so so much. Us together pozzing babies”.90

They exchanged further messages on 7 March 2020.91 During that conversation, the offender sent a child abuse image to J T.92 He sent messages including, “I love younger”; “I love older fucking and molesting younger”; “I want that so fucking much. Hunt for kids together. Kidnap and rape them together”; and “I want to poz babies with you and leave them for their parents to find them not knowing”.

The above communications form part of Charge 1.

On 20 October 2020 the offender sent a child abuse image to J T. On 22 February 2021, he sent another 3 child abuse images.93 These communications form part of Charge 4.

On 4 January 2020, the offender initiated a further conversation with ccwilly by saying “I love these” before forwarding a further 4 child abuse images.96

On 5 February 2020, he asked if ccwilly could add “a fellow perv mate” to the ‘Toon group’.97 He sent another child abuse image.

The images sent between 1 January and 5 February 2020 form part of Charge 1.

On 26 December 2020 the offender sent a child abuse video to ccwilly.98 The following day, he sent another child abuse video and three child abuse images.99

On 26 January 2021 he sent a further child abuse video to ccwilly. Ccwilly replied, “In a weird way I love it. The more fucked up the better. Especially if boys are involved”.100

On 4 January 2020, the offender sent a message to Gir Affe, ‘Hey baby I loved chatting about our family [emojis]”.102 Later that day, he said “[t]he family life I crave is only possible with another proud prod as my partner and you baby are the proud pedo that can lift it to the next level”.103 He then sent a series of images to Gir Affe (which are not child abuse material). He explained that “[t]he pic of the boy was taken on a holiday recently up in NT. Him and his parents were on the same day tour as me”.104 After a brief conversation about the boy, he said “I was properly looking for places that I would be able to take him so as I could molest and rape him”.105 He added,106

On 28 April 2020 the offender sent Telegram user, Perv, a child abuse image.153 The following day, he sent 2 child abuse videos, a child abuse image, and then a further 4 child abuse videos.

During their Telegram conversation, the offender said,154:

On 16 May 2020, Perv asked the offender if he had “[a]ny new perv vids?”.158 In response, the offender sent 2 child abuse videos and images.159

The offender sent multiple images and videos of child abuse on 31 May 2020 and 1, 7 and 19 June 2020.160

Between June 2020 and April 2021, the offender continued his conversation with Perv. The pair continued to exchanged child abuse material. On 6 July 2020 the offender sent an image of a child and told Perv, “I wanna go into hospitals with you baby an molest newborns like this one”.161 He sent further child abuse images and videos on 25 July 2020, 3 August 2020, 19-21 October 2020, 2-3 November 2020, 20 November 2020, 5-6 December 2020, 12 December 2020, 14 December 2020, 16 December 2020, 21 December 2020, 28 December 2020, 25 January 2021, 7 February 2021, 23 February 2021, 7 March 2021, 30 March 2021, and 2 April 2021.162

The material included an animated image of a prepubescent boy crying while being penetrated in the anus by an adult male; images and videos of newborn and prepubescent boys being penetrated in the anus by adult men, and an image of an infant boy penetrating an infant girl.

On 3 August 2020, the offender stated,163

Just going through our chat history baby. I love this pic and can you imagine a little boy that you arranged to be staying in our home overnight, brought into our home by his father who needed to see his boy abused to fulfill his own sexual desires. The perfect situation. Our gift to the father paid for by his gift to us. All fucking raping him together.

On 22 November 2020 the offender said “[b]aby I love you so much I want us to be married. I want to rape your little nieces and nephews with you so badly. I want to do it in front of their parents.”164

On 25 January 2021, the offender sent a link to an article entitled “Australian child sex ring uncovered after arrest of Justin Radford”. The offender added, “I have been loving this story”.165

The offender’s communications between 6 July 2020 and 2 April 2021 form part of Charge 4.

