Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Director of Public Prosecutions Act 1986.

Explanatory note
The objects of this Regulation are as follows:

(a) to update a reference to an officer holder of NSW Police in the new form of disclosure certificate that is required to be given by police and other law enforcement officers to the Director of Public Prosecutions,
(b) to clarify that the disclosure certificate must be signed by a superior officer as well as the officer making the disclosure.

This Regulation is made under the Director of Public Prosecutions Act 1986, including sections 15A and 37 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Director of Public Prosecutions Amendment
(Disclosure Certificate) Regulation 2012.

2      Commencement

This Regulation commences on 1 January 2013 and is required to be published on the NSW legislation website.

3 Amendment of Director of Public Prosecutions Regulation 2010

(1) Schedule 1 Disclosure certificate (for prosecutions and advisings) (as
substituted by the Director of Public Prosecutions Amendment
(Disclosures) Act 2012)

Omit “General Manager, Court and Legal Services” from the matter under the heading “Acknowledgement”.

Insert instead “Manager, Information Access and Subpoena Unit”.

(2) Schedule 1
Omit “should be signed” wherever occurring in the matter under the heading “Received and noted by superior officer”.
Insert instead “must be signed”.
