DENTAL HOSPITALS UNION

(AMENDMENT) ACT.

Act No. 25, 1932.

An Act to provide for the appointment of a board of control of the United Dental Hospital of Sydney, and for the control and manage­ ment of such hospital; to validate certain appointments to the board of control, business committee, and executive com­ mittee of such hospital; to amend the Dental Hospitals Union Act, 1904; and for purposes connected therewith. [Assented to, 10th October, 1932.]

BE it enacted b y the King 's Most Excellent Majesty, lative Council and Legislative Assembly of New South b y and with t he advice and consent of the Legis­ Wales in Par l iament assembled, and by the author i ty of
the same, as follows :—
1 . (1) This A c t m a y be cited as t h e " D e n t a l

be read wi th t h e D e n t a l Hospi ta l s Un ion Ac t , 1901 ,

(2) The P r inc ipa l Ac t , as amended by this Ac t ,
may be cited as t he D e n t a l Hosp i t a l s U n i o n Ac t ,

1904-1932.

(1) The appo in tmen t s in the year one t housand

n ine hundred and four teen a n d in subsequen t years of
cer ta in persons to be—

(a) t h e Pres ident of t h e U n i t e d D e n t a l Hosp i t a l
of S y d n e y ; a n d
(b) m e m b e r s of t h e board of control , t he business
commi t t ee or t h e execu t ive c o m m i t t e e of t h e
said hospi ta l ,

are he reby val idated, and shal l be deemed to have been valid, and the offices to which such appo in tmen t s were made shall be deemed to have been val idly created and held.

(2) Section th ree of t he P r inc ipa l A c t shal l be

deemed to have been repealed as from the t e n t h day of

J u l y , one thousand n ine h u n d r e d and fourteen.

3 .     (1) T h e Pr inc ipa l Act is amended—

(a) by omi t t i ng from section two t h e words " a n d
shal l be only for t he g ra tu i tous t r e a t m e n t of

t h e necessi tous poor " ;

(h)

by omi t t i ng from the same section t h e figures " 1898 " and by inser t ing in l ieu thereof t he figures and words " 1929, to the ex t en t to which it applies to separate ins t i tu t ions " ;

(c) by inserting next after section two the follow­
ing sec t ions : —

3. (1) There shall be a board of control of the

U n i t e d D e n t a l Hospi ta l of Sydney, consis t ing

of seven persons appointed by the Governor.

One of such persons shall be so appointed as

the President of t he U n i t e d D e n t a l Hosp i t a l

of Sydney.

(2) The Governor may appo in t persons to fill any vacancies which may from t ime to t ime occur in t he board of control .

(3) The member s of the board shall hold office for a period no t exceeding five years .

4. The board of control may fix and collect
from pat ients such charges for the t r ea tmen t

of pa t ients as to the board may seem proper , to

may waive such charges in any case where it re imburse the cost thereof to the hospital , and

a p p e a r s tha t the circumstances of the pa t ien t a r e such tha t to require payment would inflict

undue ha rdsh ip .

5. The Governor may make regula t ions pre­ scr ibing all m a t t e r s a n d th ings necessary and convenient to be prescribed for t he cont ro l and m a n a g e m e n t of t h e said hospital , a n d for t he ca r ry ing in to effect of this Act .

Such regula t ions sha l l—
(a) be publ ished in t he G a z e t t e ;

(b)

take effect from the date of such publication or from a later date to be specified in the regulations;

(c)

be laid before both Houses of Parliament within fourteen sifting days if Parliament is in session, and if net. then within fourteen sitting days after the commencement of the next session.

If either Home of Parliament passes a resolution of which notice has been given at any time within fifteen sitting days after such regulations have been laid before such House disallowing any regulation or part thereof, such regulation or part thereof shall thereupon cease to have effect.

(2) Subsection one of this section shall commence on a day to be appointed by the Governor, and notified by proclamation published in the Gazette.

4 . On the date appointed Id: the commencement of subsection one of section three of this Act the persons holding office as President and as members of the board of control or of the business committee or of the executive committee of the said hospital immediately before such date shall cease to hold office, but any of such persons shall be eligible to be appointed as President or as such members as from the said date, or at any time thereafter.
