COMMONWEALTH LINE DAILY FISHING LOG

I, Geoff Richardson, Acting Executive Manager Fisheries, acting as a delegate of the Australian Fisheries Management Authority, make the following Determination under subsection 42(1) of the Fisheries Management Act 1991.

Citation

1.This Determination may be cited as Determination No. LN01A.

Commencement

2.This Determination commences on the day after it is registered on the Federal Register of Legislative Instruments.

Interpretation

3.In this Determination:

“Southern and Eastern Scalefish and Shark Fishery” means all commercial fishing under a concession for the Southern and Eastern Scalefish and Shark Fishery in the sectors defined in Schedule 1 Part 2 (1) and (2) of the Southern and Eastern Scalefish and Shark Fishery Management Plan 2003.

“Eastern Tuna and Billfish Fishery” means all commercial fishing under a concession for the Eastern Tuna and Billfish Fishery in the area defined in Parts 1, 2 and 3 of Schedule 1 of the Eastern Tuna and Billfish Fishery Management Plan 2005. 

“Western Tuna and Billfish Fishery” means all commercial fishing under a concession for the Western Tuna and Billfish Fishery in the area defined in Parts 1, 2 and 3 of Schedule 1 of the Western Tuna and Billfish Fishery Management Plan 2005.

“Coral Sea Fishery” means all commercial fishing under a concession for the Coral Sea Fishery in the area defined in Part 2 of Schedule 1A of the Fisheries Management Regulations 1992.

“Eastern Skipjack Fishery” means all commercial fishing under a concession for the Eastern Skipjack Fishery in the area defined in Division 1 of Part 2B of Schedule 1A of the Fisheries Management Regulations 1992.

“Western Skipjack Fishery” means all commercial fishing under a concession for the Western Skipjack Fishery in the area defined in Divisions 1, 2 and 3 of Part 12A of Schedule 1A of the Fisheries Management Regulations 1992.

“Norfolk Island Offshore Demersal Finfish Fishery” means all commercial fishing under a concession for the Norfolk Island Offshore Demersal Finfish Fishery in the area defined in Part 5A of Schedule 1A of the Fisheries Management Regulations 1992.

“High Seas” means all commercial fishing by Australian flagged boats fishing under an Australian Commonwealth issued fishing permits for the High Seas within the area specified on the concession.

[Note: Terms defined in the Fisheries Management Act 1991 have the same meanings in this Determination.]

Determination

4.Subject to paragraph 6, the log book known as LN01A (at Attachment A) is the form and content of the log book to be kept and maintained by holders of line fishing concessions in the Southern and Eastern Scalefish and Shark Fishery, Eastern Tuna and Billfish Fishery, Western Tuna and Billfish Fishery, Coral Sea Fishery, Eastern SkipJack Fishery, Western Skipjack Fishery, and Norfolk Island Offshore Demersal Finfish Fishery in accordance with the conditions of their fishing concessions and s42 Fisheries Management Act 1991.

5.            Subject to paragraph 6, the log book known as LN01A (at Attachment A) is the form and content of the log book to be kept and maintained by holders of line fishing permits in Australian flagged boats fishing on the High Seas in accordance with the conditions of their fishing permits and s42 Fisheries Management Act 1992.

6.         Line fishing concession and permit holders may continue to use the log book known as LN01 until all stocks of LN01 are depleted.
