Annual Appropriation Acts

I, Penelope Ying Yen Wong, Minister for Finance and Deregulation, make this Determination under the following provisions:

  • subsection 11(2) of Appropriation Act (No. 1) 2008-2009;

  • subsection 11(2) of Appropriation Act (No. 1) 2009-2010;

  • subsection 11(2) of Appropriation Act (No. 3) 2009-2010;

  • subsection 11(2) of Appropriation Act (No. 1) 2010-2011;

  • subsection 13(2) of Appropriation Act (No. 2) 2010-2011;

  • subsection 10(2) of Appropriation Act (No. 1) 2011-2012; and

  • subsection 10(2) of Appropriation Act (No. 1) 2012-2013.

Part 1                  Preliminary

  1. Name

This Determination is the Determination to Reduce Appropriations (No. 3 of 2012‑2013).

  1. Commencement

This Determination commences on the day on which it is registered.

  1. Legislative authority

(1)For subsection 11(2) of:

-     Appropriation Act (No. 1) 2008‑2009;

-     Appropriation Act (No. 1) 2009‑2010;

-     Appropriation Act (No. 3) 2009‑2010; and

-     Appropriation Act (No. 1) 2010‑2011,

Schedules 1 to 4 determine amounts that are taken to be the required amounts for the purposes of subsection 11(1) of those Acts and the administered items specified in those Schedules.

(2)For subsection 13(2) of Appropriation Act (No. 2) 2010‑2011, Schedule 5 determines an amount by which the administered assets and liabilities item specified in that Schedule is to be reduced.

(3)For subsection 10(2) of:

-      Appropriation Act (No. 1) 2011‑2012; and

-     Appropriation Act (No. 1) 2012‑2013,

Schedules 6 and 7 determine amounts by which the departmental items specified in those Schedules are to be reduced.

  1. Purpose

Schedules 1 to 4 of this Determination reduce administered items for the relevant agency by the amount indicated in column 5. The required amount in column 4 for the administered items can apply as if it is the amount specified in the relevant agency’s annual report.

Schedule 5 to this Determination reduces the administered assets and liabilities item for the relevant agency by the amount indicated in column 4.

Schedules 6 and 7 of this Determination reduce departmental items for the relevant agency by the amount indicated in column 4.

  1. Disallowance

This Determination is a Legislative Instrument and is disallowable.

Note      Section 42 (disallowance) of the Legislative Instruments Act applies to this Determination (despite subsection 44(2) of that Act which exempts certain legislative instruments from disallowance). However, Part 6 (sunsetting) of the Legislative Instruments Act 2003 does not apply to this Determination.
