I, The Governor-General of the
Commonwealth of Australia, acting with the advice of the Federal Executive
Council, make the following Regulations under the

1.1 The Designs Regulations are amended as set out in these Regulations.

Subregulation 29 (3):
Omit the subregulation, substitute:
An application under subregulation (2) must be in accordance with Form 9.”.
3.1 After regulation 29, insert:
“29AA. (1) For the purposes of subsection 18 (3) of the Act, the following provisions of this regulation are prescribed.
A person to whom subsection 18 (3) of the Act applies may apply to the Registrar for a licence to do an act that would, but for the operation of this regulation, infringe, or be taken to infringe, the monopoly in a registered design:
(a) in respect of an article or part of an article that is of indefinite extent in one or 2 dimensions; and
(b) to which that subsection refers.
An application under subregulation (2) must be in accordance with Form 9.
A copy of an application must be given by the applicant to the person registered as the owner of the design and, at the direction of the Registrar, to another person.”.
4.1 Subregulation 29A (1):
After “subregulation 29 (2)”, insert “or 29AA (2)”.
4.2 Subregulation 29A (3):
Omit “for a licence under subregulation 29 (2)”.
8.1 Form 9:
Omit the heading, substitute:
“FORM 9 Subregulations 29 (3) and 29AA (3)
COMMONWEALTH OF AUSTRALIA
DESIGNS REGULATIONS
APPLICATION FOR LICENCE”.
8.2 Form 9:
Omit “subregulation 29 (2)”, insert “subregulation *29 (2)/*29AA (2)”.
8.3 Form 9:
Omit “regulation 29”, substitute “regulation 29B”.
9.1 Item 8:
After “subregulation 29 (2)”, insert “or 29AA (2)”.
