DENTISTS (AMENDMENT) ACT, 1977

An Act to amend the Dentists Act, 1934, to permit dental technicians holding practising certificates as dental prosthetists under the Dental Technicians Registration Act, 1975, to carry out certain additional work forming part of the practice of dentistry; and for other purposes. [Assented to, 22nd November, 1977.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—

1 .      This Act may be cited as the "Dentists (Amendment)

Act, 1977".

2.       (1) This section and section 1 shall commence on the

date of assent to this Act.

(2) Except as provided in subsection ( 1 ) , this Act shall commence on the day appointed and notified under section 2 (2) of the Dental Technicians Registration (Amendment) Act, 1977.

3.      The Dentists Act, 1934, is amended in the manner set

forth in Schedule 1.

(1) (a) Section 3 ( 1 ) , definitions of "Dental prosthetist"

and "Dental technician"—

Before the definition of "Dentist", insert : —

"Dental prosthetist" has the meaning ascribed thereto by section 5 (1) of the Dental Technicians Registration Act, 1975.

"Dental technician" has the meaning ascribed thereto by section 5 (1) of the Dental Technicians Registration Act, 1975.

(b) Section 3 (1), definition of "Practice of dental prosthetics"—

After the definition of "Inspector", inse r t :—

"Practice of dental prosthetics" has the mean­ ing ascribed thereto by section 5 (3) of the Dental Technicians Registration Act, 1975.

(c) Section 3 ( 1 ) , definition of "Technical work"—

After the definition of "Regulations", insert :— "Technical work" has the meaning ascribed thereto by section 5 (1) of the Dental Technicians Registration Act, 1975.

(2) Section 11 ( 2 ) —

At the end of section 11, insert :—

(2) Subsection (1) does not apply—

(a) to a dental technician, whether or not he is a dental prosthetist, in respect of his adver­ tising or holding himself out to be a person who is willing or capable or entitled to do

or perform technical work or in respect of his doing any thing that he is not prohibited by section 28 of the Dental Technicians Registration Act, 1975, from doing; or

(b) to a dental prosthetist, in respect of his advertising or holding himself out to be a person who is willing or capable or entitled to do any thing that forms part of the practice of dental prosthetics.

(3) Section 12 (3) ( d ) , ( e ) —

Omit section 12 (3) ( d ) , insert instead :—

(d) the carrying out of technical work by—•

(i) a dental technician;

(ii)   a person bona fide undergoing training in technical work under the super­ vision of a dentist or dental technician or employed as a probationer within the meaning of section 25 (1) of the

Apprentices Act, 1969, by a dental

technician or by a person employing a
dental technician; or

(iii) a person approved by the Dental Technicians Registration Board pur­ suant to section 13 (2) (f) of the Dental Technicians Registration Act, 1975, who is acting within the terms of the approval given in respect of him,

upon the written order, in or to the effect of the form prescribed for the purposes of this paragraph, of a dentist or (where that work is part of the practice of dental prosthetics) in or to the effect of the form prescribed for the

purposes of section 2 7 (b) (ii) of the Dental Technicians Registration Act, 1 9 7 5 , of a dental prosthetist; or

(e) the doing of any act by a dental prosthetist that forms part of the practice of dental prosthetics.