Throughout the above conversations, the offender also accessed (and responded to) child abuse material sent to him by Perv. Specifically, Charge 3 includes the offender’s access of child abuse material on 29 April 2020, 15 May 2020, 16 May 2020, 6 June 2020, 19 June 2020 and 22 June 2020. Charge 5 includes the offender’s access of child abuse material on 6 July 2020, 7 July 2020, 7 July 2020, 3 August 2020, 20 October 2020, 19 November 2020 (x2), 24 November 2020, 5 December 2020, 14 December 2020, 21 December 2020, 3 January 2021, 13 January 2021 and 22 February 2021.

Chat logs with Baby Storage C

On 15 May 2020, the offender transmitted 4 child abuse images to a group called, Baby Storage C, on Telegram.166 It is unknown how many members were present in the group at that time. This conduct forms part of Charge 1.

On 17 December 2020, the offender sent a message to the same group stating “Hey pervs”. He followed this by transmitting 2 child abuse images and an image depicting a Xanax lollipop.167 The transmission of the 2 child abuse images forms part of Charge 4.

Chat logs with Travis Barron

On 15 May 2020, the offender communicated with another Telegram user, Travis Barron. During this conversation, the offender received child abuse material in the form of images and videos. He responded to the images and videos and on one occasion told Travis, “The vids I like the most”. The offender’s access of this material forms part of Charge 3.

The material involved infant boys either naked or semi-naked, bound by the legs and hung from a platform while being beaten with a sandal by an adult male. The boys were then dragged across the ground before being beaten again. Further material included depictions of an adult male giving birth to a child via his anus; and adult men engaging in sexual conduct with the following text superimposed over the top, “Rewarding the BF for killing a kid today”, “Hearing the Kid Scream is Enough to Make me Loose it”, and “Knowing a Kid has to Die for me to Make Money”.

During their conversation, Travis asked the offender if his name was ‘Chris’,168 stating that he, “fell in love with a guy named Chris in Australia. His name was Chris he was poz and we always talked about killing and fucking kids”.169 The offender stated, “I’ve missed you babe [emojis]”.170 The conversation continued:171

Travis: Love how we used to talk about infecting baby’s [sic] with med resistant HIV Offender: I loved it so so much. How we were going to disappear from society so as
we could embrace pedophelia I want that so much

Travis: Same here that would be paradise so much.

TeDdy Collection

The offender was also a member of a Telegram channel named, the ‘TEDdy Collection’. Of the messages posted in the channel, 9,175 constitute child abuse material. There are 63 videos of child abuse material in the channel.

The offender did not, at any time, actively participate in the channel by sending messages or responding to material posted by other users. However, there is evidence that establishes he was monitoring and/or accessing the chat log. Specifically:

a.On 7 June 2020, in the chat log between the offender and Perv, the offender forwarded several images from the TEDdy Collection;172
b.On 1 November 2020, in the chat log between the offender and Alex, the offender forwarded an image from the TEDdy Collection;173
c.On 14 December 2020, in the chat log between the offender and R G, the offender forwarded several images from the TEDdy Collection; and
d.On 3 January 2021, in the chat log between the offender and Matt B, the offender forwarded several images from the TEDdy Collection .174

The conduct on 7 June 2020 forms part of Charge 3. The conduct between 1 November 2020 and 3 January 2021 forms part of Charge 5.

On 15 February 2020, R G initiated contact with the offender on Telegram. Between 8 July 2020 and 17 April 2021, the offender transmitted a large number of child abuse videos and images:175

a.A total of 7 images and 3 videos between 7.01am and 5.02pm on 8 July 2020;
b.Several images at 5.16pm on 8 July 2020;
c.A total of 3 images and 2 videos between 5.17pm and 5.31pm;

The material included images of animated prepubescent boys engaging in anal sex with adult men, and images and videos of prepubescent boys being penetrated in the anus by adult men.

In addition to the above transmissions, the offender engaged in written communications that constitutes text-based child abuse material.

On 8 July 2020 after sending R G some “sneaky pics”,176 the offender stated, “I love showing them to you”. R G said, “Love boys between like 6-14. Either groomed like the last vid or even forced hehe. That can be ready [sic] hot. I love seeing anal too”. They made sexualised remarks in relation to the child abuse images the offender sent.

