Part 1—Preliminary

1—Short title

These regulations may be cited as the Development (Public Notification) Variation Regulations 2019.

2—Commencement

These regulations come into operation on the day on which they are made.

3—Variation provisions

In these regulations, a provision under a heading referring to the variation of specified regulations varies the regulations so specified.

Part 2—Variation of Development Regulations 2008

4—Variation of Schedule 9—Public notice categories

  1. Schedule 9, clause 18(a)—delete "a building" and substitute:

    1 or more buildings

  2. Schedule 9, clause 18(c)—delete paragraph (c)

  3. Schedule 9, clause 19—delete clause 19 and substitute:

    19Except where the development falls within Part 1 of this Schedule, is within the City of Adelaide, or is classified as non‑complying development under the relevant Development Plan, development of a kind referred to in clause 6 of this Schedule (including a change of use of land of a kind referred to in that clause) where the site of the proposed development is adjacent land to land in a zone under the relevant Development Plan which is different to the zone that applies to the site of the development.

As required by section 10AA(2) of the Subordinate Legislation Act 1978, the Minister has certified that, in the Minister's opinion, it is necessary or appropriate that these regulations come into operation as set out in these regulations.
