Part 1 - Interpretation

  1. Name of Determination

This Determination is the Determination Relating to the Nomination of Persons for Appointment as Members of the Medical Training Review Panel No. 1 of 2010.

  1. Commencement

This Determination commences on the day the Minister makes this Determination.

  1. Definitions

For the purposes of this Determination:

Department means the Department of Health and Ageing.

in writing includes by facsimile or e-mail.

MTRP organisation means an organisation listed in the Schedule.

nominated acting membership position means an acting membership position in an MTRP organisation nominated by that MTRP organisation in accordance with subsection 4(2).

nominated primary membership position means a primary membership position in an MTRP organisation nominated by that MTRP organisation in accordance with subsection 4(1).

Panel means the Medical Training Review Panel.

Part 2 - Nomination of members to the Panel

  1. Nomination of positions

(1)    An MTRP organisation may nominate in writing to the Department the number of primary membership positions in that organisation shown in column 2 of the Schedule.

(2)    An MTRP organisation may nominate in writing to the Department the number of acting membership positions in that organisation shown in column 2 of the Schedule.

(3)    A membership position nominated pursuant to subsection (1) or (2) may be a position occupied by more than one person.

Note: For example, a nominated primary or acting membership position may be “Member of the Board of Education”.

(4)    An MTRP organisation may decide in such a manner as it thinks fit how a nominated primary membership position or nominated acting membership position is created or designated.

(5)    An MTRP organisation may revoke a nomination of a position, or nominate a different position, by informing the Department in writing.

(6)    If, in the period from 1 November 2008 to the date of this Determination, an MTRP organisation has informed the Department in writing of a position in that organisation, the occupant of which the MTRP organisation wishes to be either a primary member or acting member of the Panel, that communication is considered to be a nomination of that position for the purposes of this Determination.

(7)    The Department may specify by writing a postal address or an e-mail address to which nominations of positions must be sent.

  1. Notification of occupants of position

(1)    An MTRP organisation may notify to the Department, in writing, a person who is the occupant of a nominated primary membership position in that organisation.

(2)    An MTRP organisation may notify to the Department, in writing, a person who is the occupant of a nominated acting membership position in that organisation.

(3)    The number of persons notified by an MTRP organisation pursuant to subsection (1) must not be more than the number in column 2 of the Schedule corresponding to that organisation.

(4)    The number of persons notified by an MTRP organisation pursuant to subsection (2) must not be more than the number in column 2 of the Schedule corresponding to that organisation.

(5)    An MTRP organisation may decide in such a manner as it thinks fit how a person becomes the occupant of a nominated position or nominated acting position, or ceases to be the occupant of a nominated primary position or nominated acting position.

(6)    An MTRP organisation may revoke a notification of a primary person or acting person, or nominate instead a different primary person or acting person, in writing.

(7)    If, in the period from 1 November 2008 to the date of this determination, an MTRP organisation has informed the Department in writing of a person who occupies a position in that organisation, the occupant of which the MTRP organisation wishes to be either a primary member or acting member of the Panel, that communication shall be deemed to be a valid notification of the person for the purposes of this determination.

(8)    The Chairperson may specify by writing an address or e-mail address to which notifications of persons must be sent.

  1. Revocation of previous determinations

This determination revokes all previous determinations made under paragraph 3GC(3)(b) of the Act.

  1. Cessation of Determination

This determination shall cease to have effect on 30 June 2016.
