Determination to Reduce Appropriations Upon Request (No. 20 of 2010-2011)
Annual Appropriation Acts
I, Penelope Ying Yen Wong, Minister for Finance and Deregulation, make this Determination under the following provisions:
Subsection 9(1) of Appropriation Act (No. 1) 2006-2007;
subsection 11(1) of Appropriation Act (No. 4) 2006-2007;
subsection 9(1) of Appropriation Act (No. 1) 2007-2008;
subsection 11(1) of Appropriation Act (No. 2) 2007-2008;
subsection 10(2) of Appropriation Act (No. 1) 2008-2009;
subsection 10(2) of Appropriation Act (No. 1) 2009-2010;
subsection 13(2) of Appropriation Act (No. 2) 2009-2010;
subsection 10(2) of Appropriation Act (No. 1) 2010-2011;
subsection 12(2) of Appropriation Act (No. 1) 2010-2011;
subsection 13(2) of Appropriation Act (No. 2) 2010-2011; and
subsection 10(2) of Appropriation Act (No. 3) 2010-2011;

Part 1 Preliminary
1 Name
This Determination is the Determination to Reduce Appropriations Upon Request (No. 20 of 2010-2011).
2 Commencement
This Determination commences on the day on which it is made.
3 Legislative Authority
(1) Subsection 9(1) of Appropriation Act (No. 1) 2006-2007; Subsection 9(1) of Appropriation Act (No. 1) 2007-2008; subsection 10(2) of Appropriation Act (No. 1) 2008-2009; subsection 10(2) of Appropriation Act (No. 1) 2009-2010; subsection 10(2) of Appropriation Act (No. 1) 2010-2011, and subsection 10(2) Appropriation Act (No. 3) 2010-2011 enable the Minister for Finance and Deregulation to make a written determination reducing a departmental item for an agency by the amount specified in the Determination, upon receipt of a written request from the Minister responsible for that agency.
(2) Subsection 11(1) of Appropriation Act (No. 4) 2006-2007 and subsection 11(1) of Appropriation Act (No. 2) 2007-2008 enable the Minister for Finance and Deregulation to make a written determination reducing administered assets and liabilities items and other departmental items for an agency by the amount specified in the Determination, upon receipt of a written request from the Minister responsible for that agency.
(3) Subsection 12(2) of Appropriation Act (No. 1) 2010-2011 enables the Minister for Finance and Deregulation to make a written determination reducing a CAC Act Body payment item for an agency by the amount specified in the Determination, upon receipt of a written request from the Minister responsible for that agency.
(4) Subsection 13(2) of Appropriation Act (No. 2) 2009-2010 enables the Minister for Finance and Deregulation to make a written determination reducing other departmental item (Previous Years’ Outputs) for an agency by the amount specified in the Determination, upon receipt of a written request from the Minister responsible for that agency.
(5) Subsection 13(2) of Appropriation Act (No. 2) 2010-2011 enables the Minister for Finance and Deregulation to make a written determination reducing administered assets and liabilities items and other departmental item (Equity Injections) for an agency by the amount specified in the Determination, upon receipt of a written request from the Minister responsible for that agency.
(6) The reduction provisions are included in the annual Appropriation Acts to enable excess departmental appropriation items, administered assets and liabilities items, other departmental items and CAC Act Body payment items to be extinguished.
4 Purpose
This Determination reduces the appropriation item for the agency listed in the Schedule by the amount indicated in Column 4.
5 Notes
Each Schedule contains a table listing the affected agencies in column 1, the Appropriation Act and appropriation item in column 2, which through the request by the responsible Minister in column 3, is reduced by the amount in column 4.
6 Disallowance
This determination is a Legislative Instrument and is disallowable.
