Designs Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Designs Act 1906.

Commencement

1. These Regulations commence on the date of commencement of section 31 of the Industry, Technology and Commerce Legislation Amendment Act (No. 2) 1989.

Fees

2. Regulation 4 of the Designs Regulations is amended:

(a) by omitting subregulation (1) and substituting the following subregulation:

“(1) The fee specified in column 3 of an item in Schedule 2 is prescribed for:

(a) the lodging of the document; or

(b) the doing of the act by the Registrar or a person other than the Registrar;

referred to in column 2 of that item.”;

(b) by adding at the end the following subregulation:

“(3) For the purposes of subsection 42 (4) of the Act, the Registrar is to notify the person or his or her agent in writing within 7 days after the lodging of the document, or the doing of the act, for which the fee is payable.”.
