s1 3 s5 Department of Transport (Repeal of Penalty No. 438, 1994 Notice Provisions) ˙ Short title 1. This regulation may be cited as the Department of Transport (Repeal of Penalty Notice Provisions) Regulation 1994 . ˙ Commencement 2.(1) This regulation commences on 12 December 1994. ˙ Definition 3. In this regulation— “transport regulation” means any of the following— (a) Carriage of Dangerous Goods by Road Regulation 1989 ; (b) State Transport Regulation 1987 ; (c) Tow Truck Regulation 1988 ; (d) Traffic Regulation 1962 ; (e) Transport Infrastructure (Roads) Regulation 1991. ˙ Transport regulations amended 4. Each transport regulation is amended by the Schedule for the regulation. ˙ Transitional 5. Despite the repeal of a provision of a transport regulation by this regulation, the provision continues to apply to a notice issued under the provision that is a notice— (a) to which section 269 of the Justices Act 1886 1 applies; or 1 Section 269 was inserted in the JusticesAct1886 by the OffenceNoticesLegislation Amendment Act 1994 . The section provides for transitional provisions for SETONS.

This regulation expires on the day sections 269 and 270 of the JusticesAct 1886 expire. 2 Section 18 deals with infringement notices.
