I, Geoff Richardson, Acting Executive Manager Fisheries, acting as a delegate of the Australian Fisheries Management Authority, make the following determination under subsection 42(1) of the Fisheries Management Act 1991.

Citation

1.This Determination may be cited as Determination No. EFT01B.

Commencement

2.This Determination commences on the day after it is registered on the Federal Register of Legislative Instruments.

Interpretation

3.In this Determination:

“Southern and Eastern Scalefish and Shark Fishery” means all commercial fishing under a concession for the Southern and Eastern Scalefish and Shark Fishery in the sectors defined in Schedule 1 Part 2 (1) and (2) of the Southern and Eastern Scalefish and Shark Fishery Management Plan 2003.

“East Coast Deepwater Zone Fishery” means all commercial fishing under a concession for the East Coast Deepwater Fishery in the area set out in Part 2A of Schedule 1A of the Fisheries Management Regulations 1992.

“Victorian Inshore Trawl Fishery” means all commercial fishing under a concession for the Victorian Inshore Trawl Fishery in the area set out in Part 11B of Schedule 1A of the Fisheries Management Regulations 1992.

“South Tasman Rise Fishery” means all commercial fishing under a concession for the South Tasman Rise Fishery in the area defined in Part 11A of Schedule 1A of the Fisheries Management Regulations 1992.

“Small Pelagic Fishery” means all commercial fishing under a concession for the Small Pelagic Fishery in the area defined in Part 4 of Schedule 1A of the Fisheries Management Regulations 1992.

“Norfolk Island Offshore Demersal Finfish Fishery” means all commercial fishing under a concession for the Norfolk Island Offshore Demersal Finfish Fishery in the area defined in Part 5A of Schedule 1A of the Fisheries Management Regulations 1992.

“High Seas” means all commercial fishing by Australian flagged boats fishing under an Australian Commonwealth issued fishing permit for the High Seas within the area specified on the concession.

[Note: Terms defined in the Fisheries Management Act 1991 have the same meanings in this Determination.]

Determination

4.Subject to paragraph 6, the logbook known as EFT01B (at Attachment A) is the form and content of the log book to be kept and maintained by holders of trawl fishing concessions in the Southern and Eastern Scalefish and Shark Fishery, East Coast Deepwater Zone Fishery, Victorian Inshore Trawl Fishery, South Tasman Rise Fishery, Small Pelagic Fishery, Norfolk Island Offshore Demersal Finfish Fishery, in accordance with the conditions of their fishing concession and s42 Fisheries Management Act 1991.

5.            Subject to paragraph 6, the log book known as EFT01B (at Attachment A) is the form and content of the log book to be kept and maintained by holders of trawl fishing permits in Australian flagged boats fishing on the High Seas in accordance with the conditions of their fishing permit and s42 Fisheries Management Act 1992.

6.            Trawl fishing concession holders may continue to use the logbook known as the EFT01A until all stocks of the EFT01A are depleted.