On 3 November 2020, the offender sent R G a message stating he was “cruising in a nearby park”.177 R G responded on 5 November 2020 stating “I wish I was a young boy in that park by myself in the tight little school shorts and you took me into the bushes and felt me up as you held my mouth shut”.178 The offender replied, “Fuck yeah I wish that as well. My cock has gone instantly hard imagining that. You are such a sexy boy. There would be no doubt that I would do exactly that. As I held my hand over your mouth my other hand would be slipping underneath your shorts and pulling aside your little boy underwear”.179

On 14 December 2020, in response to a video sent by the offender, R G stated “I love home vids like that. Imagine eating him out too. Soo clean”.180 The conversation continued:181

On 2 August 2020 the offender had a conversation with Telegram user, ‘Dirty’. Him wrapped between us. Our tongues forced down his throat together”.182

The following day, the offender sent 4 child abuse images and 1 child abuse video to Dirty.183
On 22 December 2020, he sent a further child abuse image.184

The above communications form part of Charge 4. The child abuse images and video depicted a real prepubescent male child being penetrated in the anus by the penis of an adult man; a newborn male child’s penis being positioned with the penis of an adult male; an animated prepubescent naked boy exposing his anus and penis, positioned next to the word “FUCK…”; and a real female toddler child, naked from the waist down, laying on her back with her leg in the air while sucking on a dummy/pacifier.

On 24 February 2021, the offender and Dirty engaged in the following conversation:185

On 1 November 2020, the offender sent a message to user ‘alex’, stating “I want to feel our cocks together inside a little boy that we have grabbed together so badly”. He continued, “Yeah fucking him so forcefully together. I love that” and proceeded to send child abuse images to alex.

The offender and alex continued to discuss sexually abusing a child, with the offender stating, “Yeah both of them tearing it’s hole wide open so as we can thrust our cocks deeper inside him, pounding his insides at the same time”, and “Fuck yes. Love to poz him and then send him back to his parents so as they can watch hopeless as he is overcome with AIDS”.186

The pair also discussed the child abuse material that the offender sent.187 The offender’s comments included, “Yeah I know. I love their little cocks as well”; “Fuck yeah pulling back his tight little foreskin”, and “his crying and scream making us harder”. They also discussed raping children while their father watched and making “him want to fuck his little boy as much as [they] do”.188 The offender continued, “I have a younger brother. The offender sent further material on 17 January 2021, 22 February 2021 and 25 February 2021.

The child abuse material depicted a prepubescent boy being masturbated while laying on an adult male with an erect penis; toddlers and infant boys being penetrated in the anus by adult males; and prepubescent boys naked while bound by the hands and feet.

Chat logs with Nudie Melb

On 21 November 2020, Telegram user ‘Nudie Melb’ initiated contact with the offender. On 28 November 2020, after stating that they were both ‘horny’, the offender said “[l]ove to have my cock inside a younger hole”.194

On 12 December 2020, the offender sent Nudie Melb 2 child abuse images.195 The material depicted animated images of female toddlers being penetrated in the mouth and vagina by the penis of an adult man.196

On 16 December 2020, the offender sent a message to TylerCarson on Telegram. Later that day, he sent a child abuse image to him.197

On 27 December 2020, the offender sent 8 child abuse images to TylerCarson.198 He went on to state: “Fuck I want to rape babies with you”.199

On 18 January 2021, the offender sent messages to TylerCarson which included: “Me and nephews at Christmas” and “I want to molest them so badly with you”. He accompanied the messages with a child abuse image (not of his nephews).200 The offender continued,

I’m getting so so pervy with them. I need another pedo to force me to take the next step. I’d love if it was you…

…I want to have sex with children and babies more than anything including the consequences of getting caught I want to offend soon knowing that from then I will want to again and that hopefully

On 24 January 2021 the offender said that he “[s]pent the day at the beach. So many hot little boys”.201 He added, “Fuck yeah. Swimming out with a little boy together and molesting him under the water In front of everyone on the beach But no one able to see what we are doing”.202

On 26 January 2021 the offender sent a child abuse image to TylerCarson.203 On 22 February 2021 he sent a further 2 child abuse images.204 Later that day, he sent an image of his family (not child abuse material) and said, “That’s my brother and my youngest brothers daughter”; and “I used to make him suck my cock when we were younger”.205 He later sent a further 2 images of child abuse material.

