HER HONOUR:

1Marie Heeraman, you have pleaded guilty to one charge of theft, between 7 October 2014 and 16 August 2016.  You admit that you stole $142,304.97 from Michael Peirce, your former partner.  You have recently made full restitution of the stolen money.

2This is a course of conduct charge, being a single charge incorporating 808 withdrawals or transfers of money, where you dishonestly appropriated funds on a regular basis, for your personal benefit.

3The maximum penalty for this offence is 10 years’ imprisonment.

4You were born on 23 March 1969 and were 45 to 47 years old at the time of your offending.

5The Summary of Prosecution Opening has been tendered.  It is agreed to be an accurate account of events relating to the offending, although it is not agreed that your relationship with the victim is accurately reflected.  A general summary of the facts is as follows:

6You are a qualified nurse and have worked in aged care for some time.  You met the victim in this matter, Mr Michael Peirce, in around 2007, when you worked as a carer for his elderly parents.

7You commenced a relationship with Mr Peirce in around 2008 or 2009.  You lived together at an address in Boronia and had a close and loving relationship, notwithstanding that it was intimate for only the first two or three months.  You were engaged to be married, although the relationship ended in 2014.

8On 13 July 2012, Mr Peirce received an inheritance of $234,100.42 from his mother’s estate.  This was a significant financial benefit for him, as he had no income other than being in receipt of Centrelink benefits.  On 7 August 2012, he opened an account at the Westpac bank and deposited his inheritance.  Approximately three months later, on 15 November 2012, he opened another account and transferred $200,000 of his inheritance into that account.

9On 1 September 2014, you attended a branch of the Westpac bank in Boronia with Mr Peirce.  You opened an account (Account No.726155) into which Mr Peirce transferred a large portion of his inheritance.  The purpose of this was so that you could manage his money by preventing him from spending it and his family having access to it.  You agreed to assist him by looking after the funds, paying his expenses and providing him with money, as required.

10At the time of the transfer, the bank officer explained to Mr Peirce that he would lose control of the funds if you were the account holder.  Mr Peirce acknowledged that you had been in a relationship for years and that he trusted you with his money.

11Thus, the new account was opened in your name, Mr Peirce was a signatory and $198,365 was transferred.  Being the account holder, you could withdraw cash, make payments from the account using a debit card or transfer funds by electronic banking.  Mr Peirce could obtain funds from the account by attending at the bank and completing a withdrawal slip.  He did not receive a debit card, have access to telephone or electronic banking or receive bank statements.

12On the same day, you opened two more accounts in your own name.  You transferred $190,000 into one account and $8,000 into another, from account 726155.

13Mr Peirce was not aware of the further transfer of funds.  Consequently, he did not have access to his money, nor to the related bank records.

14Your relationship with Mr Peirce ended at around the same time that the bank accounts were opened.  You moved away and all the relevant bank statements were then sent to your address.

15You commenced another relationship and on 30 January 2016, you married your current partner, Mr Andrew McLachlan.

16You eventually disclosed to Mr Peirce that you had transferred the money from account 726155, after he unsuccessfully attempted to withdraw funds.  You explained that you had done so to prevent him and his family from spending the money.  You assured Mr Peirce that his money was safe, that you were looking after it for him and that you would give it to him in the future.

17Between 7 October 2014 and 16 August 2016, you transferred or withdrew a total of $142,304.97, without Mr Peirce’s permission or knowledge.  A total of 808 transactions were made for your own personal benefit.  The Schedule annexed to the Indictment provides accurate and specific details of the date, description and amount involved in each transaction.  I will attach a copy of the Schedule to my reasons.

18Your regular expenditure of Mr Peirce’s money was on grocery and food shopping, alcohol, personal grooming expenses, homewares, clothing including bridal wear, and footwear.  You spent the money at department stores, pharmacies, restaurants, on insurance-related and vehicle-related expenses and you purchased a vehicle, a Peugeot wagon, that is the subject of an application for forfeiture.  You also withdrew cash for unspecified purposes.

19By August 2016, $3,426 in interest had been paid by the bank into your accounts.  Therefore, the total sum of money to which you had access was $201,791.  When the Police commenced their investigation, a total of $14,548.74 remained.

20Mr Pierce’s mobile phone was examined in the course of the police investigation and more than 450 text messages were downloaded.  They showed the frequent communication between you, over an 18-month period.  The messages are illustrative of Mr Peirce’s understanding of your relationship and the reliance and trust he placed in you.

