REGULATION
(Dental Technicians Registration Regulation 1993)

HIS Excellency the Governor, with the advice of the Executive Council,
and in pursuance of the Dental Technicians Registration Act 1975, has
been pleased to make the Regulation set forth hereunder.

Citation
| 1. This Regulation | on may be cited as the Dental Technicians Registration |
Regulation 1993.
Commencement
2. This Regulation commences on 1 September 1993.
Definitions
3. (1) In this Regulation:
“Board” means the Dental Technicians Registration Board;
“Secretary” means the Secretary to the Board;
“the Act” means the Dental Technicians Registration Act 1975.
(2) In this Regulation, a reference to a Form is a reference to a Form
set out in Schedule 1 .

Registration as a dental technician
4. (1) For the purposes of section 15 (1) of the Act, an application for
registration as a dental technician is made in the prescribed manner if the
application is lodged at the offices of the Board.
(2) On the registration of a person as a dental technician, the Secretary
is to prepare and forward to the person a certificate of registration in the
form approved by the Board.
Practising certificates for dental prosthetists
5. (1) For the purposes of section 18B (1) of the Act, an application for a practising certificate for a dental prosthetist is made in the prescribed manner if the application is lodged at the offices of the Board.
(2) On the granting of a practising certificate to a person as a dental
prosthetist, the Secretary is to prepare and forward to the person a
practising certificate in the form approved by the Board.
Order forms for technical work
6. For the purposes of section 27 (b) of the Act, the prescribed form is
Form 1.
Standards of hygiene
7. (1) A dental technician, and any other person lawfully carrying out technical work, must not carry out technical work otherwise than in a hygienic manner and otherwise than in premises that are clean and free from vermin.
Maximum penalty: 2 penalty units.
(2) A dental prosthetist must not practise dental prosthetics otherwise
than in a hygienic manner and otherwise than in premises that are clean
and free from vermin.
Maximum penalty: 2 penalty units.
Certain advertising prohibited
8. (1) A dental prosthetist must not advertise his or her services by
means of an advertisement:
| (a) | that is false, misleading or deceptive or is likely to mislead or deceive; or |
(b) that is vulgar or sensational; or

that claims or implies that any particular dental prosthetist is superior to other dental prosthetists; or
(d)
that contains testimonials or other endorsements of a particular dental prosthetist; or
(e)
that is unprofessional or is likely to bring the practice of dental prosthetics into disrepute.
Maximum penalty: 2 penalty units.
(2) An advertisement is taken to be false, misleading or deceptive:
(a) if it contains a material misrepresentation of fact; or
(b)
if it is likely to create an unjustified expectation of beneficial treatment.
Fees
9. The fees set out in the Table to this clause are the prescribed fees
for the purposes of the provisions of the Act set out in that Table.

Repeal
10. (1) The Dental Technicians Registration Regulation 1976 is
repealed.
(2) Any act, matter or thing that had effect under the Dental Technicians Registration Regulation 1976 immediately before the commencement of this Regulation is taken to have effect under this Regulation.

EXPLANATORY NOTE
The object of this Regulation is to repeal and remake (with minor modifications) the provisions of the Dental Technicians Registration Regulation 1976. The new Regulation makes provision with respect to the following matters:
(a) the registration of dental technicians (clause 4);
(b) the issue of practising certificates to dental prosthetists (clause 5);(c) order forms for technical work (clause 6);
(d)
the standards of hygiene to be observed by dental technicians in the carrying out of technical work and by dental prosthetists in the practice of dental prosthetics (clause 7);
(e) advertising by dental prosthetists (clause 8);
(f) the various fees payable under the Act (clause 9).
This Regulation is made under the Dental Technicians Registration Act 1975,
including section 35 (the general regulation making power).
This Regulation is made in connection with the staged repeal of subordinate
legislation under the Subordinate Legislation Act 1989.
