Determination to Reduce Appropriations (No. 1 of 2011-2012)

Annual Appropriation Acts

I, Penelope Ying Yen Wong, Minister for Finance and Deregulation, make this Determination under the following provisions:

  • Subsection 11(1) of Appropriation Act (No. 2) 2004-2005;

  • subsection 8(1) of Appropriation Act (No. 1) 2005-2006;

  • subsection 11(1) of Appropriation Act (No. 2) 2006-2007;

  • subsection 11(1) of Appropriation Act (No. 4) 2006-2007;

  • subsection 8(1) and subsection 9(1) of Appropriation Act (No. 1) 2007-2008;

  • subsection 11(1) of Appropriation Act (No. 2) 2007-2008;

  • subsection 10(2), subsection 11(2) and subsection 12(2) of Appropriation Act (No. 1) 2008-2009;

  • subsection 13(2) of Appropriation Act (No. 2) 2008-2009;

  • subsection 13(2) of Appropriation Act (No. 4) 2008-2009;

Part 1              Preliminary

  1. Name

This Determination is the Determination to Reduce Appropriations (No. 1 of 2011-2012).

  1. Commencement

This Determination commences on the day on which it is made.

  1. Legislative Authority

(1)Subsection 11(1) of Appropriation Act (No. 2) 2004-2005; subsection 11(1) of Appropriation Act (No. 2) 2006-2007; subsection 11(1) of Appropriation Act (No. 4) 2006-2007; subsection 11(1) of Appropriation Act (No. 2) 2007-2008; subsection 13(2) of Appropriation Act (No. 2) 2008-2009; subsection 13(2) of Appropriation Act (No. 4) 2008-2009; subsection 13(2) of Appropriation Act (No. 2) 2009-2010; and subsection 13(2) of Appropriation Act (No. 2) 2010-2011 enable the Minister for Finance and Deregulation to make a written determination reducing administered assets and liabilities items and other departmental items (Equity Injections and Previous Years’ Outputs) for an agency by the amount specified in the Determination, upon receipt of a written request from the Minister responsible for that agency.

(2)Subsection 12(2) of Appropriation Act (No. 1) 2008-2009; and subsection 12(2) of Appropriation Act (No. 3) 2009-2010 enable the Minister for Finance and Deregulation to make a written determination reducing a CAC Act Body payment item for an agency by the amount specified in the Determination, upon receipt of a written request from the Minister responsible for that agency.

(3)Subsection 9(1) of Appropriation Act (No. 1) 2007-2008; subsection 10(2) of Appropriation Act (No. 1) 2008-2009; subsection 10(2) of Appropriation Act (No. 1) 2009-2010; subsection 10(2) of Appropriation Act (No. 1) 2010-2011; subsection 10(2) of Appropriation Act (No. 1) 2011-2012; and subsection 10(2) Appropriation Act (No. 3) 2011-2012 enable the Minister for Finance and Deregulation to make a written determination reducing a departmental item for an agency by the amount specified in the Determination, upon receipt of a written request from the Minister responsible for that agency.

(4)The reduction provisions are included in the annual Appropriation Acts to enable excess departmental appropriation items, administered assets and liabilities items, other departmental items and CAC Act Body payment items to be extinguished.

(5)Subsection 8(1) of Appropriation Act (No. 1) 2005-2006; and subsection 8(1) of Appropriation Act (No. 1) 2007-2008 enable the Finance Minister to determine an amount having regard to the expenses incurred by the entity in the current year in relation to the administered item. The provisions were included in the Annual Appropriations Acts to allow the Finance Minister to issue out of the Consolidated Revenue Fund amounts that do not exceed, in total, the lesser of the amount specified in the item and the amount determined by the Finance Minister in relation to the item.

(6)Subsection 11(2) of Appropriation Act (No. 1) 2008-2009; and subsection 11(2) of Appropriation Act (No. 1) 2009-2010 enable the Minister for Finance and Deregulation (Finance Minister) to make a determination reducing an administered item, or a State, ACT, NT and local government item, for an agency to the required amount specified in the determination. The provisions were included in the Annual Appropriation Acts to allow the Finance Minister to determine that a required amount published in the annual report of an agency is taken to be the required amount specified in the determination. The power in subsection 11(2) is to ensure that the amount published in an agency annual report for the administered item or the State, ACT, NT and local government item can be changed, if, for example, the amount is erroneous or requires updating after agency annual reports are published.

  1. Purpose

Schedules in this Determination reduce the administered appropriation item for the agency listed in those Schedules by the amount indicated in Column 5. The required amount in column 4 for these administered items applies as if it is the amount specified in the relevant agency annual report or in the case of Appropriation Act (No. 1) 2008-2009, Appropriation Act (No. 1) 2009-2010, and Appropriation Act (No. 1) 2010-2011, the total accrued administered expenses of the agency.

Schedules in this Determination also reduce the appropriation item for the agency listed in those Schedules by the amount indicated in Column 4 for all other appropriation items (departmental, other departmental (Equity Injections and Previous Years’ Outputs), administered assets and liabilities, and CAC Act Body payment items).

  1. Notes

   The Schedules contain tables for administered appropriation items listing the relevant agency, appropriation item and outcome number contained in the relevant annual Appropriation Act in column 1, the legislative authority in column 2, the amount appropriated by determination or annual report for the appropriation item in column 3, the new amount required by the agency for that appropriation item in column 4, and the amount reduced in column 5.

For the administered appropriation item under subsection 8(1)(b) of Appropriation Act (No. 1) 2005-2006, and subsection 8(1)(b) of Appropriation Act (No. 1) 2007-2008, the amount required by the agency in column 5 is the amount that is taken to be the specified amount required for the appropriation item for the purposes of the total accrued administered expenses.

For the administered appropriation item under subsection 11(2)(b) of Appropriation Act (No. 1) 2008-2009, subsection 11(2)(b) of Appropriation Act (No. 1) 2009-2010, and subsection 11(2)(b) of Appropriation Act (No. 1) 2010-2011, the amount required by the agency in column 5 is the amount that is taken to be the specified amount required for the appropriation item for the purposes of the agency’s annual report.

The Schedules contain tables for all other appropriation items (departmental, other departmental (Equity Injections and Previous Years’ Outputs), administered assets and liabilities, and CAC Act Body payment items) listing the affected agencies in column 1, the Appropriation Act and appropriation item in column 2, which through the request by the responsible Minister in column 3, is reduced by the amount in column 4.

Note 1: The amount of an appropriation item for an agency may also include adjustments to that amount made under the adjustment provisions contained in the Annual Appropriation Acts and under section 32 of the Financial Management and Accountability Act 1997. Adjustments made under these provisions may increase the amount of an item when compared with the Schedules of the Annual Appropriation Acts.

  1. Disallowance

This determination is a Legislative Instrument and is disallowable.