21The communication between you was often in caring and affectionate terms.  You used “pet names” towards each other.  Your deception persisted throughout your communication.

22You told Mr Peirce not to disclose to any of your family members that you maintained contact with each other.  You also made it clear that when you commenced your relationship with your current husband, you did not want him to know about your frequent contact with Mr Peirce.  Mr Peirce was not invited to your wedding in January 2016.

23On 28 December 2015, Mr Peirce contacted you, asking you to return his funds and a car that he had lent you.  He did not want the arrangement to continue as you were getting married.  You did not comply with his request.

24On 20 March 2016, you sent Mr Peirce the following message:

“Good night sweet Michael, sleep well. Thinking of you & I will ring you on Mon to discuss yr moving.  …. Also pls don”t send me a birthday card for my birthday, bec Andrew knows yr handwriting now & he will be upset with me. Please don”t take it personally. I love you as my lifelong & dear friend, but he won”t understand that relationship. Good night & chat on Mon. God bless you. Love, Pixie xxooxx …” (sic)

25On 14 April 2016, you assured Mr Peirce that you cared for him and that he could rely on you.  You said:

“Just know that I love you & care about you v much & I will always be there for you, even when nobody else seems to care.  You”ll always be my dearest friend & yes, for life.  You can count on me”.  (sic)

26On 6 June 2016, you sent the following message:

“I am truly helping you to spend yr $ (dollars) wisely & to save & one day you”ll thank me for this. So pls understand my logic ok. It”s for yr best interest, as I don”t want you to run out of money ok.” (sic)

27Throughout the period of your offending, you assured Mr Peirce that he could rely on you to manage his funds in his best interests.  On 16 December 2015, you sent him a message saying:

“Leave it with me. I am v wise & smart & I will do my best for you ok.”

28You told him not to tell his friends and family about the arrangement that was in place, regarding his money.  You had contact with his son via Facebook throughout the period of your offending.  You pretended that Mr Peirce had not told you anything about his finances and that you hoped and prayed he knew what he was doing with his money.

29On 3 May 2016, you sent Mr Peirce’s son a message:

“… i don't know what he's done with his money. I suspect it's all in a term deposit acc in the bank, but he won't tell me, yet i am the one who worked her arse off to get him his inheritance ….”

30Mr Peirce would contact you when he needed money for his rent and living expenses, as well as spending money.  You encouraged Mr Peirce to take steps to ensure his inheritance would not diminish by using the money he received from Centrelink, encouraging him to find a job and limiting his spending.

31On 24 June 2016, you had a telephone conversation with Mr Peirce’s son.  You told him that you had no idea where Mr Peirce’s money was and that you had not seen or touched it.  Mr Peirce’s son messaged you saying that you needed to transfer his father’s inheritance back to him.  He told you that you were “the biggest liar” and that the police had been contacted.

32Mr Peirce was in a vulnerable position as he had transferred his money into your account, for his own protection.  He maintained affectionate feelings towards you.  He always hoped that your relationship would resume and you took advantage of that.

33Mr Peirce spoke to police on 26 June 2016.  You were arrested on 8 June 2017 and interviewed.  You responded to questions about your relationship with Mr Peirce, although you did not answer any questions relating to the alleged offending.  You were released by police and eventually charged on 26 July 2018.

34On 15 April 2019, a contested committal proceeded.  The victim and other witnesses were called and cross-examined.  The evidence of Mr Pierce was challenged.  It was put to him that his intention was to give you a substantial amount of money and therefore, you had a legal right to use that money.  He denied this.  At the conclusion of the hearing, you entered a plea of “not guilty” to the charge.

35The initial trial date of 1 April 2020 was fixed, although it was vacated as a result of the COVID-19 pandemic.  The trial was refixed to commence on 10 February 2021.  On 2 February 2021 you indicated that you intended to plead guilty to the charge.  Through your plea of guilty, you admit that you had no legitimate entitlement to those funds.

36It is submitted that your plea of guilty is highly valuable, given that Mr Peirce admitted in one of his statements that he had lied to police in an earlier statement about the circumstances of the transfer of money from his account.  He confessed that he would say anything in order to have the money returned and that he was prepared to tell lies to get his money back.  Despite potential issues relating to his credibility and reliability as a witness, you have admitted your offending.

