Determination to Reduce Appropriations Upon Request (No. 5 of 2011-2012)

I, Penelope Ying Yen Wong, Minister for Finance and Deregulation, make this Determination under:
· subsection 13(2) of Appropriation Act (No. 2) 2009-2010; and
· subsection 10(2) of Appropriation Act (No. 1) 2010-2011.

Part 1 Preliminary
1 Name
This Determination is the Determination to Reduce Appropriations Upon Request (No. 5 of 2011-2012).
2 Commencement
This Determination commences on the day on which it is made.
3 Legislative Authority
(1) Subsection 13(2) of Appropriation Act (No. 2) 2009-2010 enables the Minister for Finance and Deregulation to make a written determination reducing the other departmental item (Equity Injections) for an agency by the amount specified in the Determination, upon receipt of a written request from the Minister responsible for that agency.
(2) Subsection 10(2) of Appropriation Act (No. 1) 2010-2011 enables the Minister for Finance and Deregulation to make a written determination reducing the departmental item for an agency by the amount specified in the Determination, upon receipt of a written request from the Minister responsible for that agency.
(3) The reduction provisions are included in the annual Appropriation Acts to enable excess departmental appropriation items, administered assets and liabilities items, and other departmental items to be extinguished.
4 Purpose
This Determination reduces the appropriation item for the agency listed in the Schedule by the amount indicated in Column 4.
5 Notes
The Schedule contains a table listing the affected agency in column 1, the Appropriation Act and appropriation item in column 2, which through the request by the responsible Minister in column 3, is reduced by the amount in column 4.
6 Disallowance
This determination is a Legislative Instrument and is disallowable.
7 Reduction in Appropriation Act (No. 2) 2009-2010
Schedule 1 reduces the other departmental item (Equity Injections) for the former Medicare Australia in Appropriation Act (No. 2) 2009-2010.
8 Reduction in Appropriation Act (No. 1) 2010-2011
Schedule 2 reduces the departmental item for the former Medicare Australia in Appropriation Act (No. 1) 2010-2011.

Note 2: The Human Services Legislation Amendment Act 2011 integrated the services of Medicare Australia, Centrelink and CRS Australia into the Department of Human Services (DHS) on 1 July 2011. The transitional provisions in that Act ensured that any of Medicare Australia’s annual appropriations from 2010-2011 or earlier shifted to DHS on 1 July 2011.
