s1 3 s4 Dental Practitioners Registration and Other No. 27, 2004 Legislation Amendment Regulation (No. 1) 2004 1 Short title This regulation may be cited as the Dental Practitioners Registration and Other Legislation Amendment Regulation (No. 1) 2004 . 2 Commencement Sections 3(2) and 7 and the schedule commence on 1 July 2004. 3 Regulations amended (1) This regulation (other than the schedule) amends the DentalPractitioners Registration Regulation 2001. (2) The schedule amends the regulations mentioned in it. 4 Insertion of new pt 3A After section 8— insert — ‘PART 3A—DENTAL AUXILIARY REGISTRATION ‘8A Qualifications for dental auxiliary registration—Act, s 133C ‘ (1) For section 133C(1)(a) of the Act, a qualification stated in schedule 2A, part 1, column 1, and conferred or awarded by the educational institution stated in column 2 for the qualification, is a qualification for dental auxiliary registration in the category of dental therapy. ‘ (2) For section 133C(1)(a) of the Act, a qualification stated in schedule 2A, part 2, column 1, and conferred or awarded by the educational institution stated in column 2 for the qualification, is a qualification for dental auxiliary registration in the category of dental hygiene. ‘8B Period of registration—Act, ss 56 and 133G ‘For sections 56(1) and 133G(1)(b) of the Act, the dental auxiliary registration period is a financial year.’.

s5 4 s8 Dental Practitioners Registration and Other No. 27, 2004 Legislation Amendment Regulation (No. 1) 2004 5 Replacement of s 11 (Refund of registration fee or specialist registration fee) Section 11— omit, insert — ‘11 Refund of registration fee, specialist registration fee or dental auxiliary registration fee ‘ (1) The board must refund the registration fee accompanying a person’s application for registration, or renewal of registration, if— (a) the board refuses to grant the application; or (b) the person withdraws the application before it is decided. ‘ (2) Subsection (3) applies if, within 3 months after the board decides to register a person or renew a person’s registration, the person surrenders the registration. ‘ (3) The board must refund the registration fee paid by the person less the amount of the registration fee for the registration for a period of registration of not more than 3 months.’. 6 Amendment of s 12 (Refund of restoration fee) Section 12(3)— omit, insert — ‘ (3) The board must refund the registration component of the restoration fee paid by the person less the amount of the registration fee for the registration for a period of registration of not more than 3 months.’. 7 Amendment of s 14 (Prescribed designations and duties of operative dental auxiliaries) Section 14(2), (7) and (7A)— omit . 8 Replacement of pt 6 hdg (Transitional provision) Part 6 heading— omit, insert —

s9 5 s9 Dental Practitioners Registration and Other No. 27, 2004 Legislation Amendment Regulation (No. 1) 2004 ‘PART 6—TRANSITIONAL PROVISIONS ‘Division 1—Transitional provision for Dental PractitionersRegistration Regulation 2001 SL No. 264 ’. 9 Insertion of new pt 6, div 2 After section 15— insert — ‘Division 2—Transitional provisions for Dental Practitioners Registration Amendment Regulation (No. 00) 2004 ‘16 Transitional provision about certain persons—dental therapy ‘ (1) This section applies to a person who, before 1 July 2004— (a) had satisfactorily completed a course of training at a school dental therapists training centre conducted by the department; or (b) had satisfactorily completed— (i) another course of training for dental therapists; and (ii) a retraining or re-entry course approved by the board. ‘ (2) For section 133C(1)(a) of the Act, the person is taken to have a qualification prescribed for registration as a dental auxiliary in the category of dental therapy. ‘17 Transitional provision about certain other persons—dental therapy ‘ (1) This section applies to a person who— (a) before 1 July 2004— (i) held a Diploma in Dental Therapy conferred or awarded by the University of Adelaide; or

s 10 6 s 10 Dental Practitioners Registration and Other No. 27, 2004 Legislation Amendment Regulation (No. 1) 2004 (ii) had satisfactorily completed a course of training for school dental therapists approved by the Minister of Health, South Australia; and (b) was, immediately before 1 July 2004, employed by the department. ‘ (2) For section 133C(1)(a) of the Act, the person is taken to have a qualification prescribed for registration as a dental auxiliary in the category of dental therapy. ‘(3) This section expires on 31 December 2004. ‘18 Transitional provision about certain persons—dental hygiene ‘ (1) This section applies to a person who, before 1 July 2004— (a) had satisfactorily completed a course of dental hygienist training at the School of Para Dental Studies, Gilles Plains Community College, South Australia; or (b) had satisfactorily completed— (i) another course of training for dental hygienists; and (ii) passed an examination set by or for the board, or recognised by the board. ‘ (2) For section 133C(1)(a) of the Act, the person is taken to have a qualification prescribed for registration as a dental auxiliary in the category of dental hygiene.’. 10 Insertion of new sch 2A After schedule 2— insert —
