I, Penelope Ying Yen Wong, Minister for Finance and Deregulation, make this Determination under the following provisions:

  • subsection 9(1) of Appropriation Act (No. 1) 2005‑2006; and

  • subsection 10(2) of Appropriation Act (No. 1) 2008‑2009.

Part 1              Preliminary

  1. Name

This Determination is the Determination to Reduce Appropriations Upon Request (No. 3 of 2010-2011).

  1. Commencement

This Determination commences on the day on which it is made.

  1. Legislative Authority

(1) Subsection 9(1) of Appropriation Act (No. 1) 2005-2006 and subsection 10(2) of Appropriation Act (No. 1) 2008-2009 enable the Minister for Finance and Deregulation to make a determination reducing a departmental item for an agency by the amount specified in the Determination, upon receipt of a written request from the Minister responsible for that agency.

(2)   The reduction provisions are included in the annual Appropriation Acts to enable excess departmental appropriation items, administered assets and liabilities items, and other departmental items to be extinguished.

4              Purpose

This Determination reduces the appropriation items for the agency listed in the Schedules by the amount indicated in Column 4 of each item.

5              Notes

(1)    The Schedules contain tables listing the affected agency in column 1, the Appropriation Acts and appropriation items in column 2, which through the request by the responsible Ministers in column 3, are reduced by the amounts in column 4.

(2)   This Determination reflects agency and portfolio names contained in the Appropriation Acts under which reductions are made, noting that these may have subsequently been changed by, for example, machinery of government changes. A Schedule to this Determination lists the agency to which it applies.

6              Disallowance

Determinations made under:

·subsection 9(1) of Appropriation Act (No. 1) 2005‑2006; and

·subsection 10(2) of Appropriation Act (No. 1) 2008‑2009.

are legislative instruments and are disallowable.

7              Reductions in Appropriation Act (No. 1) 2005-2006

Schedule 1 reduces the appropriation for the former Department of the Environment and Heritage for the departmental item appropriated by Appropriation Act (No. 1) 2005-2006.

8              Reductions in Appropriation Act (No. 1) 2008-2009

Schedule 2 reduces the appropriation for the former Department of the Environment, Water, Heritage and the Arts for the departmental item appropriated by Appropriation Act (No. 1) 2008-2009.

On 14 September 2010, the AAO restructured the portfolio responsibilities of the department, and from that date, the department commenced using its current name.