37You are entitled to a benefit for your guilty plea, notwithstanding its timing.  It has a significant utilitarian benefit.  You have saved the Court and the community the time and expense of running a trial and spared the victim the ordeal of giving evidence again.  In those circumstances you have facilitated the efficient administration of justice and are entitled to a benefit for that.  This is particularly relevant given the delay in jury trials that has resulted from the COVID‑19 pandemic.  I consider the utilitarian benefit of your plea to be enhanced by the fact that it was entered during the pandemic.

38The Court of Appeal has recently acknowledged in Worboyes v R[1] that a plea of guilty entered during the pandemic should be accepted as augmenting the utilitarian value of the plea, saying:

[1][2021] VSCA 169.

“it is worthy of greater weight in mitigation than a similar plea at a time when the community and the courts are not afflicted by the pandemic’s effects.  A plea of guilty during the pandemic ordinarily should attract a more pronounced amelioration of sentence than at another time.”

39There was a delay of one year between the victim making the initial complaint and your interview with police.  It took another 13 months for you to be charged.  There was then a delay of around two and a half years from the time you were charged until you entered your plea of guilty, approximately one week prior to the second listing of your trial.  Despite all the relevant evidence being available, your acceptance of responsibility for your conduct took some time.  The delay in the ultimate hearing of this matter is partially due to the fact that you elected to contest the charge, but also due to the delay in your charge being laid and the significant delays associated with the COVID-19 pandemic.  I consider delay to be a powerful factor in your favour.  You have not reoffended for the last five years.

40While you concede the seriousness of your offending, it is submitted that your misconduct and moral culpability needs to be viewed in the context of your de facto relationship with Mr Peirce.  Throughout your relationship, you had worked hard.  Your income was used to support both of you, as Mr Peirce was in receipt of Centrelink benefits.  You justified using his money as a reflection of the financial contribution you had previously made to your relationship.  It is now accepted that this justification was misplaced.

41It has been submitted by your counsel that your conduct was opportunistic and relatively unsophisticated.  The circumstances of your offending and the number of transactions involved do not support this submission.  You set up the bank accounts and created unencumbered access to the victim’s inheritance without his knowledge.  You withdrew money 808 times, over a protracted period, for your own benefit.  You used the money as if it was your own.  You refused to provide the victim with the bank statements and pretended that you were always acting in his best interests.  You maintained a caring and loving facade, perpetuating and disguising your dishonesty.  You admit that through your continuous messaging, you were “stringing him along”.  You “drip fed” money to the victim, to avoid detection.  You also took consistent steps to deter others from learning of your access to Mr Peirce’s funds.

42You have pleaded guilty to a very serious offence.  I consider that your misconduct amounts to a significant breach of trust, which is an aggravating feature.  In light of your previous relationship, Mr Peirce relied on you to protect his money and navigate his spending along a sensible path.

43You had time to reflect on your offending throughout the period, yet chose to continue with it.  Your offending, therefore, involved a level of calculation, sophistication and persistence.  I consider that your moral culpability is high.

44A Victim Impact Statement dated 13 March 2021 has been prepared and read to the Court.  In that statement, Mr Peirce describes the long lasting emotional and mental stress that has occurred as a result of your conduct.  He suffers from depression, which has become more severe.  He was required to give evidence and was cross-examined at the committal.  In his statement he states:

“The stress of attending Court and having to speak in Court has been very distressing.  I’m worried about how I will present in Court because of my extreme nervousness.”

45Your conduct has resulted in Mr Peirce feeling “100% betrayed”.  He stated:

"I don’t feel like I can trust anyone new in my life and my mental health and physical health has been greatly affected.”

46It is difficult to assess the full extent of the impact of your conduct on Mr Peirce.  The betrayal of his trust is significant and was ongoing.  It must have been a great relief to him to have the money repaid.  I take the circumstances of the Victim Impact Statement into account.

47While it has not always been so, you have now taken responsibility for your offending conduct and have belatedly shown remorse.  You have written a brief letter of apology, dated 12 March 2021, to Mr Peirce, saying that you are very sorry for your conduct and cannot imagine the negative impact it has had.

48You have now repaid all of the money that you stole, which is a highly relevant consideration that is very much in your favour.  It has taken six months for your family and husband to make arrangements to enable you to do so.  While you have a solid work history, you have not worked for some time and will be unable to resume your previous employment.  Your husband has his own business which has been negatively impacted by the pandemic.  You are now required to repay the loans.  Your preparedness to make full restitution to the victim needs to be considered in the context that you are not in a strong financial position and it is consistent with your plea of guilty.  I take this into account in your favour.

49You have no criminal history, no subsequent criminal matters and no pending charges.  However, your prior good character must be given less weight in matters such as these, as you have pleaded guilty to a course of dishonest conduct.

50You are 52 years of age and have one adult son, with whom you maintain a close relationship.  You separated from his father when he was very young.  You worked tirelessly as a single parent, to provide for him.  He lived with you until he was 17 years of age, before moving to live with his father and he now lives with your parents.  As I mentioned earlier, you married Mr McLachlan in January 2016.  Your relationship is ongoing.  He remains supportive of you and has attended the court hearings with you.

51You are one of two children, born into a loving and supportive family.  Your history of development is unremarkable.  You grew up in the Dandenong area, completing high school and then attended the Dandenong College of TAFE.

52You have a strong work history, undertaking various forms of employment.  Over the past 26 years you have worked as a qualified aged care nurse, primarily working with people who suffer from dementia.  You have been unable to continue in this form of employment, due to the pending charges.  You were last in paid employment in 2017.

53You have no issues with drug or alcohol abuse, nor do you suffer from any mental health issues, other than a level of anxiety associated with the current proceedings.

54A number of references have been provided on your behalf, attesting to your previous good character:

(a)   Your mother writes that she and your father are “completely baffled” by your offending.  It has caused them “a lot of distress”.  You have always been a  caring family member who has enjoyed working with the disabled and the elderly.  In her view, this incident is completely out of character.  She believes that you have shown remorse for your conduct.

(b)   Your father confirms that you grew up in a supportive and loving family environment.  Your conduct has left your parents in “complete shock”.  To his knowledge, you were highly regarded in your employment when you worked with disabled adults and children over many years.  In his opinion, you have shown remorse for what has happened and you regret causing unnecessary suffering to Mr Peirce.

(c)   Your brother writes that you are apologetic and remorseful for your conduct.  Your previous character is an honest, trustworthy and reliable person who is reputable and likeable amongst family and friends.  I am told that he has refinanced his home and lent you $132,000, to enable you to repay Mr Peirce.

(d)   Your husband describes your character as overwhelmingly caring, which has shaped your career choice and your general attitude towards life.  You come from a close knit and supportive family, who are “mortified” by your conduct and the impact that it will have on your capacity to work as a nurse.  He, too, has been “shocked” by your conduct and your guilty plea.  He believes that you have shown genuine remorse for the impact your actions have had on Mr Peirce.  He has provided you with the balance of money required, to repay your debt to the victim.  He writes that you have always been a loving wife and acted with great integrity in your marriage.  He continues to maintain his support and love for you.

(e)   Two of your work colleagues have written references.  One has known you for approximately eight years.  In her opinion, you were always kind, caring, honest and reliable.  You had a strong work ethic and were a highly valued member of staff.  She describes that it came as a “complete shock” to learn of your dishonest conduct.  It is at odds with everything that she knows about you.  She believes that you are “incredibly remorseful” and that you will never repeat this kind of conduct.  The other has known you for around 15 years and describes you as previously having an exemplary character.  She, too, expresses a state of shock, grief and disbelief as to your serious offending.  You have previously been known to be an honest, caring and trustworthy colleague.

55I accept that the principles of general deterrence, denunciation and just punishment must assume significance in the sentencing mix.  The principle of specific deterrence remains of some relevance, in light of the number of dishonest transactions that occurred over a lengthy period.

56I consider that in light of your lack of prior history, the concept of rehabilitation remains a relevant consideration.  You have not committed any other criminal offences and are fortunate to have the ongoing and consistent support of your husband, family and friends.  Your work history is strong.  Although you will be precluded from resuming your employment as a nurse, you hope to find work once this case is finalized.  I am satisfied that your prospects are good.

57As a result of your offending, you have been the subject of some media interest.  A brief article that was published in the Herald Sun on 22 March 2021, described you as a “gold digger” who had “fleeced her former partner”.  It was submitted that the “gold digger” description has upset you, as the reason you had a relationship with the victim was not to access his money.  Further, it was submitted that this was unfair and that the adverse publicity has resulted in extra‑curial punishment, which is a mitigating factor.

58Any offender confronts the risk of publicity being part of the criminal process.  I consider that the reporting by the media was legitimately in the public interest.

59Further, I am not satisfied that the article is inaccurate.  You stole the victim’s money and used it as your own.  While I accept that the revelation of your offending may have added to the stress associated with these proceedings, I do not consider that it should result in a meaningful reduction of sentence.  Your public humiliation is a consequence of your grossly dishonest conduct.

60When considering the appropriate penalty in your case, I have regard to the evolving measures taken by Corrections to deal with the COVID‑19 pandemic which would add to your hardship as a prisoner, particularly as you have no criminal history.  You have not spent any time in custody before.

61Your counsel has submitted that a Community Correction Order with a significant number of hours of unpaid community work, would be appropriate and would satisfy all the relevant sentencing requirements.

62The prosecution position is that the only appropriate disposition is an immediate term of imprisonment, although it is conceded that a combination disposition is within range.

63An assessment for a Community Correction Order was conducted.  In a report dated 5 August 2021, the author indicated that you expressed remorse for your offending behaviour.  You accepted that there was no excuse for your misconduct.

64You did not present with any issues requiring treatment.  You are capable of performing unpaid community work and are prepared to do so.  You have been assessed as a low risk of reoffending and supervision has not been recommended.  You indicated that you are willing to comply with a corrections order and have been found suitable.

65I have considered the decision of Boulton v The Queen.[2]In particular:

[2][2014] 46 VR 308 at 338.

“a CCO may be suitable even in cases of relatively serious offences which might previously have attracted a medium term of imprisonment ... [and a Court] may find that, in view of the objective gravity of the conduct and the personal circumstances of the offender, a properly-conditioned CCO of lengthy duration is capable of satisfying the requirements of proportionality, parsimony and just punishment, while affording the best prospects for rehabilitation.”

66I take into account the maximum penalty for this offence.  I have broadly considered current sentencing practices and the case to which I was referred by your counsel.  I have endeavoured to tailor your sentence to ensure that it is proportionate to your overall criminal conduct.

67It is inevitable that a conviction be imposed in this case.  This is a form of punishment in itself, as it will preclude you from returning to your previous or similar types of employment in the future.

68The principle of parsimony requires that a sentence be no more severe than is necessary to achieve the purposes of sentencing, for which it is imposed.[3]  Ultimately, I am persuaded that an alternative to a custodial sentence is the appropriate outcome here.  You have avoided a term of imprisonment by the narrowest of margins.

69Balancing all factors as best I can, I intend to impose a Community Correction Order, with conviction, for a period of two years.

·        You are required to report to the Moorabbin Community Corrections office by telephone, within 48 hours.

·        You are to perform 350 hours of unpaid community work over a period of two years.

70The declaration I make under s 6AAA is,[4] had the matter not proceeded as a plea of guilty, I would have imposed a term of imprisonment of two and a half years, with a minimum of one year and nine months.

71The prosecution has applied for a forfeiture order under s 32(1) of the Confiscation Act, regarding the Peugeot vehicle that was seized by police.  It was purchased by you on 20 July 2016 for $27,125.

72There is no dispute that it can be categorised as tainted property.  The prosecution submission is that you should not be permitted to retain the vehicle, as it was purchased with the proceeds of your offending.

73The application is opposed.  It is submitted that you have incurred a substantial debt as a result of making restitution.  You are unable to return to your previous career, and your financial capacity is limited.

74Should the vehicle not be forfeited, you intend to transfer ownership of it to your brother as part of the loan repayment.  The vehicle is now valued at between $15−17,000.

75Section 33(5) of the Confiscation Act outlines the relevant considerations, including sub-s(b) any undue hardship that may reasonably be likely to be caused to any person by the order.

76In the exercise of my discretion, I consider that it would be unjust to forfeit the vehicle, given that you have made full restitution.

77Mr Bell, is you client prepared to comply with the corrections order?

78MR BELL:  Yes, Your Honour.

79HER HONOUR:  I will ask my associate then to print it out and she can step down from the dock and if you will just go through it with her please.  Thank you.

80MR BELL:  My client signed the order, Your Honour.

81HER HONOUR:  Thank you, I will adjourn the court.
