Part 1—Preliminary

1—Short title

These regulations may be cited as the Dental Practice (General) Variation Regulations 2009.

2—Commencement

These regulations will come into operation on 1 July 2009.

3—Variation provisions

In these regulations, a provision under a heading referring to the variation of specified regulations varies the regulations so specified.

Regulation 3, definition of child—delete the definition

5—Variation of regulation 7—Meaning of supervision

  1. Regulation 7(1)—after "dental practitioner" first occurring insert:

    (the supervising practitioner)

  2. Regulation 7(1)(a)—before "practitioner" insert:

    supervising

  3. Regulation 7(1)(b)—before "practitioner's" insert:

    supervising

  4. Regulation 7(1)(c)—before "practitioner" insert:

  6. Regulation 7(1)—delete paragraph (f) and substitute:

    (f)the treatment is provided in accordance with a supervision agreement between the person and the supervising practitioner.

  7. Regulation 7(2)—delete subregulation (2) and substitute:

    (2)In this regulation—

    supervision agreement means an agreement approved by the Board that specifies—

    (a)the dental treatment that a person may provide only if a dental practitioner whose registration authorises the provision of the treatment of the kind concerned is present on the premises where the treatment is being provided and is available—

    (i)to advise or assist the person in the provision of the treatment; or

    (ii)to intervene in the provision of the treatment,

    as may be necessary in the circumstances of the case; and

    (b)the dental treatment that a person may provide only if a dental practitioner whose registration authorises the provision of the treatment of the kind concerned is contactable by telephone, fax, email or other electronic means to provide advice or instruction to the person, if necessary, while the person is providing the treatment.

6—Variation of regulation 8—Authority conferred by registration as dental prosthetist (section 31(c) of Act)

Regulation 8(d)(i)—delete "but no implants"

7—Variation of regulation 10—Authority conferred by registration as dental therapist (section 31(f) of Act)

  1. Regulation 10(1)—delete subregulation (1) and substitute:

    (1)For the purposes of section 31(f) of the Act, registration on the register of dental therapists authorises—

    (a)a dental therapist employed in the public sector or by a prescribed body in accordance with the conditions of the therapist's employment; or

    (b)a dental therapist employed in the private sector (other than by a prescribed body) under the supervision of a registered dentist or registered specialist,

    to provide—

    (c)dental treatment of a kind prescribed by subregulation (2) to any person; and

    (d)dental treatment consisting of the diagnosis of oral conditions and planning of dental treatment to a person under the age of 18 years.

  2. Regulation 10(2)(b)—delete paragraph (b)

Note—

As required by section 10AA(2) of the Subordinate Legislation Act 1978, the Minister has certified that, in the Minister's opinion, it is necessary or appropriate that these regulations come into operation as set out in these regulations.
