AN ORDINANCE

To amend the Dentists Registration Ordinance

1931-1937.

BE it ordained by the Governor-GeneraL in and over the Executive Council, in pursuance of the powers conferred by the Commonwealth of Australia, with the advice of the Federal Seat of Government Acceptance Act 1909-1938 and the Seat of
Government (Administration) Act 1910-1947, as follows:—

1.— (1.) This Ordinance may be cited as the Dentists Kegistra- short title

Hon Ordinance 1954.* and citation-

(2.) The Dentists Registration Ordinance 1931-1937 is in this

Ordinance referred to as the Principal Ordinance.

(3.) The Principal Ordinance, as amended by this Ordinance,

may be cited as the Dentists Registration Ordinance 1931-1954.

2. Section four of the Principal Ordinance is amended— Definitions.

(a) by omitting the definition of " Director-General of

Health " ; and

(b) by inserting after the definition of "The Chairman"

the following definition:—

" ' The Director-General' means the Director-

General of Health of the Commonwealth ; ".

3. Section six of the Principal Ordinance is amended— Members of

(a) by omitting from sub-section (1.) the words "of

Health " ;

(b) by omitting sub-section (2.) and inserting in its stead

the following sub-section:—

" (2.) A person is not eligible for appointment as a member of the Board, other than the Chairman, unless he is, and for a period of not less than five years has been, registered as a dentist in a State or Territory of the Commonwealth.";

(c) by omitting from sub-sections (3.) and (4.) the words

" of Health " ; and

(d) by omitting sub-section (7.) and inserting in its stead

the following sub-section:—

" (7.) A quorum of the Board consists of the member presiding at the meeting (being the Chairman or the Deputy Chairman) and such number of other members as, together with the member so presiding, constitute a majority of the members of the Board.".

Office of 4. Section ten of the Principal Ordinance is amended by

stead the following paragraph:—
"(b) the member ceasing to be a person who is eligible for

appointment as a member of the Board; ".

Qualifi cations 5. Section twenty-two of the Principal Ordinance is amended—
for registration.

(a) by omitting from sub-section (1.) the words "natural-

born or naturalized " ;

(b) by omitting paragraph (b) of sub-section (1.) and

inserting in its stead the following paragraph:—

"(b) holds a recognized certificate as prescribed in this section granted in a place outside Aus- tralia and, in the period during which he has held the certificate, has not been deprived of the qualification it confers for any cause that discpaalifies him from being registered under this Ordinance,";

(c) by omitting from sub-section (3.) the words "portion
of His Majesty's Dominions or in a foreign country "

and inserting in their stead the words " place outside

Australia " ;

(d) by omitting from sub-section (3.) the words " Dominion or country " and inserting in their stead the word " place " ; and

(e) by omitting from the second proviso to sub-section (3.) the words " British Empire " and inserting in their stead the words " Queen's dominions ".

6. Section twenty-five of the Principal Ordinance is repealed and the following section inserted in its stead:—

" 25.— (1.) A certificate of registration issued under sub-section (2.) of section twenty-two of this Ordinance under the hand of the Chairman or Deputy Chairman of the Board is evidence that the

to be so registered.

" (2.) Judicial notice shall be taken of the signature of the Chairman or Deputy Chairman of the Board appearing on a certificate of registration referred to in the last preceding sub- section and of the fact that the person by whom the certificate purports to have been signed was, at the time the certificate was signed, the Chairman or Deputy Chairman of the Board, as the case may be.".

7. Section twenty-seven of the Principal Ordinance is amended by omitting from sub-section (2.) the words "His Majesty the King " and inserting in their stead the words " the Sovereign ".

8. Section thirty of the Principal Ordinance is amended by cancellation

omitting from paragraph (c) of sub-section (1.) the words "any for fraud part of His Majesty's Dominions " and inserting in their stead grounds. the word " Australia ".
9. Section thirty-five of the Principal Ordinance is amended by Person
omitting the words " the last preceding section " and inserting in himself'

their stead the words " section thirty-four of this Ordinance ". penalty.

10. Section forty of the Principal Ordinance is amended by Power of

omitting from sub-section (2.) the words "of Health ". de'S'rnfme0