The above communications form part of Charge 4. The images transmitted by the offender depicted animated and real images of infant children being penetrated in the mouth and anus by adult men; and images and videos of an infant male child and a prepubescent child bound by the arms and feet and being penetrated in the anus.

On 8 March 2021, the offender stated, “I have a huge pedo crush on you bro. Would like to offend with you often and regularly” and “Fuck yes. 2 Proud pedos together. Living our lives lives less complicated by only doing what we love. Child prn and child sex as life should be”.206

On 17 December 2020 the offender sent a child abuse image to Telegram user, MickyMischa.207 The image depicted a bound, naked prepubescent male. MickyMischa replied, “Beautiful kid” and “I hope he died suffering”. The offender said, “Fuck yeah. Me to brother”.

On 28 December 2020 the offender sent a child abuse video to MickyMischa.208 The video depicted a prepubescent female being penetrated in the anus by an adult male’s penis.

On 20 October 2020 the offender engaged in a conversation with Telegram user, ‘K Mac’.209 After exchanging pictures, K Mac said, “We need to do some boys. Any limits”. The offender replied, “No limits. Love brutal. Would love to DP a toddler with you”.

On 21 December 2020 the offender sent a child abuse image to K Mac.210 He added, “Horny as fuck bro. Wanting to be inside little boys”.211

On 26 December 2020, Telegram user ‘J Dean’ sent a message to the offender, asking if the offender liked ‘0+’, to which the offender replied, “I definitely do”.214 J Dean said, “They just look funny to me at that stage, with a mouthful of cock…. but gotta start em asap”. The offender responded, “I fucking love seeing a fat pedo cock opening up a tight unopened hole”. The conversation continued and the following day, the offender sent a child abuse image.215

Chat logs with Awkward Guy

On 28 December 2020, Telegram user ‘Awkward Guy’ initiated contact with the offender.
During the conversation, the offender sent a number of images and videos including:216

a.A photograph of the offender next to a child while they were both in a pool (not child abuse material);
b.A photograph which appears to depict the offender on the ground with three children (not child abuse material);
c.6 videos which have been identified as child abuse material; and
d.2 images which have been identified as child abuse material.

The 6 videos and 2 images of child abuse form part of Charge 4. The material depicts prepubescent boys being penetrated in the anus by the penises of adult men; and an animated prepubescent boy being penetrated in the mouth and anus by the penis and fingers of an adult male.

After the transmission of the child abuse material, Awkward Guy stated, “Of fuck. Shouldn’t you send those in a secret message?’ and the offender replied, “Ah I probably should of. My apologies”.217

On 26 February 2021, the offender sent Awkward Guy a video of him “cruising for boys in a local park”.218 On 6 March 2021, he said that he “wish[es] there was [sic] some little boys closer by”,219 and that he would “love to be there with [Awkward Guy]. On 29 December 2020 the offender commenced a conversation with Telegram user, Amino AC.221 The offender told Amino, “I would love to feel them together inside a boy. I’m 43 gay pedo perv in Australia”.222 He later sent 11 child abuse images in the chat. He asked if Amino had any younger nephews or brothers, and the conversation continued:223

The offender and ‘Amino’ continued to discuss raping a child, with the offender’s messages including:

a.“Knowing that he always would finish up naked used and even abused between us’, ‘It would make our bond even stronger”;
b.“I want to go on proper pedo child sex vacations”;
c.“He can fuck us both as well with his hard little cock. Oh yeah making him dry orgasm. To young to cum”;
d.“Fuck yes. I want him to be used by us brutally and extremely so as he will never be afraid when our friends have him to use”;

