Designs Amendment Regulations 1998 (No. 1)2

I, WILLIAM PATRICK DEANE, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following regulations under the Designs Act 1906.

1.   Name of regulations

1.1   These regulations are the Designs Amendment Regulations 1998 (No. 1).

2.   Commencement

2.1   These regulations commence on gazettal.

3.   Amendment

3.1   The Designs Regulations are amended as set out in these regulations.

4.   Regulation 1 (Citation)

4.1   Omit the regulation, substitute:

Name of regulations

 “1. These regulations are the Designs Regulations 1982.”.

5.   Regulation 50AA (Delegation by Registrar under paragraph 8A (1) (a) of the Act)

5.1   Omit the regulation, substitute:

Persons to whom Registrar may delegate (Act, s 8A (1))

 “50AA.(1) For paragraph 8A (1) (a) of the Act, a person holding, or performing the duties of, an office in the Designs Office stated in Part 1 of Schedule 2B is a person to whom the Registrar may delegate all or any of the Registrar’s powers under the Act, except the powers under paragraphs 42A (a) and (c) of the Act.

 “(2) For paragraph 8A (1) (a) of the Act, a person holding, or performing the duties of, an office in the Designs Office stated in Part 2 of Schedule 2B is a person to whom the Registrar may delegate all or any of the Registrar’s powers under the Olympic Insignia Protection Act 1987.”.

6.   Schedule 2A (Convention countries)

6.1   After:

“San Marino”,

insert:

“Sao Tome and Principe, Democratic Republic of”.

7.   Schedule 2B (Prescribed persons—paragraph 8A (1) (a) of the Act)

7.1   Omit the Schedule, substitute:

APS level 6 — Supervising Examiner of Designs

APS level 6 — Manager, Designs Operations
