An Act to authorize the appointment of a Deputy

amongst other things provided that the Office of Registrar General of W H E R E A S by an Act of Council passed in the thirteenth year of the reign of Her present Majesty number forty-five it was
the Colony of New South Wales should be abolished and that the duties before then authorized to be performed and executed by such Registrar General should thenceforth be performed and executed by the Prothonotary and Registrar of the Supreme Court for the time being as principal and the Chief or Principal Clerk of the Supreme Court for the time being as secondary Officer for the purposes therein mentioned And whereas there is no such Officer as the Prothonotary and Registrar of the Supreme Court by reason whereof the said Chief or Principal Clerk is now the only Officer by whom the said duties can be performed and executed and whereas it is necessary to authorize a Deputy to perform and execute the same in case the said Chief or
Principal Clerk shall be unable from sickness or otherwise to attend and perform the said duties or shall be absent from his Office Be it therefore enacted as follows :—
1. I t shall be lawful for the said Chief or Principal Clerk of the Supreme Court with the approbation in writing of the Chief Justice of the Supreme Court or in the absence from Sydney of the said Chief Justice then with the approbation in writing of one of the other Judges of the said Court from time to time to appoint by writing under his hand some person to be and act as his Deputy during his absence from the said Office and in case the said Chief or Principal Clerk shall at any time be unable from any accident or otherwise to appoint such Deputy it shall be lawful for such Chief Justice or other Judge to make such appointment and any such Deputy shall have full power to perform and execute in the absence of the said Chief or Principal Clerk all the duties in the said recited Act mentioned or referred to.