On 25 January 2021, the offender said he “Spent today at the beach perving on little boys”. He added, “Or dragged him into the deeper water and molested him under the water in front of everyone back on the beach.”224 He sent 3 child abuse images to Amino.225 The pair continued to discuss sexually assaulting children, and the offender stated, “Oh yeah. Kissing him passionately and deeply. Smothering him as I flood his tiny mouth with your pre cum”. He sent another child abuse image, before stating: “I want to feel our cocks both pressed against the tiny little hole of our little boy”.

Later, he sent a message: “This is a news article about the guy that worked in child care that I mentioned”226 and included a link to an article entitled “Gay Couple at Centre of Childcare Centre Paedophile Ring”.

The conversation continued later that day. He told Amino, “The one I want more than any is our first actual offence. Everything will seem so much easier after that” and said:

The offender’s communications between 29 December 2020 and 4 February 2021 form part of Charge 4. The child abuse images sent by the offender depicted newborn babies and infants being penetrated in the anus by the penises of adult men; a naked prepubescent boy bound by the hands and feet and positioned to expose his penis; an animated boy watching pornographic material while exposing his anus and testicles with a quotation, “Do you wanna try that?”.

Chat logs with iPad 21

On 18 January 2021 the offender commenced a conversation with Telegram user, ‘iPad 21’. The offender stated “Sexy pedo”, to which iPad 21 replied “Fuck yes”. The offender then sent several images to iPad 21, including a photograph of himself.229 He went on to reference “Cruising around for kids together” and later send a link to an article titled “Sydney Man Charges Over Online Child Sex Abuse Network”.230

The following day the offender sent a child abuse image to iPad 21. He stated, “I’ve had to get my pedo cock out now to wank and perv thinking of me being your dad”.231 He sent further child abuse images on 25 January 2021, 4 February 2021 and 22 February 2021.232

The communications sent by the offender between 19 January and 22 February 2021 form part of Charge 4. The images transmitted by him included depictions of an infant boy being digitally penetrated in the anus; and animated prepubescent boys being penetrated in the anus by the penises of adult men.

On 2 April 2021 the offender sent iPad 21 a series of images of himself wearing “boys [sic] underwear”.233 User iPad 21 told the offender that he is going to the beach with his family, and the offender responded, “Ah nice. Any younger members”.234

Chat logs with Yustin Lop

On 5 February 2021 the offender commenced a conversation with Telegram user, Yustin Lop.235 The offender stated he is “43 gay pedo perv in Australia” and added “I love 12 and younger. Favourite toddlers down to 0+”.236

Yustin Lop sent the offender an image that depicted nine boys, of decreasing age, standing in a line and numbered 1 to 9.237 In response, the offender stated “Number 8 for me”. Later Yustin Lop asked if the offender had a picture like that, and the offender sent a child abuse image. The image depicted an animated prepubescent boy being penetrated in the anus by the penis of an adult male while giving a ‘thumbs-up’.238 That transmission forms part of Charge 4.

Saved messages

Within the Telegram application, the offender had also saved a selection of material from multiple sources, such as group chats, individual chats and unknown sites. The material ranged from 21 September 2019 to 29 April 2020 and includes 100 images and 183 videos which have been identified as child abuse material. This conduct forms part of Charge 3.

Possession of Child Abuse Material (Charge 6)

On Friday 23 April 2021, members from the Victorian JACET executed a search warrant at the home address of the offender. The offender was present and was later arrested.

During the search, an Apple iPhone belonging to the offender was located and seized. Analysis of the phone revealed 64 images of child abuse material stored on the device within the folder “Cutie & Dad”. The images are a series depicting the same prepubescent boy and adult male, with each image dated 1 April 2020.

In addition, the child abuse material shared via Telegram (as described above) was also located on the device. The images and videos possessed throughout each of these chats can be broken down approximately as follows:
