Director of Public Prosecutions (Consequential Provisions) Act 1990

No. 23 of 1990

An Act to make certain amendments consequent upon the making of the Director of Public Prosecutions Act 1990 and for related purposes

Short title

1.  This Act may be cited as the Director of Public Prosecutions (Consequential Provisions) Act 1990.

Commencement

2.  (1)  Section 1 and this section commence on the day on which this Act is notified in the Gazette.

(2)  The remaining provisions commence on a day, or respective days, fixed by the Attorney-General by notice in the Gazette.

Amendment of Acts

3.  The Acts specified in the Schedule are amended as set out in the Schedule.

Transitional

4.  Where immediately before 1 July 1990 the Commonwealth Director was—

(a)conducting general proceedings; or

(b)assisting a coroner in an inquest or inquiry;

on and after that date the Director shall continue to—

(c)conduct those proceedings; or

(d)assist the coroner in that inquest or inquiry.

(2)  In subsection (1), “Commonwealth Director”, “Director” and “general proceedings” have the same meanings respectively as in the Director of Public Prosecutions Act 1990.

After subparagraph 10 (1) (a) (ix) insert the following subparagraph:

“(ixa)  the Director of Public Prosecutions;”.

Maintenance Act 1968

Omit subsection 117 (2).

National Exhibition Centre Trust Act 1976

Omit subsection 28 (3).

Police Offences Act 1930

Repeal section 19B.

Public Health Act 1928

Repeal section 11.

Registration of Births, Deaths

and  Marriages Act 1963

Omit subsection 57 (5).
