Annual Appropriation Acts

I, Lindsay Tanner, Minister for Finance and Deregulation, make this Instrument under the following provisions:

  • subsection 9(1) of Appropriation Act (No. 1) 2006‑2007;

  • subsection 9(1) of Appropriation Act (No. 1) 2007‑2008;

  • subsection 10(2) and subsection 12(2) of Appropriation Act (No. 1) 2008‑2009;

  • subsection 10(2) and subsection 12(2) of Appropriation Act (No. 1) 2009‑2010;

  • subsection 10(2) of Appropriation Act (No. 3) 2009‑2010;

  • subsection 13(2) of Appropriation Act (No. 2) 2008‑2009;

  • subsection 13(2) of Appropriation Act (No. 4) 2008‑2009; and

  • subsection 13(2) of Appropriation Act (No. 2) 2009‑2010.

Part 1              Preliminary

  1. Name

This Determination is the Determination to Reduce Appropriations Upon Request (No. 11 of 2009-2010).

  1. Commencement

This Determination commences on the day on which it is made.

  1. Legislative Authority

(1) Subsection 9(1) of Appropriation Act (No. 1) 2006-2007; subsection 9(1) of Appropriation Act (No. 1) 2007-2008; subsection 10(2) of Appropriation Act (No. 1) 2008-2009; subsection 10(2) of Appropriation Act (No. 1) 2009‑2010; and subsection 10(2) of Appropriation Act (No. 3) 2009‑2010, enable the Minister for Finance and Deregulation to make a determination reducing a departmental item for an agency by the amount specified in the Determination, upon receipt of a written request from the Minister responsible for that agency.

(2) Subsection 12(2) of Appropriation Act (No. 1) 2008-2009 and subsection 12(2) of Appropriation Act (No. 1) 2009‑2010, enable the Minister for Finance and Deregulation to make a determination reducing a CAC Act body payment item for an agency by the amount specified in the Determination, upon receipt of a written request from the Minister responsible for that agency.

(3) Subsection 13(2) of Appropriation Act (No. 2) 2008-2009; subsection 13(2) of Appropriation Act (No. 4) 2008-2009; and subsection 13(2) of Appropriation Act (No. 2) 2009‑2010, enable the Minister for Finance and Deregulation to make a determination reducing administered assets and liabilities items and other departmental items for an agency by the amount specified in the Determination, upon receipt of a written request from the Minister responsible for that agency.

(4)   The reduction provisions are included in the annual Appropriation Acts to enable excess departmental appropriation items, administered assets and liabilities items, and other departmental items to be extinguished.

4              Purpose

This Determination reduces the appropriation items for the agencies listed in the Schedules by the amount indicated in Column 5 of each item.

5              Notes

(1)    The Schedules contain tables listing the affected agencies in column 1, the appropriation Acts and appropriation items in column 2, the legislative authorities in column 3, which through the request by the responsible Ministers in column 4, are reduced by the amounts in column 5.

(2)   This Determination reflects agency and portfolio names contained in the appropriation Acts under which reductions are made, noting that these may have subsequently been changed by, for example, machinery of government changes. A Schedule to this Determination lists each agency to which it applies. The agencies are listed alphabetically, by portfolio.

6              Disallowance

Determinations made under:

·subsection 9(1) of Appropriation Act (No. 1) 2006‑2007;

·subsection 9(1) of Appropriation Act (No. 1) 2007‑2008;

·subsection 10(2) and subsection 12(2) of Appropriation Act (No. 1) 2008‑2009;

·subsection 10(2) and subsection 12(2) of Appropriation Act (No. 1) 2009‑2010;

·subsection 10(2) of Appropriation Act (No. 3) 2009‑2010;

·subsection 13(2) of Appropriation Act (No. 2) 2008‑2009;

·subsection 13(2) of Appropriation Act (No. 4) 2008‑2009; and

·subsection 13(2) of Appropriation Act (No. 2) 2009‑2010;

are legislative instruments and are disallowable.

7              Reductions in Appropriation Act (No. 1) 2006-2007

Schedule 1 reduces the appropriation for the Office of the Director of Public Prosecutions for the departmental item appropriated by Appropriation Act (No. 1) 2006-2007.

8              Reductions in Appropriation Act (No. 1) 2007-2008

Schedule 2 reduces the appropriation for the Attorney-General’s Department for the departmental item appropriated by Appropriation Act (No. 1) 2007-2008.

9              Reductions in Appropriation Act (No. 1) 2008-2009

Schedule 3 reduces appropriations for agencies for the departmental item and CAC Act body payment item appropriated by Appropriation Act (No. 1) 2008-2009.

10            Reductions in Appropriation Act (No. 1) 2009-2010

Schedule 4 reduces appropriations for agencies for the departmental item and CAC Act body payment item appropriated by Appropriation Act (No. 1) 2009-2010.

11            Reductions in Appropriation Act (No. 3) 2009-2010

Schedule 5 reduces the appropriation for the Department of Defence for the departmental item appropriated by Appropriation Act (No. 3) 2009-2010.
