Determination 2018/04: Members of Parliament
Pursuant to subsection 45(1) of the Parliamentary Business Resources Act 2017 (the Act), the Remuneration Tribunal has inquired into the rates of travel allowances (or a method for determining the rates) for domestic travel, to be paid out of the public money of the Commonwealth to members by reason of being members of the Parliament or particular office holders, and determines as set out below.
Subsection 47(7) of the Act applies to this determination, so that the disallowance provisions in section 42 of the Legislative Instruments Act 2003 do not apply to it.
This Determination commences on 1 January 2018.
PART 1 - AUSTRALIAN TRAVEL ALLOWANCE
1.1In this part, Determination Number 23 of 2017 is referred to as the Principal Determination.
1.2Part 5 of the Principal Determination is amended by deleting the wording of clause 5.4 and replacing it with the following:
5.4 Where a member, including the Prime Minister or Acting Prime Minister, stays in non-commercial accommodation, the rate of travel allowance for the night is one-third of the rate in clause 5.1 or 5.3, rounded up to the nearest $1. This provision does not apply to stays in Canberra.
1.3Part 5 of the Principal Determination is amended by deleting the wording of clause 5.7 and replacing it with the following:
5.7 ‘Commercial accommodation’ means accommodation in a commercial establishment such as a hotel, motel or serviced apartment. However, if the member does not produce to the Administrator a receipt for accommodation given to the member by the accommodation provider, or provide certification to the Administrator that such a receipt can be produced upon request and does not subsequently provide such a receipt when requested, the accommodation is taken to be non-commercial accommodation.
