Part 1              Preliminary

  1. Name of Determination

This Determination is the Determination to Reduce Departmental and Administered Appropriations in Previous Appropriation Acts (No. 1 of 2009-2010).

  1. Commencement

This Determination commences on the day after registration on the Federal Register of Legislative Instruments.

3              Purpose

The purpose of this Determination is to reduce departmental and administered appropriations previously appropriated by the Parliament, in relation to the depreciation and make good amount that has not yet been applied by each of the specified agencies.

Note 1    This Determination contains two schedules:  Schedule 1 reduces various departmental and administered appropriations of specified agencies; and Schedule 2 reduces certain departmental appropriations of the parliamentary departments.

  1. Legislative Authority

Subsection 14(1) of the Appropriation Act (No. 3) 2009-2010 and subsection 18(1) of the Appropriation Act (No. 4) 2009‑2010 enable the Minister for Finance and Deregulation (Finance Minister) to determine, by writing, that a departmental item or an administered item for an agency in a previous appropriation Act is reduced by the amount specified in the written determination.

Note: Subsection 14(4) of the Appropriation Act (No. 3) 2009-2010 and subsection 18(4) of the Appropriation Act (No. 4) 2009‑2010, provide that a determination made under subsections 14(1) or 18(1) is a legislative instrument that is subject to disallowance under section 42 of the Legislative Instruments Act 2003, but not subject to sunsetting under Part 6, of the Legislative Instruments Act 2003.

5              Reductions in departmental and administered items by the Legislative Authority of Appropriation Act (No. 3) 2009‑2010

Schedule 1 reduces the specified departmental and administered items of the specified agencies appropriated in previous appropriation Acts amounting to a total of $512,616,399.31 of appropriated public money.

Note 1    Schedule 1 lists the agencies to which the Determination applies. The agencies are grouped by portfolio and are listed alphabetically within the portfolio with the Department of State listed first (where relevant), using the portfolio name and agency name as at the date of the registration of this Determination on the Federal Register of Legislative Instruments. Each portfolio table names the relevant agency within the portfolio (column 1), the relevant appropriation item to be reduced (column 2), the legislative authority relied upon to effect the reduction (column 3) and the amount by which the appropriation item is reduced (column 4).

Note 2    In the table in Schedule 1 some appropriation items (column 2) refer to different agencies than the agency name (column 1). These differences reflect the fact that functions and associated appropriations have been transferred between agencies since the item was appropriated. Functions of an agency (the transferring agency) may be transferred to another agency (the new agency) for various reasons. Where agency functions are transferred, section 32 of the Financial Management and Accountability Act 1997 enables the Finance Minister to make a determination to permit the new agency to access the appropriations related to the transferred function.  Prior to 25 September 2007, section 32 determinations only permitted the new agency to access the departmental appropriation of the transferring agency.  On 25 September 2007, section 32 of the FMA Act was amended to enable the determinations of the Finance Minister to transfer departmental appropriations between agencies.  Accordingly, in Schedule 1:

·reductions to departmental appropriations that were subject to a section 32 determination made before 25 September 2007, reduce appropriations of the transferring agency; and

·reductions to departmental appropriations that were subject to a section 32 determination made on or after 25 September 2007, reduce appropriations of the new agency.

Notes have been included in Schedule 1 to identify reductions to departmental appropriations that have been subject to a section 32 determination made before 25 September 2007. Historical consolidations of the Administrative Arrangements Order also assist in understanding changes that have occurred to functions, agencies and portfolios.

6              Reduction in departmental and administered items under the Legislative Authority of Appropriation Act (No. 4) 2009-2010

Schedule 2 reduces the specified departmental items of certain Parliamentary Departments appropriated in previous appropriation Acts.
