s1 2 s3 Dental Technicians and Dental Prosthetists No. 460, 1997 Amendment (No. 2) ˙ Short title 1. This by-law may be cited as the Dental Technicians and Dental Prosthetists Amendment By-law (No. 2) 1997 . ˙ By-law amended 2. This by-law amends the Dental Technicians and Dental Prosthetists By-law 1992 . ˙ Replacement of pt 3 (Advertising) 3. Part 3— omit, insert— ‘ PART 3—MISCELLANEOUS ˙ ‘ Advertising not to be false, misleading, deceptive, harmful etc. ‘ 7.(1) A dental technician must not— (a) advertise about the performance of dental technical work in a way that is false, misleading or deceptive or likely to be misleading or deceptive; or (b) advertise dental technical work that is harmful or likely to be harmful; or (c) advertise about the performance of dental technical work in a way that is vulgar or sensational in a way that would be likely to affect adversely the standing of the dental technology profession. Maximum penalty—10 penalty units. ‘ (2) A dental prosthetist must not— (a) advertise about a clinical practice matter in relation to the provision of dental prosthetic services in a way that is false, misleading or deceptive or likely to be misleading or deceptive; or (b) advertise dental prosthetic services that are harmful or likely to be harmful; or
s4 3 s5 Dental Technicians and Dental Prosthetists No. 460, 1997 Amendment (No. 2) (c) advertise about a clinical practice matter in relation to the provision of dental prosthetic services in a way that is vulgar or sensational in a way that would be likely to affect adversely the standing of the dental prosthetics profession. Maximum penalty—10 penalty units. ‘ (3) In subsection (2)— “clinical practice matters ”, in relation to the provision of dental prosthetic services, includes— (a) expected treatment outcomes, including, for example, cures, pain relief or other beneficial outcomes; and (b) the nature or qualities of products, materials, techniques, procedures or equipment used in the course of providing the services; and (c) the field of practice, including, for example, a special area of practice expertise. ‘ (4) However, “clinical practice matters” do not include business or commercial matters in relation to the service, including, for example— (a) the name of the practice providing the services; and (b) the fees payable for services provided by the dental prosthetist.’. ˙ Omission of pt 4 heading (Miscellaneous) 4. Part 4, heading— omit. ˙ Amendment of s 17 (Fees) 5.(1) Section 17(2)— omit, insert— ‘ (2) If a person is registered as a dental technician or dental prosthetist in December of a year, the annual registration fee for the following year is waived.’.
