Determination to Reduce Appropriations Upon Request (No. 1 of 2012-2013)

Annual Appropriation Acts

I, Penelope Ying Yen Wong, Minister for Finance and Deregulation, make this Determination under the following provisions:

• Subsection 10(2) of Appropriation Act (No. 1) 2009-2010; and

• subsection 13(2) of Appropriation Act (No. 2) 2009-2010.

Part 1              Preliminary

1. Name

This Determination is the Determination to Reduce Appropriations Upon Request (No. 1 of 2012-2013).

1. Commencement

This Determination commences on the day on which it is made.

1. Legislative Authority

(1)Subsection 10(2) of Appropriation Act (No. 1) 2009-2010 enables the Minister for Finance and Deregulation to make a written Determination reducing a departmental item for an agency by the amount specified in the Determination, upon receipt of a written request from the Minister responsible for that agency.

(2)Subsection 13(2) of Appropriation Act (No. 2) 2009-2010 enables the Minister for Finance and Deregulation to make a written Determination reducing the other departmental item (Equity Injections) for an agency by the amount specified in the Determination, upon receipt of a written request from the Minister responsible for that agency.

(3)The reduction provisions are included in the annual Appropriation Acts to enable excess departmental appropriation items, administered assets and liabilities items, other departmental items and CAC Act Body payment items to be extinguished.

1. Purpose

This Determination reduces the appropriation item for the agency listed in the Schedule by the amount indicated in Column 4.

The Schedule contains a table listing the affected agency in column 1, the Appropriation Act and appropriation item in column 2, which through the request by the responsible Minister in column 3, is reduced by the amount in column 4.

1. Disallowance

This Determination is a Legislative Instrument and is disallowable.

1. Reduction in Appropriation Act (No. 1) 2009-2010

Schedule 1 reduces the departmental item for the Australian Security Intelligence Organisation in Appropriation Act (No. 1) 2009-2010.

Schedule 12 reduces the other departmental item (Equity Injections) for the Australian Security Intelligence Organisation in Appropriation Act (No. 2) 2009‑2010.
